Abstract

Fictitious orders in online transportation always exist and even tend to increase and develop in society along with advances in internet technology, transportation and the economy, even though acts of fraud and fictitious orders are seen from any angle very reprehensible, because they can create mutual distrust of fellow drivers and drivers. company. The main problems in this research are 1. what is the reality of the fictitious orders of online motorcycle taxi drivers in the city of Makassar? 2. What is the comparison between national law and Islamic law against fictitious orders for online motorcycle taxi drivers? This type of research is a qualitative descriptive research with a normative (syar'i) approach and a sociological approach. Data management techniques in this study are interviews, observation and documentation. The key informants from this research are drivers and customers who make fictitious orders. The results of this study are losses felt by the customer (customers) on fictitious orders made by drivers and losses are also felt by drivers if the customer (customer) makes a fictitious order so that all those involved make fictitious orders even PT.Grab companies are not the same once taught and justified the existence of fictitious orders suffered losses. The cause of fictitious orders is due to not fulfilling the order target, the perpetrator intends to take personal advantage. The implication of this research is that companies can improve security services for online motorcycle taxi applications, as well as impose sanctions on those who make fictitious orders. Because of the lack of awareness for perpetrators to carry out fictitious orders.

Abstract

The tradition of panai’ money in South Sulawesi is a form of respect from the party who proposes (men) to women as a form or process of family ties. The main point of this study is how the Position of panai’ Money in the Marriage of the Bugis-Makassar Tribe Community; Fatwa Study of the Indonesian Ulema Council of South Sulawesi Province. This study aims to analyze the fatwa issued by the Indonesian Ulema Council of South Sulawesi Province regarding panai’ money in the marriage tradition of the Bugis-Makassar community. The type of research used in this study is qualitative descriptive research that provides an overview of phenomena and events that occur in a research location based on environmental conditions. The data used in this study are primary data and secondary data that are processed and presented to conclude. The results showed that the position of this panai’ money is a condition in a marriage because if there is no panai’ money then the marriage cannot be done. Islam does not regulate the provision of panai’ money but the law is good, Islam does not prohibit panai money in marriages of the Makassar bugis tribe because no evidence regulates it. Therefore, the MUI in its fatwa states that the law of this panai’ money is mubah, and if it does not burden both parties. The MUI in its fatwa does not state how much must be spent, because it adjusts to everyone's economic conditions.

Abstract

 Artikel ini mengemukakan kedudukan sunrang yang diminta kembali pada saat terjadi perceraian. Penelitian ini dilakukan di Kecamatan Pallangga, Gowa. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa, masyarakat Kecamatan Pallangga, mengenal  sunrang sama dengan mahar dalam hukum Islam yaitu  syarat yang harus dipenuhi oleh calon mempelai laki-laki untuk diberikan kepada calon  mempelai perempuan dengan jumlah dan jenis sunrang ditentukan oleh keluarga dari pihak calon mempelai perempuan dan disetujui oleh pihak dari keluarga calon mempelai laki-laki. Apabila sunrang tersebut telah  diberikan  oleh calon mempelai laki-laki kepada calon mempelai perempuan pada saat akad nikah  maka sunrang tersebut sudah menjadi hak mutlak dari isteri. Artinya sudah tidak ada lagi hak dari suami atas sunrang  itu, artinya sunrang tersebut tidak boleh di ganggu gugat. Menurut hukum adat yang ada di Pallangga ketika suami isteri bercerai lalu si suami meminta sunrang/maharnya kembali maka itu tidak di perbolehkan apabila sepasang suami isteri tersebut sudah mempunyai anak. Lain halnya ketika bercerai lalu belum bercampur maka pihak perempuan wajib mengembalikan seluruh sunrang yang diberikan oleh laki-laki pada saat akad nikah, kerena hal tersebut merugikan pihak dari  laki-laki. Menurut pandangan hukum Islam apabila terjadi perceraian dan belum bercampur maka mahar itu bisa diambil kembali tetapi hanya sebagian atau separuhnya saja kecuali perempuan memaafkan atau mengikhlaskannya maka seluruh mahar tersebut itu boleh diambil oleh pihak laki-laki. Begitupun sebaliknya ketika laki-laki memafaatkan/mengikhlaskan maharnya maka seluruh mahar tesebut adalah milik dari perempuan.Kata Kunci: Sunrang; Hukum Islam; Hukum Adat.
