Abstract

Mahkamah  Konstitusi  memiliki kewenangan  MK  berwenang  mengadili pada tingkat  pertama  dan terakhir  yang  putusannya  bersifat  final untuk  menguji  Undang-undang  terhadap  Undang-undang  Dasar, memutus sengketa kewenangan lembaga negara yang kewenangannya diberikan oleh Undang-undang Dasar, memutus pembubaran partai politik, dan memutus perselisihan tentang hasil pemilihan umum. Keberadaan Mahkamah Konstitusi sebagai pengawal konstitusi . Dengan konsekuensi itu juga MK berfungsi sebagai penafsir final konstitusi.  Mahkamah Agung sebagai pelaku kekuasaan kehakiman  juga diberikan kewenangan  untuk melakukan uji materiil terhadap peraturan perUndang-undangan dibawah  Undang-undang terhadap Undang- undang di Indonesia. Rumusan masalah dalam tulisan tesis ini terdapat tiga rumusan masalah. Pertama Apakah MK   telah melakukan Pergeseran Fungsi Yudikatif   dengan Putusan Mahkamah Konstuisi Nomor 102/PUU- VII/2009, kedua Apakah MK  telah   melakukan Perubahan Konstitusi terhadap Pasal 24 C Ayat (1) dengan Putusan MK Nomor 34/PUU-XI/2013, dan ketiga Apakah MA   melalui Perma Nomor 1 Tahun 2011 telah melakukan pergeseran fungsi Yudikatif. Mahkamah Konstitusi dalam dalam melaksanakan kewenagannya melakukan pengujian Undang-undang terhadap UUD NRI Tahun 1945 tersebut menurut pasal 24C Ayat (1) adalah mengadili pada tingkat pertama dan terakhir yang putusannya bersifat final. Putusan MK Nomor 34/PUU- XI/2013 telah meniadaan sifat dari putusan  Mahkamah Konstitusi yang semula sifat putusannya bersifat final menjadi tidak final lagi. Oleh karenanya perubahan konstitusi telah berubah terhadap ketentuan Pasal 24C UUD NRI Tahun 1945 tersebut. Mahkamah Agung yang memperoleh kewenangan melakukan pengujian terhadap peraturan perUndang-undangan dibawah Undang-undang terhadap Undang-undang melalui amanah Pasal 24A Ayat (1) UUD NRI Tahun 1945. Namun Mahkamah Agung melalui Perma Nomor 1 Tahun 2011 tentang Hak Uji Materill telah merubah ketentuan tersebut dan melebarkan kewenangannya menjadi tidak hanya pengujian Undang-undang, namun frasa yang digunakan adalah peraturan tingkat lebih tinggi.

Abstract

Pemilihan umum secara garis besar ialah tindakan yang dilakukan oleh negara yang sah untuk mendapatkan pemimpin dalam sebuah negara (jabatan politik), ketentuan mengenai penyelenggaran pemilu sudah diatur melalui peraturan perundang-undangan, namun tidak sedikit dalam penyelenggaran pemilu, peserta pemilihan umum melakukan politik uang untuk memenangkan kompetisi tersebut. Tindakan politik uang harus diformulasikan dengan baik agar tindakan politik uang dapat benar-benar sesuai dengan hakikat politik uang. Tindakan penggantian uang transportasi, uang lelah dan uang makan dalam mobilisasi pemilih dalam kampanye terbuka perlu penegasan dari kajian ilmu hukum. Instumen hukum terhadap pencegahan politik uang harus dikaji secara mendalam, penerapan hukum pidana sebagai ultimum remidium harus dikaji secara mendalam, beberapa cara lainnya dapat digunakan sebagai metode pencegahan politik uang selain mekanisme hukum yang ada.

Abstract

Village Government with the promulgation of Law Number 6 of 2014 concerning Villages clearly indicates that there are efforts to strengthen village institutions or the existence of villages is very large and strategic in development and realizing welfare for the people. The initial government units from ministries, provincial and district/city governments in their apparatus are accompanied by the State Civil Apparatus without exception, but it is questionable that in the village government unit there is not a single apparatus from the State civil apparatus. The village government which is a government that is directly related to the people needs to be considered especially for the sake of strengthening and improving services to the community by including elements of the State Civil Apparatus in it.

Abstract

The cinematography in telegram is widely misused by irresponsible people by piracy. In fact, cinematography is a component contained in copyright law that must be protected. The first problem is how is the legal protection for copyright owners? And the second dispute resolution that can be taken by the copyright owner? This research method uses the normative method. And it will become a legal problem if piracy continues on Telegram. Copyright owners need to be protected with two forms of protection, namely preventive legal protection and repressive legal protection. As for dispute resolution, it can be done through litigation and non-litigation.

