Abstract

Kegiatan perusahaan pada hakekatnya merupakan upaya bersama antara pihak pengusaha dan pekerja yang bertujuan untuk pertumbuhan perusahaan dan juga untuk kesejahteraan para pekerja. Oleh karena itu pihak perusahaan perlu memberikan suatu imbalan yang layak kepada pekerjanya sesuai dengan peraturan perudang-undangan yang berlaku. Dan selain itu, perusahaan wajib memperhatikan segala upaya untuk peningkatan kesejahteraan para pekerja sesuai dengan kemampuan dan kemajuan perusahaan. Hubungan kerja yang baik hanya bisa dicapai apabila setiap karyawan dan perusahaan dapat memahami serta menghayati hak dan kewajiban masing-masing pihak. Dimana pada akhirnya akan menimbulkan dan menumbuhkan saling menghargai dan saling mempercayai dalam menjaga iklim kerja sama yang baik dan harmonis. Yang menjadi permasalahan pokok dalam penelitian ini adalah bagaimana Sistem pengupahan bagi pekerja dalam perjanjian kerja waktu tertentu (PKWT) berdasarkan Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan dan perlindungan pengupahan dalam perjanjian kerja waktu tertentu (PKWT). Metode yang digunakan dalam penelitian ini jika dilihat dari sudut jenisnya, maka penelitian ini tergolong kedalam penelitian normatif. Sedangkan jika dilihat dari sifatnya, maka peneliian ini bersifat deskriptif analitis, yaitu menerangkan dan menganalisa. Upah adalah suatu penerimaan sebagai imbalan dari pengusaha kepada pekerja untuk sesuatu pekerjaan atau jasa yang telah atau akan dilakukan. Hubungan kerja adalah hubungan antara pihak pekerja dengan pihak perusahaan. Hubungan kerja ini terjadi karena adanya perjanjian kerja atau kesepakatan kerja diantara kedua belah pihak, dimana pekerja menyatakan kesanggupannya untuk bekerja pada perusahaan dan pihak perusahaan menyatakan kesanggupannya untuk mempekerjakan pekerja dengan memberi upah. Perjanjian kerja waktu tertentu (PKWT) perjanjian telah ditetapkan suatu jangka waktu yang dikaitkan dengan lamanya hubungan kerja antara pekerja dengan pengusaha. Sistem pengupahan berdasarkan peraturan perusahaan antara pekerja dengan pengusaha. Dimana dalam peraturan perusahaan tersebut dibuat secara tertulis dengan memuat hak-hak dan kewajiban pekerja, termasuk sistem pengupahan.

Abstract

Background. The use of Intellectual Property Rights, especially product brand registration for Micro, Small and Medium Enterprises, has not been running optimally in Indonesia, and especially in the city of Pekanbaru, due to the lack of understanding of home industry entrepreneurs about brands and registration procedures, lack of technical guidance and programmatic socialization from the Regional Government. Purpose. This study aims to analyze the low implementation of product trademark registration for Micro, Small and Medium Enterprises and to analyze the role of the local government of Pekanbaru city in the implementation of product trademark registration for Micro, Small and Medium Enterprises in improving trade business. Method. The approach used in this study is a normative juridical approach and an empirical juridical approach to obtain correct and objective research results. Results. Based on the results of the study, it is known that the implementation of product trademark registration for Micro, Small and Medium Enterprises in Pekanbaru city has not been running as expected, as evidenced in 2022, out of 25,074 trademarks circulating in the market, only 8 (eight) have implemented their trademark registration. Conclusion. Furthermore, it is known that the role of local government in the implementation of trademark registration for Micro, Small and Medium Enterprises in Pekanbaru city is not running as expected, because the local government of Pekanbaru city has not given maximum attention to Micro, Small and Medium Enterprises so that they do not develop and make updates in innovating in accordance with science and technology and community needs.

Abstract

This study aims to analyze theoretical issues regarding the reformulation of the concept of criminal responsibility towards corporations as subjects in criminal offenses in the field of patents by using the parameters of criminal law doctrine and the new Indonesian Criminal Code. As normative legal research, this research uses statutory, historical, and conceptual approaches. The results of the study concluded that based on construction both in terms of criminal law doctrine and the new Indonesian Criminal Code, the rules regarding corporate criminal liability mechanisms for patent crimes are not recognized in Law Number 13 of 2016 concerning Patents (Patent Law). Bearing in mind that corporate criminal liability is related to patent crimes in the provisions of Article 1 point 13 of the Patent Law, the phrase "everyone" means individuals and legal entities. With the use of this term, of course this has a juridical implication that all criminal provisions in the Patent Law can only be applied to the intended legal subject (individuals and legal entities). Therefore, with this problem, projections are needed that are aimed at reformulating the Patent Law therefore that it does not only cover corporations as subjects. Alternatively, it is also aimed at reformulating the theory used and the model for imposing sanctions that can be applied therefore that it conforms to the criminal law doctrine and the corporate concept in Indonesia's new Criminal Code.

