Abstract

This study examines legal certainty in land sale and purchase agreements, particularly concerning sale and purchase deeds that result in Niet Ontvankelijke Verklaard (NO) verdicts. The importance of this study lies in understanding the root causes of legal uncertainty in the transfer of land rights and its implications for the involved parties. The objective of this research is to analyze the causes of NO verdicts, understand their legal basis, and evaluate their legal impacts. The methodology used is a normative legal approach with an analysis of primary and secondary legal materials, as well as related court decisions. The main findings indicate that NO verdicts are caused by unclear dispute objects and formal defects such as error in persona and obscuur libel. NO verdicts impact legal certainty, potential compensation claims, and public trust in notaries/PPATs. The implication is that there is a need to increase meticulousness and compliance with formal requirements in drafting sale and purchase deeds to avoid NO verdicts that can harm various parties.

Abstract

Abstract

The Covid-19 pandemic has changed patterns in all aspects of society, including its impact on political participation in society. Blitar Regency is a small example in several regions in Indonesia which carry out the 2020 simultaneous regional elections during the pandemic with a slightly different style from previous years. The purpose of the study was to determine the political participation of the Blitar district community in the 2020 simultaneous elections. The qualitative research method is a socio-political research with a normative-juridical approach with empirical data obtained from some information from informants who developed in the field. The results show that in a pandemic situation Covid-19 which has the potential to reduce public political participation in exercising their voting rights, it turns out that the Blitar Regency KPU is able to create a solution that is anticipatory, namely by implementing strict health protocols, and massive socialization either directly or digitally, so that it is able to approach the expected target, even higher from the previous two years. KPU, KPPS and the local community cooperate with each other to anticipate by trying to ensure health security during the simultaneous regional elections, also always trying to avoid possible frauds.

Abstract

Pada 18 Mei 2024, di Kabupaten Blitar, dilaksanakan kegiatan "Sosialisasi Peningkatan Sadar Politik pada Perempuan" dengan kerjasama antara pemerintah desa, ibu PKK, dan Karang Taruna. Acara dihadiri oleh 30 peserta dari ibu PKK dan pemilih muda yang diwakili oleh Karang Taruna. Narasumber utama adalah Dosen Fakultas Hukum Abdul Hakam Sholahuddin, S.Ag., M.H, dengan materi politik praktis, dan dibantu oleh Bapak Erwin Widhiandono, S.H., M.H. Kegiatan meliputi diskusi dan sesi tanya jawab. Tim Pengabdian Masyarakat juga melakukan survei, sosialisasi, dan monitoring evaluasi. Partisipasi politik perempuan menjadi fokus utama kegiatan, dengan harapan mengurangi tingkat golongan putih (Golput) dan meningkatkan pemahaman politik di kalangan masyarakat. Suasana acara terlihat semarak dan peserta aktif dalam diskusi, mencerminkan keberhasilan dalam menyebarkan informasi politik yang relevan.

Abstract

This study examines public perceptions of the role of business law regulations in strengthening the entrepreneurial ecosystem and MSMEs in Blitar City. The background to this study is the importance of MSMEs in the national economy and the state's efforts to create a conducive business climate through legal policies (e.g., Law No. 20/2008 on MSMEs, Law No. 11/2020 on Job Creation). The approach used is qualitative phenomenological, with data collection through in-depth interviews (15 informants: MSME actors, practitioners, local officials, academics), participatory observation in the field, and a study of relevant policy documentation. The findings show that the community views business law regulations as an important instrument for providing certainty and protection (e.g., business legality), but in practice, there are bureaucratic obstacles and a lack of socialization that hinder their effectiveness. The novelty of this research lies in the local context of Blitar City and the use of a phenomenological approach to explore the subjective meanings of the actors. Based on the findings, it is concluded that although regulations have the potential to support the empowerment of MSMEs and the regional economy (in line with Welfare State theory), implementation in the field needs to be strengthened by simplifying procedures, providing legal assistance, and strengthening law enforcement so that it does not become an obstacle for business actors.
