Abstract

Article 3 paragraphs (1) and (4) of Padang Pariaman Regency DPRD Regulation Number 2 of 2020 concerning the DPRD Code of Ethics. One violation of the code of ethics is violence in carrying out duties. This research is legal research with descriptive-analytical specifications. From the results of the internal meeting, the members of the DPRD who were in conflict were summoned. The Honorary Board verbally reprimanded DPRD members with the initials H and J. Then they were given directions and input on what they had done in DPRD meeting activities. The two DPRD members were asked not to repeat their actions and attitudes and to respect the DPRD district regulations and procedures. Padang Pariaman. Obstacles in the Implementation of the Code of Ethics as an Effort to Overcome Violent Behavior by DPRD Members in Carrying Out Their Duties at the Padang Pariaman Regency DPRD are in the form of External Obstacles, namely statutory regulations. Weaknesses in research techniques in Article 51 letter b of Government Regulation Number 53 of 2005 concerning Amendments to Government Regulation Number 25 of 2004 concerning Guidelines for Drafting the Standing Orders of the Regional People's Representative Council which states that document inspection is only sufficient for formal evidence in the form of written allegations and the identity of the reporter and through requests for information and explanations from witnesses and/or those concerned as well as an examination of documents or other evidence.

Abstract

Penerapan Pidana Oleh Hakim Terhadap Terdakwa Tindak Pidana Pencabulan Secara Berlanjut Pada Putusan Nomor 55/Pid.Sus/2020/Pn.Pdp dan Nomor 61/Pid.Sus/2020/Pn.Pdp Majelis Hakim menyatakan bahwa unsur-unsur perbuatan terdakwa memenuhi unsur dalam Pasal 82 ayat (1) Undang-Undang RI Nomor 17 Tahun 2016 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2016 tentang Perubahan Kedua atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Hakim menerapkan unsur memberatkan pidana yaitu Pasal 64 Ayat (1) KUHP tersebut dikarenakan para korban pencabulan ini masih di bawah umur serta perbuatan ini telah memenuhi kualifikasi serangkaian perbuatan yang harus dipandang sebagai perbuatan berlanjut. Pertimbangan Hakim Dalam Penerapan Pidana Terhadap Terdakwa Tindak Pidana Pencabulan Secara Berlanjut Pada Putusan Nomor 55/Pid.Sus/2020/Pn.Pdp adalah pertimbangan yuridis perbuatan terdakwa yang unsur-unsurnya yaitu unsur setiap orang dan unsur Dilarang melakukan kekerasan atau ancaman kekerasan, memaksa, melakukan tipu muslihat, melakukan serangkaian kebohongan, atau membujuk anak untuk melakukan atau membiarkan dilakukan perbuatan cabul. Pada putusan Nomor 61/Pid.Sus/ 2020/Pn.Pdp dengan pertimbangan yuridis yang sama namun dikaitkan dengan Pasal 64 Ayat (1) KUHPidana yaitu unsur melakukan beberapa perbuatan yang ada hubungannya sedemikian rupa sehingga harus dipandang sebagai perbuatan berlanjut.

Abstract

Law Number 5 of 2018 has regulated the Eradication of Indonesian Terrorism Crimes. However, the number of acts of terrorism in Indonesia has not decreased even though the laws and regulations in Indonesia have provided strict sanctions against the perpetrators of terrorism. Crime prevention policies or efforts are urgently needed to reduce the number of acts of terrorism in Indonesia. The problems examined in this thesis are First, how is the criminal policy in handling criminal acts of terrorism in Indonesia? Second, how can the handling of criminal acts of terrorism be better in the future in Indonesia? This research is a legal research with descriptive analytical specifications. The approach used is a normative juridical approach. The data used are secondary data and primary data collected through library research. The data obtained were analyzed qualitatively and presented in an analytical descriptive form. The results of this study are first, criminal policy in handling criminal acts of terrorism in Indonesia is the formation or renewal of legal substance with the issuance of RI Law Number 5 of 2018 concerning Amendments to RI Law Number 15 of 2003 concerning Eradication of Criminal Acts of Terrorism. Second, better handling of Terrorism Crimes in the Future is to change Article 14 by adding 1 (one) new paragraph, namely paragraph (2) concerning mitigating crimes against perpetrators if the crime referred to in paragraph (1) does not occur. Furthermore, amending Article 17 paragraph (2) regarding criminal liability for corporations that commit acts of terrorism.