Abstract

This study examines the influence of organizational culture, work ethic, and work communication on employee productivity at the Commission for the Prosecution of the Republic of Indonesia (KKRI). Employing a quantitative research approach, data were collected from 40 employees through a structured questionnaire and analyzed using multiple linear regression. The results reveal that organizational culture, work ethic, and communication each have a positive and significant effect on employee productivity. Organizational culture and communication demonstrate a strong influence, while work ethic shows a moderate yet meaningful impact. Furthermore, the simultaneous analysis confirms that the three variables together significantly contribute to explaining variations in productivity. These findings suggest that strengthening organizational culture, fostering a robust work ethic, and enhancing effective communication are critical strategies to improve productivity within public institutions. Future research is recommended to explore moderating or mediating variables to further enrich the understanding of these relationships in various organizational contexts.

Abstract

The enactment of Law Number 6 of 2023, concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 on Job Creation, introduced the Individual Company as a legal entity designed to empower Micro and Small Enterprises (MSEs). This provision enables the establishment of a company by a single individual, a departure from the traditional requirement of at least two shareholders. The Job Creation Law, supported by Government Regulation Number 8 of 2021, outlines that an Individual Company is created through a Statement of Establishment, without the need for a Notary Deed, in line with the provisions for MSEs as stipulated in Government Regulation Number 7 of 2021. However, this legal framework creates challenges when an Individual Company exceeds the MSE criteria or gains more than one shareholder. In such cases, the company must transition into a Limited Liability Company (LLC), a process that requires the drafting of a notary deed and registration through the Ministry of Law and Human Rights’ online AHU system. This research focuses on advocating for legal certainty in the status transition of Individual Companies to Limited Liability Companies, which currently involves the dissolution of the original entity before the new LLC can be formed. The lack of a clear, comprehensive legal mechanism for this transition causes significant legal uncertainty. This paper examines the gaps in the existing legal framework and proposes solutions to streamline the conversion process, eliminating the need for dissolution. By advocating for legal certainty in the status transition, this research contributes to the broader discourse on improving the General Legal Administration system, ensuring that the legal status of businesses aligns with their evolving needs, and facilitating smoother business expansion and growth.

Abstract

The objective of this study is to assess and understand fair Production Sharing Agreement (PSC) structures as well as state practices in the mining sector through a comparative analysis. The investigation aims to scrutinize and understand the optimal approach for implementing a fair PSC)in mining. The research uses the normative legal research method and legal principles rooted in specific areas of the legal system, initially by determining the rules defined in the relevant legislation. Findings reveal fair Production Sharing Contract (PSC) arrangements in the Mining Sector and Government Practices. Production-sharing contracts in comparative research ignore the principle of balancing the rights and obligations of the parties involved. The contractor is required to bear all operating costs, which represents a significant burden in the absence of cost recovery. The proposed ideal concept for the implementation of the fair PSC in the mining sector involves the integration of the cost recovery PSC with the common split system agreement. In particular, the application of  PSC to existing upstream oilfields and the adoption of the gross split work contract system for new upstream oilfields.Tujuan dari studi ini adalah untuk menilai dan memahami struktur Perjanjian Bagi Hasil (PSC) yang adil serta praktik negara di sektor pertambangan melalui analisis komparatif. Investigasi ini bertujuan untuk meneliti dan memahami pendekatan optimal untuk menerapkan PSC yang adil di bidang pertambangan. Penelitian ini menggunakan metode penelitian hukum normatif dan asas-asas hukum yang berakar pada bidang tertentu dalam sistem hukum, yang mula-mula dengan menentukan aturan-aturan yang ditetapkan dalam peraturan perundang-undangan yang bersangkutan. Temuan mengungkapkan pengaturan PSC yang adil di sektor pertambangan dan praktik pemerintah. Kontrak bagi hasil dalam penelitian komparatif mengabaikan prinsip keseimbangan hak dan kewajiban para pihak yang terlibat. Kontraktor wajib menanggung seluruh biaya operasional, yang merupakan beban signifikan jika tidak ada cost recovery. Usulan konsep ideal penerapan fair PSC di sektor pertambangan melibatkan integrasi cost recovery PSC dengan perjanjian sistem common split. Khususnya penerapan PSC pada ladang minyak hulu yang sudah ada dan penerapan sistem kontrak karya gross split pada ladang minyak hulu baru.