Abstract

At the present time, traveling has become secondary requirement for people, to get rid of fatigue after work or just entertain themselves. It takes no less amount of people who like nature tourism and ecotourism. In Jember city, there is one very interesting nature tourism called the Tancak Panti Waterfall which is located in Suci Village. However, the question arises : Can the Tancak Panti Waterfall obtain authorization or licence as nature tourism? Does the Suci Village Government and the local community should be apply for requirements and qualifications to granted the licence? The aim in this article is to determine the method of normative and empirical legal research with the typical characteristics of the methods of researching Law. The result of the first discussion is that the Tancak Panti Waterfall Tourism Destination has the right to obtain licence as nature tourism in accordance with Article 33 Number (1) of Government Regulation Number 3 of 2008 on amendments to Government Regulation Number 6 of 2007 concerning Forest Management and Preparation of Forest Management Plans, As well as Forest Utilization which states that the Tancak Waterfall can obtain licence for nature tourism. The result of the second discussion is that the Suci Village Administration and the local community have the right to apply for licence in accordance with Article 67 Paragraph (2) of Government Regulation Number 3 of 2008 regarding amendments to Government Regulation Number 6 of  2007 concerning Forest Management and Preparation of Forest Management Plans, as well as Forest Utilization.

Abstract

The Constitutional Court decision No.013-022/PUU-IV/2006 issued in 2006, it was stated that the article on insulting the President contained in Article 134, Article 136 and Article 137 of the Criminal Code no longer had binding legal force. The Constitutional Court stated that in its ratio decidendi regarding the abolition of the article on insulting the President and/or Vice President, namely with several considerations: 1) The Criminal Code is a legacy of Dutch colonialism. 2) Give rise to legal uncertainty (rechtsonzekerheid) and the principle of equality before the law does not apply. 3) protection of human rights. The redaction of the article on insulting the President and/or Vice President as stated in Article 217-Article 218 of Law the Criminal Code is no different from the redaction of the article on insulting the President and/or Vice President which has been declared unconstitutional by the Constitutional Court. Minimize the occurrence of a judicial review in the next three years regarding the article regarding insulting the President and Vice President. So the restrictions on the article regarding insulting the President and Vice President can be regulated by equivalent legal regulations, such as government regulations as a matter of urgency in explaining the article.

Abstract

The rapid advancement of technology has brought many benefits to society, making it easier and helping to meet their needs through various technologies. However, along with this development, problems such as fraud through WhatsApp applications have also emerged. One of the modus operandi is the fraud of courier receipts or from the sender's expedition party. Therefore, the formulation of the research problem is whether perpetrators of fraud through WhatsApp invitation links can be subject to criminal sanctions, and what legal efforts can be made by victims of fraud through WhatsApp invitation links. The purpose of this study is to determine whether fraud through WhatsApp invitation links can be subject to criminal sanctions, and to determine what legal efforts can be made by victims of such fraud. The research method used is the typology of normative legal research, which is research conducted on written regulations, as well as library research or documentary studies, because this research mostly uses secondary data such as books and official documents. The approach used in this research is the statutory approach, case approach, and conceptual approach. In addition, this study also uses primary and secondary legal material sources. The first discussion result shows that fraud through WhatsApp invitation links can be subject to criminal sanctions based on Article 378 of the Criminal Code and Article 28 paragraph (1) of the ITE Law. Victims can take legal action by reporting such criminal acts to the Police in accordance with Article 4 paragraph (1) of Law Number 23 of 2007 concerning the Legal Jurisdiction of the Indonesian National Police. Victims can also resolve their issues through litigation or non-litigation.

Abstract

Advances in digital technology have had a significant impact onIntellectual Property Rights (IPR), especially in the field of graphicdesign utilizing applications such as Corel Draw X4. Althoughthese applications are very popular and provide great economicbenefits, their illegal use has a negative impact on patent rights anddeveloper innovation. This research aims to examine the legalimplications of the illegal use of Corel Draw X4 in the graphicdesign business in Indonesia based on Law Number 13 Year 2016on Patent Rights. The method used is normative juridical, withstatutory and conceptual approaches. The results show that theillegal use of this software violates the exclusive rights granted tothe patent holder and is potentially subject to legal sanctions suchas fines or imprisonment. Corel Corporation has a mechanism todetect illegal use and offer alternatives to legal use, such as trialversions. Therefore, graphic designers and businesses are advised tocomply with patent rules to avoid adverse legal consequences andsupport the sustainable growth of the industry. Resolving disputesrelated to patent infringement can be done through litigation ornon-litigation approaches, with mediation as a more effective andefficient option.
