Abstract

Distribution is an activity of distributing or distributing goods or services to several people or groups to facilitate the flow of marketing channels, both physical and non-physical. Zakat has a very strategic role in efforts to eradicate poverty and zakat plays a role in the economic development of Muslims. In contrast to other financial sources for development, zakat does not have any return impact except the pleasure and hope of Allah alone. If combined with zakat, the distribution of zakat is the distribution of zakat to people who are entitled to receive it (mustahik) either consumptive or productive with the aim of increasing the welfare of the mustahik. Based on several definitions that have been explained previously, what is meant by Effectiveness of Distribution of Zakat, Infaq and Alms Funds is the process of thinking and analyzing with the aim of measuring the accuracy of the implementation of the distribution of zakat, infaq and alms funds during the Covid-19 pandemic. So the purpose of the title: Effectiveness of distribution of zakat, infaq and alms funds during the Covid-19 pandemic is a way to understand the process and examine the activities of distributing zakat, infaq and alms funds which is useful for knowing the extent to which these funds can be realized. Implementation of appropriate and targeted distribution of zakat, infaq and alms funds can be felt to be beneficial and effective for the community, especially during the Covid-19 pandemic in Pandanarum Village

Abstract

Hadith is the second primary source of Islamic law after the Qur'an and plays a vital role in shaping legal norms, including in matters of marriage law. However, certain hadiths used as legal foundations—particularly those concerning the age of marriage remain contested in terms of their validity and contextual relevance. In this regard, Harald Motzki’s methodological contributions are significant, especially through his isnād-cum-matn analysis and dating theory, which allow for a historical and textual tracing of hadith transmissions. This study employs a qualitative approach using library research to examine Motzki’s epistemology and its relevance to reinterpreting hadiths often used to justify child marriage practices. The findings suggest that Motzki’s approach reveals the dynamic nature of hadith transmission and opens the door for more contextual and just reinterpretations of Islamic law. Thus, Motzki’s epistemology is not only essential in the academic study of hadith but also strategically valuable in supporting the reconstruction of Islamic marriage law that aligns with child protection and the principles of maqāṣid al-sharī‘ah.

Abstract

Undang-Undang No. 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) menandai tonggak penting dalam perlindungan terhadap korban kekerasan seksual di Indonesia. Salah satu pendekatan yang dilakukan peneliti adalah restorative justice (keadilan restoratif), yang idealnya bertujuan untuk memperbaiki kerugian yang dialami korban, bukan sekadar menghukum pelaku. Namun, dalam praktik perundang-undangan dan pelaksanaannya, terdapat celah normatif yang menyebabkan pendekatan ini tidak mampu memenuhi tujuan pemulihan secara menyeluruh. Kegagalan pemulihan korban bukan hanya disebabkan oleh faktor teknis, tetapi juga oleh kelemahan dalam konstruksi hukum yang berlaku. Penelitian ini bertujuan untuk mengkaji dan menganalisis pengaturan hukum mengenai restorative justice dalam UU TPKS secara normative sehingga dapat menilai sejauh mana norma-norma hukum tersebut mampu menjamin hak-hak korban untuk dipulihkan secara utuh. Penelitian ini menggunakan metode normatif yuridis, yaitu penelitian hukum yang berfokus pada pengkajian bahan hukum primer dan sekunder. Pengaturan hukum belum secara eksplisit memberikan ruang bagi partisipasi aktif korban dalam menentukan bentuk pemulihan yang sesuai dengan kebutuhan dan kondisi mereka. Ketiadaan peraturan pelaksana (Peraturan Pemerintah atau Peraturan Menteri) menghambat efektivitas implementasi keadilan restoratif secara normatif. Jadi Secara normatif, pengaturan restorative justice dalam UU TPKS belum cukup kuat untuk menjamin pemulihan korban secara menyeluruh.