Abstract

Penelitian ini bertujuan untuk melihat bagaimana peran aktor yang terlibat dalam pengelolaan program simpan pinjam perempuan (SPP) yang dijalankan oleh BUMNagMa guna memberdayakan masyarakat terutama perempuan untuk meningkatkan perekonomian melalui kegiatan usaha produktif. Penelitian ini menggunakan pendekatan kualitatif dengan desain deskriptif. Penelitian ini menggunakan teknik purposive sampling. Metode utama untuk mengumpulkan data adalah melalui wawancara dan dokumentasi. Penelitian dilakukan di BUMNagMa VII Koto Sungai Sariak di Kabupaten Padang Pariaman. Hasil penelitian ini : (1) Dalam implementasi program SPP di BUMNagMa aktor memiliki 6 indikator peran, berupa (a) wewenang aktor dalam melaksanakan program SPP, (b) kemampuan yang dimiliki target program dalam memanfaatkan dana program SPP, (c) keyakinan aktor dalam mencapai tujuan program SPP, (d) kesempatan yang diberikan aktor kepada target program, (e) tanggungjawab yang diberikan aktor dan target program jika terjadi persoalan dalam implementasi program, (f) dukungan yang diberikan oleh aktor untuk menunjang pemanfaat dalam menggunakan dana program SPP. (2) Upaya dalam menyelesaikan persoalan kredit macet, berupa (a) melakukan evaluasi, identifikasi, komunikasi dan negosiaso (b) lakukan tinjauan bersama dengan surat peringatan, (c) Jika permasalahan kredit macet lewat dari 2 tahun, kelompok yang bersangkutan mendapat catatan merah (d) jika sudah tidak bisa diselesaikan, atas kesepakatan kelompok, maka kredit macet akan ditutupi dengan tanggung renteng.

Abstract

Abstract This research aims to analyze the issues associated to the ambiguity of deradicalization program for terrorist convicts in the Indonesia penitentiary, focusing on 2 (two) main issues, firstly, whether deradicalization program directed towards terrorist convicts should be a right or an obligation, and the second issue is related to the appropriate measure on how to counteract the radical understanding of terrorist convicts in Indonesia. As a normative legal research, this research uses a statutory, historical, comparative, and conceptual approach. The results of the study conclude that the Law Number 12 of 1995 concerning Corrections still classified education as the right of the convicts and that includes deradicalization program. Keywords: Education, Deradicalization, Terrorism, penitentiary Intisari Penelitian ini bertujuan untuk menganalisis permasalahan hukum yang berhubungan dengan ambiguitas pendidikan deradikalisasi bagi terpidana terorisme dalam lembaga pemsyarakatan di Indonesia, dengan fokus pada 2 (dua) permasalahan utama terkait, apakah pendidikan deradikalisasi bagi terpidana terorisme merupakan suatu hak ataukah kewajiban, serta bagiamana mekanisme penanganan yang tepat untuk memerangi pemahaman yang radikal bagi terpidana terorisme di Indonesia. Sebagai penelitian hukum normatif, penelitian ini menggunakan pendekatan perundang-undangan, sejarah, perbandingan, dan konseptual. Hasil penelitian menyimpulkan bahwa di dalam Undang-Undang Nomor 12 Tahun 1995 tentang Pemasyarakatan serta peraturan teknis pelaksana undang-undang tersebut masih menempatkan pendidikan sebagai hak dari terpidana termasuk pendidikan deradikalisasi. Abstract

This research aims to determine the implementation of the principles of justice and supervision of consumer protection in protecting consumers who use whitening cream cosmetic products (from the perspective of legal justice theory). The urgency of this research was initiated because many whitening cream products are circulating that contain dangerous ingredients and are sold at low prices. The research involved takes a juridical-normative approach. Techniques for data collection include literature studies and observations at BPOM Pekanbaru City. The principle of justice in consumer legal protection has not been effectively implemented by Article 2 paragraph (2) of the UUPK. One of the factors is a lack of effective compensation. The government merely issues administrative and criminal sanctions without being obliged to compensate for damages or restore the health of the skin affected by products. Then, according to UUPK rules, the BPOM does not have the authority to supervise the execution of consumer protection (Article 30 (1) UUPK). As a result, the Pekanbaru City BPOM's supervisory function on this research issue is ineffective, leaving consumers with insufficient facilities and infrastructure, free legal aid, and quick access to settle consumer disputes with business actors.

Abstract

Article 3 paragraphs (1) and (4) of Padang Pariaman Regency DPRD Regulation Number 2 of 2020 concerning the DPRD Code of Ethics. One violation of the code of ethics is violence in carrying out duties. This research is legal research with descriptive-analytical specifications. From the results of the internal meeting, the members of the DPRD who were in conflict were summoned. The Honorary Board verbally reprimanded DPRD members with the initials H and J. Then they were given directions and input on what they had done in DPRD meeting activities. The two DPRD members were asked not to repeat their actions and attitudes and to respect the DPRD district regulations and procedures. Padang Pariaman. Obstacles in the Implementation of the Code of Ethics as an Effort to Overcome Violent Behavior by DPRD Members in Carrying Out Their Duties at the Padang Pariaman Regency DPRD are in the form of External Obstacles, namely statutory regulations. Weaknesses in research techniques in Article 51 letter b of Government Regulation Number 53 of 2005 concerning Amendments to Government Regulation Number 25 of 2004 concerning Guidelines for Drafting the Standing Orders of the Regional People's Representative Council which states that document inspection is only sufficient for formal evidence in the form of written allegations and the identity of the reporter and through requests for information and explanations from witnesses and/or those concerned as well as an examination of documents or other evidence.
