Abstract

Fikih kaya atas keragaman opini hukum, termasuk fikih perempuan. Opini hukum fikih tentang perempuan tidak tunggal melainkan beragam. Keragaman fikih perempuan ini sejatinya menjadi pilihan alternatif atas fikih yang berperspektif gender. Tulisan ini menawarkan wacana non dominan sebagai fikih alternatif untuk menghadirkan fikih yang berkeadilan gender. Sebab wacana dominan tentang fikih perempuan dikritik sebagai fikih yang tidak berkeadilan gender. Sementara fikih tidak hanya menghadirkan wacana dominan, melainkan juga menyandingkan wacana non dominan. Dalam wacana non-akikah dan cara membersihkan air kencing bayi laki-laki dan perempuan disamakan. Bersentuhan dengan perempuan tidak membatalkan wudhu, dan perempuan memiliki hak yang sama dengan lelaki dalam hal perwalian, saksi dan kepemimpinan. Dalam wacana non dominan, perempuan boleh menjadi wali dan saksi pernikahan, imam salat jamaah dan pemimpin publik. -----------------Jurisprudence has a diversity of opinions over the law interpretation. Among other is the women jurisprudence. Furthermore, the women legal opinion is subsequently not single but diverse. The diversity of women jurisprudence is actually seen as an alternative, that is, ‘gender’ perspective kind of fiqh. This paper offers a non-mainstream discourse over the fiqh by presenting and assessing ‘gender’ perspective kind of jurisprudence. This is done because it is seen that most discourse over women jurisprudence were dominated by gender inequality; and therefore it should be thoroughly criticized. With the exception of akiqah discourses, the way to bath boys’ and girls’ urine, they both treated equally the same. Any physically contacts with women subsequently do not invalidate the ablution (wudhu). Therefore, woman has equal rights with man in custody, witness and leadership. More importantly, in the non-dominant discourse of jurisprudence, woman may be a guardian and a witness to a wedding, even can be a khutbah priest and an imam of public congregational prayers.

Abstract

Tulisan ini menguraikan tentang asas personalitas keislaman; salah satu asas umum yang melekat pada lingkungan Pe-radilan Agama. Asas ini menegaskan empat hal. Pertama, tempat penyelesaian hukum adalah Pengadilan Agama. Itu berarti yang berwenang dalam menyelesaikan perkara adalah pengadilan agama. Kedua, yang berperkara adalah orang-orang Islam. Itu berarti, non muslim tidak ada keharusan untuk tunduk kepada kekuasaan lingkungan Peradilan Agama. Ketiga, ketundukan personalitas muslim kepada lingkungan Peradilan Agama terbatas pada hukum perdata tertentu. Itu berarti, ketundukan tersebut bukan bersifat umum meliputi semua bidang hukum perdata, melainkan bidang tertentu, yaitu: perkawinan, kewarisan, wasiat, hibah, sedakah dan perwakafan. Keempat, hukum yang diberlakukan adalah hu-kum Islam, yaitu hukum yang berkenaan dengan keperdataan. Hukum ini tertuang dalam Kompilasi Hukum Islam Indonesia.

Abstract

Interpretation and understanding of the authoritative sources of Islam (Quran and Hadith) are not single, but diverse. Therefore, the diversity and differences understanding are inevitable and historical. In the midst of diversity and difference are needed openness, respect and it don’t negate the different opinions, and distanced himself from the claim of truth single opinion is a moral imperative to harmony. This paper offers five principles for knitting harmony intended, namely: mandatory precedence (Wajib) over the Sunnah; promoting scientific paradigm on religious, agreed on the principle (qathi-usul) and tolerant on the particulate matter (zhanni-furu), emphasizes the relationship to the debate; and did not highlight his own opinion as he cornered a different opinion. These five principles of fiqh tasamuh (jurisprudence of tolerant).

Abstract

The core application of Islamic personality is not a separate entity relationships on the basis of legal relations. Perfection and absolute principle of Islamic personalities must be supported by elements of legal relationship under Islamic law. It needs various strategies to apply the principles of Islamic personality. There are two main strategies to implement the principles of Islamic personalities. That is what he calls a common guide and the guide during the legal relationship. The definition of common standards is a benchmark that is formal. While the definition of the benchmark when there is that in the event of a legal relationship both parties are equally Muslim and legal bond that ties them to do under Islamic law.

Abstract

This article aims to elaborates M. Quraish Shihab's thoughts on the concept of tajdīd in addressing the challenges of globalization. In conducting legal reasoning, M. Quraish Shihab distinguishes between principles and particulars (al-qat’ī min al-zannī), understanding the legal sources contextually and allegorically. M. Quraish Shihab's legal response in fatwas based on the moderation paradigm, ease and far from being fanaticism. It is very frequently happening that the choice and answer to the law and the fatwa of M. Quraish Shihab opposite the mainstream, such as the ability to choose a leader who is not a religious leader congratulates Christians on the Christmas day and does not require a headscarf. For these different opinions, liberal accusations are often pinned to M. Quraish Shihab.

Abstract

This paper descibes the dynamic of Islamic law. Dynamics of Islamic law was born through a progressive process of ijtihad. Ijtihad progressive Islamic law gave birth to four products, namely fiqh, fatwa, legislation in Muslim countries (Qanun) and a court decision (making up). The fourth product of the Islamic legal thought is rich with a diverse opinion (deviation). In the Sunni Jurisprudence born five popular Islamic school of thought (Hanafi, Maliki, Shafi'i, Hanbali and Zahiri) with different patterns of thought. Rational Hanafi, Maliki tend to the opinion of the People of Madinah, the moderate Shafii, Hanbali tradition emphasizes the meaning of birth and textual Zahiri.

Abstract

This paper discusses about the Siti Musdah Mulia’s thought about polygamy in Islam. This research is a library research with primary data sources are the writings of Siti Musdah Mulia about women, especially polygamy. Data were analyzed descriptively qualitatively with a sociological approach to law. The results showed that Siti Musdah Mulia refuted polygamy because it was considered to insult and insult women's dignity. The Marriage Law and Compilation of Islamic Law which legalize polygamy favor the interests of men and ignore women. The provisions of polygamy in the Marriage Law and KHI have psychological implications for women; violence against women; and social towards the community. Whereas the principle of ushul fiqh is to reject the negative excesses rather than benefit.

Abstract

This study aims to determine and analyze the views of Marriage Registrar at the Office of Religious Affairs (KUA) in Gorontalo City on the registration of underage marriages. This research is a field research. The approach used is a legal approach and a sociological approach. Data collected through observation, interviews and documentation. Furthermore, it is processed and analyzed with qualitative descriptive. The results showed that: First, the level of underage marriages in the KUA region in Gorontalo City increased every year from 2016 to 2018. Various reasons were put forward by the parties, both prospective brides and families to be able to carry out underage marriages; Second, in principle the Marriage Registrar in Gorontalo City understands and implements the marriage registration rules based on the Minister of Religion Regulation No. 19 of 2018 about Marriage Registration.
