Abstract

The object of this study was to find out how the prospect of salacca processing industry of UD.Salacca is in building economy of society depends on Islam perspective. The method of the study was qualitatif approach which the techniques of collecting the data were interview and documentation. The analysis of the data was SWOT analysis which is to find out the strengths, the weaknesses, the opportunities, and the threats of the industry. Based on result of the interview held to the interviewees then the researcher finds out some strengths such as strategic location, wide market share, MUI halal label and satisfied profits while the weaknesses are not sophisticated technology and expired of the products. Then, the business opportunities are support of the government and achievement of foreign market while the threat which is faced is new business competitors so that it can be concluded that salacca processing industry of UD. Salacca is deserved and prospective to be developed.

Abstract

This research was aimed to find out how big the effect of celebrity endorser, brand image and customer satisfaction toward the customer loyalty both directly and indirectly influence. The sample used in this research were consumers who make purchases in the shopping centre in Medan. The method used in this research was quantitative approach with path analysis with multiple linear regression model assisted by SPSS program version 19. From the results of research conducted, the author conclude that this research yields R-Square on the structural models 1 shows that the variable of celebrity endorser, brand image and customer satisfaction affect the customer loyalty in Medan amounted to 94,4% while 5,6% was explained by other factors. Based on R-Square on the structural models 2 shows that the variable of celebrity endorser and brand image affect the customer satisfaction amounted to 82,7%, while 17,3% was explained by other factors. In the simultaneously test the structural models 1 shows that the variable of celebrity endorser, brand image and customer satisfaction affect the customer loyalty in Medan, this is shown by the value of Fstatistics (537,229) > Ftable (2,31). In the simultaneously test the structural models 2 shows that the variable of celebrity endorser and brand image affect the customer satisfaction, this is shown by the value of Fstatistics (231,602) > Ftable (2,31). In the partially test the structural models 1 shows that the variable of celebrity endorser, brand image and customer satisfaction affect the customer loyalty in Medan. In the partially test the structural models 2 shows that the variable of celebrity endorser and brand image affect the customer satisfaction. The results of significance tests based on the indirect effect shows that there is an indirect effect of the brand image variable on the customer loyalty through the customer satisfaction wiyh significantly.

Abstract

Mawah and cater are part of local wisdom in Aceh which is a cooperative practice between asset owners and managers/ sharecropper. In the field of agriculture with rice fields as assets, mawah and cater are practiced with the provisions of local customs. This means that the implementation will have a difference in each place, however, the difference in the model of cooperation mawah and cater does not guarantee the proportional and fair benefits for both parties, so that it will impact on their welfare. This study aims to analyze various models of mawah and cater practices that exist in the farming community of Ulim Sub-district of Pidie Jaya Regency and to analyze the impacts on improving the welfare of local farmers. This is a kind of field research with qualitative approach. As a result, this research concludes that there are six models of mawah and one cater model which is practiced in Ulim Sub-district of Pidie Jaya Regency. This study also confirmed the contribution of both cooperations in improving the welfare of local farmers.

Abstract

This article tries to address the issue related to environmental demage caused by illegal or legal exploration of natural resource type C in Johar Village. karang baru district. The exploration as such has violated the rule and regulation or the Qanun Kabupaten Aceh Tamiang No. 13. Tahun 2008 that provides legal procedures on the exploration of natural resources type C in the ATam Regency. Not only that the Developer should also look on the matter through environmental fiqh. Both the qanun dan fiqh al biah found that such legal or illegal exploration of the natural resources has caused huge lost only to the region but also the local community in Johar, it demages not only the ecosystem but also deprive the johar people from development.

Abstract

This research is based on Law Number 23 of 2011 on the Management of Zakat which states that the management of Zakat must be in accordance with Islamic Shari'ah, convey, benefit, justice, legal certainty, integrated, and accountability. This research uses field research. The researcher interviewed directly with the administrators of Baitul Mal Aceh Singkil and completed with observation and documentation. The results of the research in Baitul Mal Aceh Singkil show that 1. The management of Zakat in Baitul Mal Aceh Singkil is done by several stages of planning that is the first way of Collection of Zakat, second distribution of Zakat fund, third, supervision and coaching, and evaluation of each programs that have 2. 2. Distribution is adjusted based on general interpretation of the meaning of fi sabilillah, because in particular the Qur'an and Ijma 'do not want any new group of Zakat recipients other than 8 main groups.

