Abstract

Abstract: Bride-napping in the Sumba community is one of the traditional practices that continue to be carried out and preserved to this day. Ideally, bride-napping holds profound and noble philosophical values when performed per established norms and customs. However, in reality, this tradition is often misunderstood and irresponsibly conducted, turning it into a criminal act of sexual violence against women who become victims of misinterpreted bride-napping practices. This paper aims to examine and elaborate on how a tradition of high noble value can transform into a criminal act when carried out contrary to customary norms. The method used in this study is normative descriptive, sourced from library research. Ultimately, all cultures and traditions in society deserve our respect and appreciation to ensure their preservation as part of the nation's identity. However, no tradition or culture should cause harm or disruption within the community. The Sexual Violence Crimes Act (UU Tindak Pidana Kekerasan Seksual) is one of the legal frameworks that can serve as a foundation and motivation to continue advocating for the rights and freedom of women, particularly for women in Sumba who fall victim to irresponsible and norm-violating bride-napping practices.Keywords: Customary Law, Bride-Napping, Sumbanese, Sexual Violance

Abstract

Kawin tangkap pada Masyarakat Sumba merupakan salah satu praktik tradisional yang masih terus dilakukan dan dilestarikan hingga saat ini. Sesungguhnya, bila dilakukan sesuai dengan ketentuan dan norma yang berlaku, kawin tangkap mengandung nilai filosofis yang tinggi dan luhur, namun pada kenyataannya kebudayaan ini seringkali dilakukan secara salah kaprah dan tidak bertanggung jawab, sehingga akhirnya berujung menjadi tindak kejahatan kekerasan seksual terhadap perempuan yang menjadi korban praktik kawin tangkap salah kaprah. Untuk itu, penulisan ini ingin mengkaji dan menguraikan bagaimana suatu tradisi yang bernilai luhur tinggi berubah menjadi tindak kejahatan ketika dilakukan secara bertentangan dengan norma adat. Metode yang dipakai dalam penulisan ini adalah normatif deskriptif yang bersumber dari data kepustakaan. Pada akhirnya, segala budaya dan tradisi yang ada di masyarakat patut kita hargai dan sayangi agar terus lestari sebagai jati diri bangsa dan negara, namun jangan sampai atas nama tradisi dan budaya, justru menyebabkan kerugian dan kericuhan di masyarakat. Undang-Undang Tindak Pidana Kekerasan Seksual adalah salah satu produk hukum yang bisa dijadikan dasar dan semangat untuk terus memperjuangkan hak dan kebebasan perempuan, khususnya bagi perempuan-perempuan di tanah Sumba yang menjadi korban dari praktik kawin tangkap yang dilakukan secara tidak bertanggung jawab dan bertentangan dengan norma dan ketentuan adat yang berlaku.

Abstract

Abstract: This paper discusses the implementation of diversion as a form of solution to criminal cases of children with legal problems outside the formal legal institution mechanism. Diversion is seen as a humanist solution because it puts forward the basis of restorative justice and protection of children's rights, as contained in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (UU SPPA). This study uses a theoretical approach through child protection theory and restorative justice theory, and highlights the effectiveness of diversion in practice, including various challenges faced from normative, structural, cultural, to technical operational aspects. The results of the study show that the implementation of diversion has not run optimally due to limited regulations, lack of understanding of the apparatus, lack of supporting infrastructure, and community resistance to non-retributive approaches. In addition, the inconsistency of evaluative data and uneven implementation between regions also worsen the condition. Therefore, it is necessary to strengthen regulations, increase the capacity of human resources, enlighten the community, and synergize between institutions to ensure the implementation of effective and equitable diversion. Diversion that is carried out substantially is expected to be a means of social rehabilitation and long-term protection for children in the Indonesian legal system.Keywords: diversion, children in conflict with the law, restorative justice, child protection, UU SPPA.
