Abstract

The obedience of citizens to every legal product, such as state law and Islamic law for its adherents, is absolute when a country and religious people want to create a democratic climate in the 21st century. This study discusses the governance of citizens’ compliance with the law, especially Islamic law, in a Pancasila-democratic country. There are two sources of law in Indonesia; the first is religious law and positive state law, both of which invite people to the path of goodness for justice and democracy. This study uses a phenomenological approach to collect as much data as possible and examine it to obtain relevant answers. This study concludes that the governance of citizens’ compliance with Islamic law in a democratic country is mutually supportive obedience, meaning that they obey religion, so they will abide by the state so that this country becomes a democratic country. Ketaatan warga negara terhadap setiap produk hukum seperti hukum negara dan hukum Islam bagi pemeluknya adalah mutlak ketika sebuah negara dan umat beragama ingin menciptakan iklim demokrasi di abad 21. Penelitian ini ingin membahas tata kelola kepatuhan warga negara terhadap hukum, khususnya hukum Islam, di negara demokrasi Pancasila. Ada dua sumber hukum di Indonesia; yang pertama adalah hukum agama dan hukum positif negara, keduanya mengajak masyarakat ke jalan kebaikan untuk keadilan dan demokrasi. Penelitian ini menggunakan pendekatan fenomenologis untuk mengumpulkan data sebanyak mungkin dan memeriksanya untuk mendapatkan jawaban yang relevan. Penelitian ini menyimpulkan bahwa tata kelola kepatuhan warga negara terhadap hukum Islam di negara demokrasi adalah kepatuhan yang saling mendukung, artinya mereka mematuhi agama, sehingga mereka akan mematuhi negara sehingga negara ini menjadi negara demokrasi

Abstract

Muslim scholars and local communities have actively negotiated the Islamization process in Indonesia through complex engagements with Islamic law (sharia) and local cultural traditions. This study examines how such interactions have shaped distinct constructions of Islamic moderation in three culturally significant regions: Gorontalo, Minangkabau, and Banten. Employing a qualitative, field-based approach, the research utilizes in-depth interviews, participant observation, and document analysis to explore the integration of sharia and adat (customary law). The findings reveal three typological models of Islamic moderation: (1) an integrative model in Gorontalo, where royal diplomacy and political marriage internalized Islamic law within the framework of customary governance; (2) a negotiation model in Minangkabau, emerging from post-conflict reconciliation between ulama and customary leaders, institutionalized through the philosophy of Adat basandi syarak, syarak basandi Kitabullah; and (3) a hegemonic model in Banten, characterized by the dominance of Islamic law over local traditions, embedded within the centralized religious authority and state power. These findings suggest that Islamic moderation in Indonesia is not a singular concept but the product of historically and contextually embedded legal-cultural dynamics. The study concludes that Islamic moderation is a localized negotiation among legal norms, cultural practices, and power structures. Its academic contribution advances the understanding of legal pluralism in Muslim societies while offering policy-relevant insights for promoting religious tolerance and cultural inclusivity in Indonesia.

Abstract

This article aims to critically examine the power of custom based on sharia' in the dynamics of the encounter between custom and Islamic law in Gorontalo. This research is aimed at showing how localities are involved in a very dynamic histo-sociological encounter or struggle between Islamic law and culture. This research uses literature study (library research) with a qualitative approach. This study found that the power of customs or traditions will never fade in Gorontalo society as a traditional region. Because customs or traditions are identity, so losing tradition is the same as losing identity. The local customs or culture of the Gorontalo people, which are preserved and practiced to this day, are the result of the dialectic between customary law and Islamic law. The power of this custom is stronger because it is based on the Shari'a, giving birth to the philosophy of “adati hula-hulaa to saraa, saraa hula-hulaa to syara'”. The meaning in the current context is actually to strengthen the power of custom so that there is no conflict in society that pits custom against Islamic law.
