Abstract

Islam mendorong pemeluknya untuk giat bekerja. Dengan bekerja manusia akan memperoleh penghasilan yang dapat memenuhi kebutuhan hidupnya sehari-hari. Namun demikian, bekerja dengan sebaik-baiknya tidaklah cukup tanpa adanya penyisihan pendapatan selama aktif dalam bekerja. Dengan cadangan pendapatan tersebut ketika seorang memasuki masa kurang produktif masih memiliki sumber pendapatan. Hal itu tentunya dapat dilakukan dengan cara mempersiapkan bekal untuk hari tua yaitu dengan dana pensiun. Pemberian pensiun pada karyawannya bukan saja hanya memberikan kepastian penghasilan masa depan, akan tetapi juga ikut memberikan motivasi bagi para karyawannya untuk lebih giat bekerja. Dari pandangan ini, mendorong penulis untuk melakukan penelitian untuk mengetahui mekanisme pengelolaan dana pensiun di BPRS Sumekar Sumenep dengan perspektif ekonomi syariah. Penelitian dilaksanakan dengan pendekatan deskriptif kualitatif. Data diperoleh dari sumber primer dan sekunder dengan tehnik observasi, wawancara, dan dokumentasi. Data dianalisis dengan tahapan reduksi data, penyajian data, verifikasi data, dan penarikan kesimpulan. Sebelumnya data diuji validitasnya dengan metode perpanjangan pengamatan dan triangulasi. Hasil penelitian menyimpulkan bahwa (1) mekanisme pengelolaan dana pensiun dalam pemberdayaan masyarakat yang diterapkan di BPRS Bhakti Sumekar Sumenep yaitu berpedoman pada kaidah-kaidah keterbukaan, akuntabilitas, pertanggungjawaban, dan kesetaraan, serta menggunakan sistem Mudharabah dengan Deposito Mudharabah Mutlaqhah, (2) mekanisme penyaluran dana pensiun yang diterapkan di BPRS Bhakti Sumekar Sumenep yaitu dengan melakukan pengawasan ketat sebelum dana disalurkan, baik dengan cara diantar ke rumah nasabah atau datang langsung ke bank.

Abstract

The term standard clause is often used specifically in the practice ofbuying and selling that occurs between businesses and consumers.Consumers are forced to accept it even though this is a unilateralagreement in the form of transfer of responsibility by business actors toconsumers. As a result of the existence of this standard clause if there is adefect in the goods that have been purchased, the consumer cannotreturn the item back wherein in Islamic law the business / purchasetransaction is determined by the validity of a contract that is carried outand discussed in the division of khiyar rights. In addition, this standardclause is also regulated in Law No. 8 of 1999 concerning ConsumerProtection (UUPK).Thus, the focus of this research objective is to find out the application ofstandard clauses in business practices and to describe the approach ofIslamic law and La w no. 8 of 1999 concerning consumer protectionagainst standard clauses in business practices or buying and selling.In the approach of Islamic law the application of this standard clausemust be carried out in an interadin manner. While according to Law no. 8of 1999 concerning Consumer Protection (UUPK) the application of thisstandard clause continues to provide protection for consumers infulfilling the rights of consumers to be served properly and notdiscriminatory as well as the right to get compensation in the form ofreplacement of similar goods if there is a disability.

Abstract

The issue of inheritance is often a cause of chaos and conflict in various parts of the world. Inheritance problems can occur from determining heirs or how to distribute the inheritance. And the solutions are sometimes simple (mutually voluntary) and not infrequently some are complicated so that the Religious Court judges participate in helping to solve it fairly. To facilitate understanding in this study, researchers used qualitative research methods. By multiplying the data sources from various literatures relating to the distribution of inheritance. The data obtained by researchers in the field included interviews with lawyers, judges and clerks at the Banyuwangi Religious Court to determine the implementation of Article 185 KHI. In addition, the data collection techniques were carried out by researchers by means of interviews, observation and documentation. In this study, the presence of researchers is also very important because researchers are human instruments as well as data collectors. From the results of the research that the researchers obtained, it can be concluded that firstly, the implementation of Article 185 of the KHI regarding the replacement heir is the person who gets the inheritance to replace the real heir because he died earlier than the heir. The concept of a substitute heir is not only on the up and down path, but can also be implemented on a sideways route. And the share of the successor heir is not more than the share of the heir which is equal to him and who is replaced. Second, the decision of the Banyuwangi Religious Court judge number 2659 / Pdt.G / 2016 / PA.Bwi which gives portions to sons and daughters of sisters (nephews) can be justified under Islamic law. Because the successor heir is related to lafadz al-mawaali in the verse 33 of Surah An-Nisa '. However, the existence of a part of the mandatory will that is given to one of the successor heirs needs to be considered. Because the judge's ijtihad as outlined in the decision as jurisprudence is applied meaning casuistic, the judge also needs to pay attention to justice. It is better if the replacement heir with the status of an adopted child is given only one part. Abstract

