Abstract

jurnal ini membahas mengenai budaya Carok sebagai adat istiadat orang madura (suku madura) dalam menyelesaikan permasalahan ditengah masyarakat berkaitan dengan penghinaan atau perselisihan dengan tujuan mempertahankan harga diri. Budaya hukum carok ini ini salah satu yang solusi atau penyelesaian tentunya bertentengan dengan hukum positif yaitu Hukum Pidana Indonesia. Tentu ini menjadi suatu permasalahan yang ada ditengah masyarakat hukum adat madura mengenai eksistensi budaya hukum carok ditengah masyarakat Indonesia yang multicultural sehingga budaya carok dalam masyarakat adat madura sedikit demi sedikit bisa tergerus. Dalam penulisan jurnal ini menggunakan metodelogi normatif dengan membahas budaya hukum carok dalam penyelesaian permasalahan bagi masyarakat madura itu sendiri dengan hukum positif yang berlaku di Indonesia dengan memberi kasus-kasus dalam 2-3 tahun terakhir dan dengan melalui jurnal ini dapat pula diketahui bagaimana peran dari pemerintah, tokoh adat dan tokoh agama dalam memberikan pemahaman untuk tidak menggunakan penyelesaian permasalahan dengan carok yang bertentangan dengan hukum positif di Indonesia.

Abstract

Upon the death of an individual, their legal rights and obligations do not extinguish but are transferred to their heirs in accordance with prevailing inheritance laws. In the Indonesian legal system, inheritance is governed by a pluralistic framework that incorporates both religious and civil law. Copyright, as an exclusive right granted to creators over their original works in the fields of art, literature, and science, is recognized as inheritable property. Despite its intangible nature, copyright possesses economic value and is therefore classified as part of the deceased’s estate. Conflicts often arise among heirs concerning the division and control of copyrighted works, particularly in sectors such as the music industry, which play a vital role in Indonesia's cultural and economic landscape. This study addresses two central research questions: (1) To what extent do economic rights remain attached to a creator’s work posthumously? and (2) What legal protections are afforded to heirs with respect to these economic rights? The findings reveal that economic rights associated with copyrighted works constitute intangible assets within the broader category of intellectual property. These rights are automatically transferred to the legal heirs upon the death of the creator, as stipulated by Indonesia’s Copyright Law (Law No. 28 of 2014) and relevant inheritance law, without necessitating any additional legal formalities. Consequently, copyright is legally recognized as a valid object of inheritance, enabling heirs to exploit, assign, or derive economic benefits from the work. Establishing clear and consistent legal frameworks for the inheritance of copyright is crucial in ensuring legal certainty and safeguarding the rights of heirs, thereby preventing potential disputes.

Abstract

Mining companies listed on the Indonesia Stock Exchange in 2013-2017 are the objects of this study. The value of the company is influenced by capital structure and profitability and the size of the company is the destination to be known. Exploratory is the type in this study by looking at secondary data published by the official website of each mining company. Purposive sampling becomes a data collection technique with a total of 21 mining companies. The results of the study using PLS 3.0 analysis show that firm value is positively influenced by profitability and company size. Capital structure is positively influenced by capital size. Other results from this study indicate that capital structure is not significantly affected by profitability. The value of the company is also not negatively affected by the capital structure.
