Abstract

This study examines the laws and regulations in Indonesia that contain material related to cyberspace. The goal to be achieved is to provide a detailed description of the problems contained in laws and regulations, especially at the level of laws related to cyberspace, their implications in people's lives, and appropriate concepts to solve these problems. The method used is normative legal research with a state approach. The results of this study indicate that there is regulatory obesity that regulates cyberspace in Indonesia. There are 30 regulations at the statutory level. Moreover, the content material contained in it is still general in nature and has not been integrated with one another. This fact creates legal uncertainty in the realm of implementation, creating loopholes that can be exploited by irresponsible parties to carry out cyber crimes, such as the spread of negative content, cyber attacks, hacking and theft of personal data. The rise of crimes that occur in cyberspace is very detrimental to the wider community, disrupts security and public order, and even threatens the resilience of the state. Therefore, it is necessary to reform in the realm of law, namely by applying the omnibus method to draft universal sweeping laws that can integrate legal norms in many laws effectively and efficiently. ABSTRAK Penelitian ini mengkaji tentang peraturan perundang-undangan di Indonesia yang memuat materi terkait ruang siber. Tujuan yang hendak dicapai yaitu memberi gambaran secara detail mengenai problematika yang terdapat dalam peraturan perundang-undangan, terutama di tingkat undang-undang yang terkait dengan ruang siber, implikasinya dalam kehidupan masyarakat, dan konsep yang sesuai untuk menyelesaikan permasalahan tersebut. Metode yang digunakan ialah penelitian hukum normatif (normative legal research) dengan pendekatan undang-undang (statue approach). Hasil penelitian ini menunjukkan bahwa terjadi obesitas regulasi yang mengatur ruang siber di Indonesia. Regulasi tersebut berjumlah 30 di tingkat undang-undang. Terlebih, materi muatan yang terkandung di dalamnya masih bersifat general dan belum terintegrasi satu sama lain. Kenyataan yang demikian itu menimbulkan ketidakpastian hukum di ranah implementasi, sehingga menimbulkan celah yang dapat dieksploitasi oleh pihak-pihak yang tidak bertanggung jawab untuk melancarkan kejahatan siber, seperti penyebaran konten negatif, serangan siber, peretasan dan pencurian data pribadi. Maraknya kejahatan yang terjadi di ruang siber sangat merugikan masyarakat luas, mengganggu keamanan dan ketertiban umum, bahkan mengancam ketahanan negara. Oleh karena itu, dibutuhkan reformasi di ranah undang-undang yaitu dengan menerapkan metode omnibus untuk merancang undang-undang sapu jagat yang dapat mengintegrasikan norma-norma hukum dalam banyak undang-undang secara efektif dan efisien.

Abstract

Penulisan ini bertujuan guna mengetahui pola Desentralisasi Asimetris proses pengisian jabatan Kepala Daerah dalam pelaksanaan demokrasi di Indonesia. Penulisan ini menggunakan metode yuridis normatif, dengan spesifikasi penelitian deskriptif analitis. Dalam pembahasan diuraikan bahwa dalam Konstitusi Indonesia Desentralisasi asimetris ditegaskan dan diakui hingga saat ini. Terdapat 4 (empat) daerah yang mempunyai ciri khusus dalam pengisian jabatan kepala daerahnya. Keempat daerah tersebut adalah DKI Jakarta, Daerah Istimewa Yogyakarta, Papua, dan Aceh. Realita pada pemerintahan daerah, landasan yuridis konstitusional berlakunya desentralisasi asimetris tersebut dapat ditinjau pada Pasal 18A ayat (1), dan Pasal 18B ayat (1) UUD 1945. Satuan-satuan pemerintahan daerah khususnya keberagaman pengisian jabatan kepala daerah diakui dalam pelaksanaannya.

Abstract

This study focuses on discussing the legal ratio of ultra vires rulings by constitutional judges as a manifestation of judicial activism. The ultra vires ruling has created a dialectic between preventing rechtvacum to uphold constitutional justice and the threat of judicial autocracy because the Constitutional Court exceeds its authority as a negative law. The purpose of this study is to comprehensively describe the dialectics of affirming ultra vires decisions by the Constitutional Court in accordance with human rights based on constitutional justice, as well as to analyze the application of the ultra vires doctrine to the actions of the Directors in hiring workers/labourers with work agreements for a certain time. The research method used is normative legal research with a legal approach and a contextual approach. The results of this study indicate that ultra vires decisions by constitutional judges are an unavoidable legal necessity. This is because normatively, sociologically, and in principle they are not contradictory. Therefore, ultra vires needs to be done with methods and sources to find the right law/constitutional to prevent rechtvacuum and overlapping judges in dealing with problems that are constantly changing without destroying checks and balances and creating a mini-parliament

Abstract

Since the Constitutional Court is the guardian of democracy and the constitution, it is responsible for ensuring that elections in Indonesia are held in a democratic manner. The power rotation process must be carried out calmly and collectedly, without any significant breaches of people's fundamental rights or acts of violence. The instrument of authority is a necessary component for the Constitutional Court to achieve all of the goals stated in the text. The functioning of the Constitutional Court's authority to resolve disputes relating to the outcomes of Indonesia's regional head elections will be further examined in this research. Then, in order to determine the necessary treatments, a worldwide comparison of the increasing symptoms with those of other countries will be carried out. The research methodology used is doctrinal legal study using a comparative constitutional research strategy. The findings demonstrated the weakness of the Constitutional Court's authority to resolve disputes over the outcomes of regional head elections. It was observed that there were three distinct interpretations of the norms that formed the basis for legitimacy, which resulted in progressive changes to this authority. The Republic of Indonesia's 1945 Constitution's ambiguous normative framework for regional head elections has led to ongoing interpretations It is really unique in light of the fact that the constitutions of 43 of 72 unitary nations in the world fully regulate election procedures and the course of dispute settlement in the event of a dispute. In fact, they specifically mention in one or more of the Constitutional Court's complete authority articles the nature of authority and the scope of elections. It is imperative to promptly establish the precedent with clear legal politics declaring that regional head elections are elections in order to guarantee that the Constitutional Court hears the majority of cases.
