Abstract

At the present time, traveling has become secondary requirement for people, to get rid of fatigue after work or just entertain themselves. It takes no less amount of people who like nature tourism and ecotourism. In Jember city, there is one very interesting nature tourism called the Tancak Panti Waterfall which is located in Suci Village. However, the question arises : Can the Tancak Panti Waterfall obtain authorization or licence as nature tourism? Does the Suci Village Government and the local community should be apply for requirements and qualifications to granted the licence? The aim in this article is to determine the method of normative and empirical legal research with the typical characteristics of the methods of researching Law. The result of the first discussion is that the Tancak Panti Waterfall Tourism Destination has the right to obtain licence as nature tourism in accordance with Article 33 Number (1) of Government Regulation Number 3 of 2008 on amendments to Government Regulation Number 6 of 2007 concerning Forest Management and Preparation of Forest Management Plans, As well as Forest Utilization which states that the Tancak Waterfall can obtain licence for nature tourism. The result of the second discussion is that the Suci Village Administration and the local community have the right to apply for licence in accordance with Article 67 Paragraph (2) of Government Regulation Number 3 of 2008 regarding amendments to Government Regulation Number 6 of  2007 concerning Forest Management and Preparation of Forest Management Plans, as well as Forest Utilization.

Abstract

The Constitutional Court decision No.013-022/PUU-IV/2006 issued in 2006, it was stated that the article on insulting the President contained in Article 134, Article 136 and Article 137 of the Criminal Code no longer had binding legal force. The Constitutional Court stated that in its ratio decidendi regarding the abolition of the article on insulting the President and/or Vice President, namely with several considerations: 1) The Criminal Code is a legacy of Dutch colonialism. 2) Give rise to legal uncertainty (rechtsonzekerheid) and the principle of equality before the law does not apply. 3) protection of human rights. The redaction of the article on insulting the President and/or Vice President as stated in Article 217-Article 218 of Law the Criminal Code is no different from the redaction of the article on insulting the President and/or Vice President which has been declared unconstitutional by the Constitutional Court. Minimize the occurrence of a judicial review in the next three years regarding the article regarding insulting the President and Vice President. So the restrictions on the article regarding insulting the President and Vice President can be regulated by equivalent legal regulations, such as government regulations as a matter of urgency in explaining the article.

Abstract

Legal protection is a right that every citizen should be able to enjoy equally and fairly from their government. However, in reality there are still many people who do not receive proper legal attention or protection. Law NRI Number 13 of 2003 concerning Employment, here in after referred to as UUK in Indonesia, is a law that is used to regulate all matters related to or related to workers’ labor and tenure. This research examines legal protection in fixed-team work agreements (PKWT) in terms of workers’ rights guarantess according to Law. The research method used uses an approach through statutory regulations. The research result show that the Specific Time Work Agreement (PKWT) provides legal protection to workers, although there are several weaknesses that need to be corrected. It is important to continue to improve and strengthen legal protection for workers who are bound by a (PKWT) in accordance with the provisions of the Law.

Abstract

Article 103 paragraph 4 in PP No. 28 of 2024 concerning Health states the Provision of contraceptives for school-age children. The provision of contraceptives for school-age children is contrary to the principle of legal protection for children. Legal issues in this study: 1) Is the Provision of Contraceptives for School-Age Children Not Contrary to the Principle of Legal Protection for Children; 2) What is the Ratio Legis of the Regulations on the Article on the Provision of Contraceptives for School-Age Children in PP No. 48 of 2024 concerning Health. The purpose of this study is to determine and analyze the ratio legis and the regulation of the Provision of Contraceptives for School-Age Children Not Contrary to the Principle of Legal Protection for Children. This type of research is normative juridical. The results of the study are the ratio legis of PP No. 28 of 2024 concerning Health is to increase understanding and access for school-age and adolescents to reproductive health. Meanwhile, no additional explanation was found in Article 103 paragraph 4 point e regarding the provisions for the provision of contraceptives. If the focus is on those who are married, this is not in accordance with the category of the school age range that is allowed to marry. Meanwhile, if the focus is on education, it is less appropriate because the concept of provision means providing "physical goods" directly to school-age individuals. ABSTRAK Pasal 103 ayat 4 dalam PP No 28 Tahun 2024 tentang Kesehatan menyebutkan Penyediaan alat kontrasepsi bagi anak usia sekolah. Penyediaan alat kontrasepsi untuk anak usia sekolah bertentangan dengan prinsip perlindungan hukum bagi anak. Isu hukum dalam penelitian ini: 1) Apakah Penyediaan Alat Kontrasepsi Untuk Anak Usia Sekolah Tidak Bertentangan dengan Prinsip Perlindungan Hukum Bagi Anak; 2) Apa Ratio Legis Pengaturan Tentang Pasal Penyediaan Alat Kontrasepsi Bagi Anak Usia Sekolah pada PP No. 48 Tahun 2024 Tentang Kesehatan. Tujuan dari penelitian ini adalah Untuk mengetahui dan menganalisis ratio legis dan pengaturan Penyediaan Alat Kontrasepsi Untuk Anak Usia Sekolah Tidak Bertentangan dengan Prinsip Perlindungan Hukum Bagi Anak. Jenis penelitian ini yuridis normatif. Hasil penelitian adalah ratio legis dari PP No. 28 Tahun 2024 tentang Kesehatan adalah meningkatkan pemahaman dan akses bagi usia sekolah dan remaja terhadap kesehatan reproduksi. Sementara tidak ditemukan penjelasan tambahan dalam Pasal 103 ayat 4 poin e mengenai ketentuan penyediaan alat kontrasepsi. Jika fokus pada yang telah menikah, hal ini kurang sesuai dengan kategori rentang usia sekolah yang diperbolehkan menikah. Sementara jika fokus untuk edukasi kurang sesuai karena konsep penyediaan yang tersebut berarti memberikan “barang fisik” secara langsung kepada individu dengan usia sekolah Kata Kunci: Perlindungan Hukum; Anak Usia Sekolah; Alat Kontrasepsi
