Abstract

AbstractThe doctrine of Judicial Restraint and Judicial Activism has become a debate indemocraticcountriesondecisionsrelatedtothepresidentialnominationthreshold(presidential threshold) made by the Constitutional Court. In the application of judicialrestraint, judges are more self-limiting in deciding a case and are more restrained in theirauthority, in contrast to judicial activism which is more active and brave in providing newlegal breakthroughs on the norms being tested. In this paper, the formulation of the problemto be discussed is How the Decision of the Constitutional Court Judges Applying the Doctrineof Judicial Restraint Against the Presidential Threshold Lawsuit in the Presidential Electionand the Development of Democracy in Indonesia and How the Relationship between theDecision of the Constitutional Court Judges Using the Doctrine of Judicial Activism Againstthe Presidential Threshold Lawsuit in the Presidential Election and the Development ofDemocracy in Indonesia. This paper also uses normative legal research methods, which is aprocess to analyze legal rules, legal principles and legal doctrines. The problem approach inthis writing is the statute approach and conceptual approach.

Abstract

The development of marine tourism area is one of the forms of tourist management areas which strive and aim to provide benefits, especially for the protection, preservation and utilization of tourism potential and environmental services of natural resources, specifically in coastal areas. In the development of marine tourism areas, it is necessary to determine the exact location of each region so that there is no imbalance between the residential growth with marine tourism areas which being managed and utilized for recreational activities. The welfare of the community can be seen from various components that can describe whether the community is already in a prosperous life or not. Visible components include the state of housing in which they live, the level of education, and health. The role of the tourism sector, especially marine tourism in Lamongan City, can be seen from its contribution to gross regional domestic product (PDRB) in terms of labor absorption and business opportunities. The increasing contribution of the trade sector, hotels, and restaurants donated to gross regional domestic product (PDRB), are an overview of the role of the tourism sector. The purpose of this study can be described as follows: 1). To find out how extent the influence of marine tourism development on community welfare in Lamongan District. 2). To find out how extent the influence of marine tourism development on GDRP growth in Lamongan District. For the method of the study, primary data collection was conducted by interview and observation, while secondary data was obtained from Lamongan Tourism Office as well as literature study, who’s the data is in the form of general conditions and the number of visitors in the area.

Abstract

Village government has a strategic role in village financial management based on Law Number 6 of 2014 concerning Villages. However, the management of village funds that is not transparent and accountable has the potential to give rise to corruption crimes. The Jotosanur Village Regulation is present as a preventive effort to prevent corrupt practices through good governance arrangements. This research uses a normative juridical approach by analyzing laws and regulations, literature, and related documents, such as Law Number 6 of 2014, Regulation of the Minister of Home Affairs Number 113 of 2014. The Jotosanur Village Regulation regulates the management of village funds, budget transparency, and supervision by the Village Consultative Body (BPD) and the community. This provision is in line with the principles of good governance, namely transparency, accountability, and community participation. However, implementation faces challenges such as low capacity of village officials and lack of community participation. Internal and external oversight mechanisms, as well as anti-corruption education, are important factors in supporting the effectiveness of these regulations.  The Jotosanur Village Regulation has a strong legal foundation and has the potential to be effective in preventing corruption through strengthening village governance. However, its effectiveness depends on increasing the capacity of village officials, community participation, and synergy with relevant institutions.
