Abstract

Harmonization the draf regional regulation is an attempt to harmonize,adjusting, strengthening and rounding up the conception of a draf regionalregulatios, wheter higher, equal or more low, and other matters other than lawsand regulation, so that they are arranged systematically, not conflicting oroverlappig, regional regulations in Riau Province must of course be inaccordance with the principles of forming laws and regulations and providiondthat are in accordance with the philosophy o Pancasila and local wisdom.This research is a sociological legal research, this is based on fieldresearch which refers to interviews and observations statements as wellsupporting documents that have a corelation with the background of the problemto be studied. This study uses secondary date sources consisting of primary,secondary, and tertiary legal materials. This study uses qualitative date analysisby producing a deductive method of drawing conclusions, namely drawingconclusions from that are general to things that are specific.From the results of the discussion, it can be concluded that theharmonization, rounding and strengthening of the draft Provincial RegionalRegulations was carried out by vertical agencies, in this case the Regional Officeof the Ministry of Law and Human Rights, Riau Province. Obstacles in theprocess of harmonization of Riau Province Regional Regulations are caused byseveral factors, namely: the minimum number of human resources, the difficultyof adjusting time between agencies, and the limited budget resulting in norescheduling of the process. Efforts that need to be made so that theharmonization of the Riau Province Regional Regulation Draft can beimplemented is by providing an adequate number of human resources to carry outthe harmonization, the obligation of the relevant parties to be present whendiscussing harmonization, and the existence of an adequate budget to guaranteelegal products in the form of Regional Regulations.Keyword: Harmonization, Regional Regulation, Riau province.

Abstract

The zoning system is a policy for accepting new students (PPDB) which iscarried out by determining the zone radius between the school and the placewhere the relevant student lives. One of the objectives of the zoning system itself ismapping students during school registration, besides aiming to equalize thequality of education, eliminate the title of favorite school, improve the quality ofteachers, and reduce the level of traffic congestion.This research was conducted using a qualitative approach, the authorwent into the field to conduct observations and direct interviews with researchinformants. The unequal quality of education equivalent to State High Schools hasbeen a problem that has been occurring for some time. Efforts made to overcomethis problem are the implementation of a zoning system for Admission of NewStudents (PPDB).The PPDB zoning system aims to: a) Ensure that the admission of newstudents is carried out in an objective, transparent, accountable, nondiscriminatory and fair manner in order to encourage increased access toeducational services, b) Ensure the availability and readiness of educational units(state schools, in particular) to be able to provide quality education services, c)Ensure equal access and fair quality of education in each zone/region determinedto be close to where students live, d) Ensure the provision of competent teachingand education staff supported by adequate infrastructure and facilities that can beprovided and used jointly by every educational unit in the designated area/zone.However, in reality, the zoning system has not been implemented wel, due to theineffective use of Family Cards. This is proven by the methods used by thecommunity to continue attending the school which has been labeled as a favoriteamong the community, including the people of Pekanbaru.The conclusion fromthe research is that equal distribution of education using the zoning system hasnot been completely successful, there are several factors causing this to happen.Suggestions from this research is to have an approach to the communityregarding the purpose of implementing a zoning system, so that the communityunderstands and complies with the regulations issued by the government.Keywords: Zoning System, Acceptance of New Students (PPDB)

Abstract

The Constitutional Court is a state institution that was formed after the amendment to the 1945 Constitution. In this context, the Constitutional Court has a vision in enforcing the constitution which aims to create a state that strictly adheres to law and democracy in the administration of state life. The Constitutional Court has 9 (nine) constitutional judge members appointed by the President, each of whom is appointed 3 (three) people by the Supreme Court, 3 (three) people by the DPR and 3 (three) people by the President. One of the reasons for the DPR's involvement in filling the position of constitutional judge after the 1945 Constitution was the phenomenon of strengthening the DPR in the Indonesian constitutional system during the democratic transition period through changes to the 1945 Constitution. However, this involvement has the potential to give rise to a number of problems, including the existence of the DPR's authority which is very decisive in the selection process for constitutional judges can give rise to problems of politicization. The aim of this research is to determine the implementation of the authority of the People's Representative Council in filling the positions of constitutional judges based on the principles of the rule of law and democracy in Indonesia and to find out the ideal model for filling the positions of constitutional judges from the authority of the People's Representative Council in the future. The results of this research explain that first, the DPR's authority to fill the position of constitutional judge is not in accordance with the principles of democracy and the principles of the rule of law because when filling the constitutional judge, the DPR actually has full authority over the nomination of 3 constitutional judges. Second, the Recruitment and Selection Model for Constitutional Court Judges using a Selection Panel either by the respective Institution Proposing Constitutional Judges or a selection Panel in the form of an agreement with the Institution Proposing Constitutional Judges is a legal reform whose main aim is to produce constitutional judges who have the ideal integrity as a statesman Really.

Abstract

Penelitian ini mengkaji tanggung jawab pemerintah dalam mencegah kerusakan hutan yang dilakukan oleh perusahaan pemegang izin Hutan Tanaman Industri (HTI), dengan studi kasus pada PT. Perawang Sukses Perkasa Industri (PSPI) di Kampar, Riau. Latar belakang penelitian muncul dari maraknya praktik pembalakan liar dan perambahan hutan di dalam kawasan konsesi PSPI, meskipun telah tersedia berbagai perangkat hukum yang mewajibkan perusahaan dan pemerintah untuk melakukan perlindungan hutan secara optimal. Kondisi ini menunjukkan adanya kesenjangan antara regulasi yang berlaku dan realitas pelaksanaan di lapangan. Penelitian ini menggunakan metode hukum sosiologis, dengan pengumpulan data primer melalui wawancara bersama pejabat pemerintah, aparat dinas kehutanan, serta perwakilan perusahaan. Selain itu, data sekunder diperoleh dari peraturan perundang-undangan, buku, jurnal, dan dokumen resmi lainnya. Seluruh data dianalisis secara kualitatif dengan pendekatan deskriptif-analitis untuk menggambarkan dan menilai efektivitas tanggung jawab pemerintah dalam pengawasan kehutanan. Hasil penelitian menunjukkan bahwa tanggung jawab pemerintah dalam perlindungan hutan belum berjalan secara efektif. Faktor-faktor utama yang mempengaruhi antara lain keterbatasan sumber daya manusia, lemahnya koordinasi antarinstansi, serta kurang optimalnya kegiatan pemantauan di lapangan. Di sisi lain, evaluasi pemerintah terhadap kepatuhan perusahaan juga masih lemah, terlihat dari jarangnya verifikasi terhadap laporan perusahaan serta ketidaktegasan dalam penerapan sanksi. Penelitian ini menyimpulkan bahwa pencegahan kerusakan hutan membutuhkan pengawasan yang lebih kuat, penegakan sanksi yang konsisten, serta peningkatan kerja sama antara pemerintah, perusahaan, dan masyarakat.