Nusyuz is one of the themes discussed in the Quran. This study focuses on the disobedience of career women in the perspective of Islamic law which prioritizes justice and the relationship between husband and wife. It can be understood that nusyuz is an act of neglecting the obligations of husband and wife that causes estrangement of relations in the household with the provisions, nusyuz action is carried out with certain motives, and aims to degrade the dignity of one party. The more developed the situation, the more women's desire to move forward and develop their careers in the world of work. These working women are usually called career women, some of whom have different opinions regarding this, some allow it on conditions, and some do not absolutely allow it. The issue of women is indeed the most actual thing to talk about considering times have changed, the mindset of humans has also changed, in this modern era there are still people who look down on women, and discriminate against them. Although there are many who are interested in conducting research related to this case. The natural privileges possessed by men and women lead to differences in functions, and the main roles between the two. Islam obliges a man as a husband to provide for his wife and children, however, it does not necessarily rule out the possibility that a woman as a wife also earns a living to fulfill the family economy. Islam itself places men and women in a balanced and equal position. The problem behind the misunderstanding between the two is that there is a misunderstanding in constructing the social roles between men and women as a result of the interpretation of the Qur'anic text in particular and it seems incomplete. While basically the relationship between husband and wife, men and women is a partnership, which must support each other.

Abstract

YouTube is a social media that is in demand by many people of all age groups. Because of this, many people make YouTube a source of income. The way to make money from YouTube or called the Monetization system, requires YouTubers to enter into a cooperation agreement with the YouTube Partner Program. YouTubers who have made a contract by agreeing to all the rules from the YouTube Partner Program, but in practice they often violate these rules, in practice sometimes many YouTubers whose content violates Islamic Sharia and violates the rules of the YouTube community. The final conclusion from this research according to the Sharia Economic Law Perspective on creator content income on the YouTube Channel is allowed, because the agreement made by YouTubers and the YouTube Partner Program is with the pleasure of YouTubers by agreeing to the terms made by the YouTube Partner Program by clicking " Agree" to all the rules. on the channel there is no content that is prohibited by Islamic law and does not violate the approved rules of the YouTube community guidelines. So, the law of the contract remains valid because the principles and conditions have been meet.

Abstract

Humans are creatures that cannot live individually. Definitely need help from other people in living a life. One proof of the truth of this statement is the presence of marriage. Marriage is a path taken by men and women who love each other and have a strong desire to create a family. A sakinah, mawaddah and rahmah family is of course the goal of all married couples, and this cannot be achieved without cooperation between husband and wife in the form of fulfilling the rights and obligations between the two which are based on equality, balance and justice. Based on the explanation above, it is important to have effective communication, in undergoing a husband and wife relationship, especially for husband and wife who are far apart, which is popularly known as Long Distance Relationship (LDR) or Long Distance Marital in Relationship. Frequently communicating effectively can be a joy for a husband and wife because they have not met for a long time, but on the other hand, the lack of effective communication between the two can cause problems in the family which will end in divorce

Abstract

Marriage in Islam is not simply an ordinary contractual or civil relationship, but it has the value of worship, so it needs to be regulated with certain requirements and pillars that must be fulfilled so that the purpose of making marriage legal can be achieved. Marriage is an important thing in Islam, Islam regulates the procedures for family life so that a sakinah, mawaddah warahmah family is formed. Because this is basically the dream and goal of every marriage that takes place. In this modern era, we often hear the word arranged marriage which is usually called forced marriage. Abstract

Marriage is a very important dimension of life in human life. So it is not surprising that religions in the world regulate marriage issues even according to traditions or customs among local communities, and state institutions also do not lag behind in regulating marriages that apply among the community. The purpose of marriage according to the Islamic religion is to fulfill religious instructions in order to establish a harmonious, prosperous and happy family, harmony in exercising the rights and obligations of family members. Prosperous means the creation of inner and outer peace due to the fulfillment of life's and inner and outer needs, so that happiness arises, namely affection between family members Premarital guidance for those who are getting married is highly recommended because it provides provisions for both parties so that family life can be adjusted to religious guidance, and marriage can be able to give birth to a harmonious family