نبذة المقالة التقليد مظهر من مظاهر اتباع المذاهب الفقهية المنتشرة بين المسلمين، وذلك بعد بلوغ الفقه الإسلامي سن النضج. لقد صدق القائل إذ قال: وماذا بعد الكمال إلا النقصان. فكتب الشريعة بعد أن دونت والفقه بعد أن شملت مباحثه فلم يبق للناس إلا الاتباع ولفت أنظارهم إلى ما صنفه السابقون. هنا جاءت عملية التقليد ثم التلفيق لأن هذا ثمرة ذلك. وهذه المقالة تحاول كشف مفاهيم التقليد والتلفيق منها ما يوافق المقاصد الشرعية فنتبعها طمعاً لتحقيق المصالح ودفع المفاسد، ومنها ما هي في منأىً عن المقاصد التي أراد بها الشارع فلا يجوز الأخذ بها. فالتقليد والتلفيق إذا كانا يؤيدان روح الشريعة ويوافقانها فلا مانع القول بهما، وأما ما يهدم روح الشريعة ومقاصدها فلا يجوز القول بهما فضلاً عن العمل بهما.

Abstract

The research was aimed to find out the role of women as the main breadwinner in Subulussalam. This research used a field-research with a phenomenology approach with a descriptive qualitative -inductive research. The subjects of this study were the women as breadwinners in Subulussalam. The results of this research indicate that the women in Subulussalam very have a role for her familyas the main breadwinner. It effected due to the low income of her husband, the high level of the necessities of life, the number of the cost of her children's life and their education, the existence of encouragement from within in order to obtain a better life are well established, and the existence of women's desire to work.A women generally choose a job in the informal sector, such as selling, selling cakes around, selling herbs around, scavenged, domestic workers, farm laborers, garden laborers, and other work. The reasons for choosing such occupations are the difficulty of getting a job, lack of employment, lack of women's creativity, lack of skills, and the absence of the capital to open their own business. The constraints faced are the lack of business capital, the number of rivals in work and the absence of transportation. The dual role of women as a housewife and as the main breadwinner for her family have an effect on not maximal the woman in running both function. The government's efforts in the welfare of women's economy are to socialize policies, empower women programs, provide guidance to women, assistance in solving women's problems and provide business capital assistance.

Abstract

This study aims to determine how much influence the variable direct and indirect advertising, product quality, price and the level of confidence in the purchasing decisions through an online shop in the city of Medan. The method used in this study is quantitative approach using path analysis with multiple linear regression model is supported by test models and statistical tests using SPSS version 17. Findings from the research showed structural model 1 in unison that approximately 72.1% of advertising variables , product quality, the level of trust and influence purchasing decisions through an online shop in the city of Medan, while 27.9% is explained by other factors. In two simultaneous structural model that approximately 56.6% variable advertising, product quality and prices affect the level of trust while 43.4% is explained by other factors. The test results show the significance of the indirect impacts their indirect effect of the variable quality of the products on purchase decisions online through a confidence level significantly.

Abstract

Pada dasarnya pola bagi hasil dalam penelitian ini adalah pola bagi hasil akad mudharabah, Mudharabah adalah kontrak yang melibatkan antara dua kelompok, yaitu pemilik modal (shohibul mal) yang mempercayakan modalnya kepada pengelola (mudharib) untuk digunakan dalam aktifitas perdagangan, dan keuntungan (profit) dibagi antara investor dan mudharib berdasarkan proporsi yang telah disetujui bersama. kerja sama antara shohibul mal dengan mudharib dimana modal usaha sepenuhnya berasal dari shahibul mal. Dalam penelitian ini shohibul mal adalah pemilik kapal dan mudharib adalah anak buah kapal, ada persoalan yang sangat berpengaruh terhadap dampak ekonomi di antara kedua belah pihak yaitu pola bagi hasil dimana nelayan sebagai penerima modal mengelola usaha yang dibiayai pemilik kapal berkewajiban memberikan bagi hasil sesuai kesepakatan. jika terjadi kerugian, maka resiko sepenuhnya ditanggung oleh pemilik kapal selama kerugian tersebut bukan akibat kelalaian mudharib (nelayan), namun kenyataannya tidak semunya berjalan sesuai dengan hasil kesepakatan, dimana ada diantara sebagian anak buah kapal melakukan kecurangan dengan menjual sebagian ikan tanpa di ketahui oleh pemilik kapal. Berdasarkan masalah yang ingin peneliti kaji, dalam penelitian ini rumusan masalahnya sebagai berikut: 1. Bagaimanakah Praktik Pola Bagi Hasil Nelayan dengan Pemilik Kapal di Gampong Tanoh Anou Kec. Idi Rayeuk?. 2. Bagaimanakah Respon Nelayan Terhadap Pola Bagi Hasil dengan Pemilik Kapal Tanoh Anou Kec. Idi Rayeuk ?. Adapun tujuan penelitian dalam penelitian ini adalah untuk mengetahui praktik Pola Bagi Hasil Nelayan dengan Pemilik Kapal di Gampong Tanoh Anou Kec. Idi Rayeuk dan Untuk mengetahui Respon Nelayan Terhadap Pola Bagi Hasil dengan Pemilik Kapal Tanoh Anou Kec. Idi Rayeuk. Hasil penelitian ini menujukan bahwa pola bagi hasil antara nelayan dengan pemilik kapal di desa Tanoh Anao termasuk dalam kategori mudharabah, sedangkan berkaitan dengan pola bagi hasil ada dua macam bentuk yaitu 50:50 dan 40:30:30, dimana pembagian itu di istilahkan 40:30:30. Artinya 40% untuk pemilik kapal, 60% untuk para ABK, yang nantinya bagian tiap ABK mendapatkan porsi masing-masing, yaitu 30% untuk nahkoda (pawang) serta yang mempunyai tugas khusus, dan 30% untuk anak buah kapal yang hanya membatu proes penangkapan ikan. Namun masyarakat merasa pola bagi hasil yang selama ini berjalan merugikan pihak nelayan sehingga sebagaian dari mereka melakukan kecurangan dengan menjual sebagiam ikan di tengah laut sebelum hasil tangkapannya diserahkan kepada pemilik kapal.

Abstract

Transaksi jual beli tanpa menyebutkan sighat akad sering kali terjadi, baik saat berbelanja di pasar swalayan maupun pasar tradisional. Pada dasarnya, hukum asal transaksi adalah keridhaan kedua belah pihak yang berakad, namun tentunya tidak sesederhana itu. Dibutuhkan akad dalam transaksi tersebut dan pastinya bukan sembarang akad. Akad sendiri memiliki syarat dan rukun yang harus dipenuhi agar transaksi yang dilakukan sah menurut hukum Islam. Diantara bentuk bisnis yang sedang di posisi trend teratas saat ini adalah transaksi jual beli online. Penjual dan pembeli tidak saling bertemu, bahkan tidak saling mengenal, namun saling melakukan transaksi jual beli. Dalam praktik ini, sering terjadi kealpaan seperti tidak adanya sighat akad dan hilangnya kesakralan akad, sehingga melahirkan tanda tanya tentang keabsahan jual beli tersebut. Permasalahan ini yang akan penulis jelaskan secara mendetail berdasarkan kajian fikih muamalah agar tidak ada lagi kerancuan dalam bertransaksi. Walau bagaimanapun hukum Islam tetaplah hukum Islam yang harus ditaati selama tidak ada udzursyar’i yang menghalanginya. Penelitian ini bertujuan untuk mengetahui tinjauan hukum Islam terhadap jual beli tanpa sighat akad dan untuk mengetahui tinjauan hukum Islam terhadap jual beli transaksi jual beli tanpa sighat akad yang terjadi pada transaksi online. Sehingga jenis penelitian ini adalah penelitian kepustakaan. Peneliti mendasarkan teori penelitian ini pada alQuran dan al Hadist. Salah satunya di dalam alQuran surat al-Maidah: 1 yang berbunyi “Hai orang-orang yang beriman, penuhilah akad-akad itu. Dihalalkan bagimu binatang ternak, (kecuali yang akan dibacakan kepadamu), yang demikian itu (dengan tidak menghalalkan berburu ketika kamu sedang mengerjakan haji). Sesungguhnya Allah menetapkan hukum- hukum menurut yang dikehendaki- Nya”. Berdasarkan hasil penelitian penulis, dapat disimpulkan bahwa dalam keadaan normal, jual beli yang sah wajib disertai dengan lafal ijab dan kabul, kecuali ada hal (keadaan) lain yang menyebabkan gugurnya kewajiban tersebut. Jika transaksi jual-beli online dilakukan secara transfer bank atau rekening bersama, keduanya dilakukan tanpa bertemu langsung antara penjual dan pembeli, maka ada keringanan yang menggugurkan kewajiban sighat akad, namun harus jelas bahwa pembeli dan penjual sama-sama rela dengan barang yang dijualbelikan.
