Abstract

Divorce often leaves a significant psychological, emotional, and social impact on children, as well as disrupting their well-being and development. This study aims to explore Cooperative Parenting (Co-Parenting) as a way of post-divorce parenting that is in line with the principles of Islamic family law. This study uses a qualitative approach with a descriptive-analytical method based on literature study. The results show that effective Co-Parenting can minimize the negative impact of divorce by creating emotional stability, harmonious relationships, and consistent attention from both parents. This approach not only supports the physical and emotional needs of the child but also reflects the moral and spiritual responsibility of parents in accordance with Islamic values. The implementation of Co-Parenting has the potential to optimize children's development as well as be a strategic solution to maintain their welfare after divorce.

Abstract

Fenomena perceraian merupakan isu yang terus meningkat meskipun pernikahan memiliki nilai sakral. Di Desa Sawentar, Kecamatan Kanigoro, peran pemerintah desa melalui Kepala Desa dan perangkatnya menjadi kunci dalam mencegah perceraian. Upaya preventif ini memanfaatkan budaya mediasi yang telah menjadi tradisi masyarakat setempat, sesuai dengan konsep ‘urf. Penelitian ini bertujuan untuk mengkaji bagaimana peran pemerintah desa dalam memfasilitasi mediasi rumah tangga yang bermasalah dan mencegah perceraian. Dengan pendekatan kualitatif dan metode penelitian lapangan, data diperoleh dari wawancara dengan pasangan yang mengalami konflik rumah tangga, perangkat desa, dan Kepala Desa. Temuan menunjukkan bahwa budaya mediasi berbasis ‘urf berkontribusi signifikan dalam mencegah perceraian dan membangun keharmonisan keluarga. Implikasi penelitian ini menegaskan pentingnya peran pemerintah desa sebagai mediator dalam penguatan ketahanan keluarga melalui pendekatan berbasis nilai lokal.

Abstract

The Qur'an is a holy book that was revealed directly by Allah to humans through His messenger, the Prophet Muhammad. Understanding the Qur'an which was directly revealed by the Creator makes humans also demand an understanding of how the position of humans with God is, it doesn't stop there, this will continue with widespread understanding and thinking about the concepts of life that humans want to understand completely. So that it is necessary to understand both the position of humans and God in order to find a good and correct understanding of what God means in the Qur'an as a provision for humans to complete their duties in the world, then try to discuss the Basic Structure of Weltanschauung Al-Quran and the Ontology Between God and Humans. The Quran explains that there is a relationship between man and God. The relationship between God and man can be in the form of ontological relations, communication relations, master and servant and ethical relations which in some of these relationships need to be related to one another. This perfect relationship then makes a certain group, the group is called the Muslim community. The Qur'an explains that the position of the Qur'an is to mediate between this world and the hereafter, where the Qur'an acts as a liaison or something that represents the transition between the two (world and the hereafter).

Abstract

Hadith is the second primary source of Islamic law after the Qur'an and plays a vital role in shaping legal norms, including in matters of marriage law. However, certain hadiths used as legal foundations—particularly those concerning the age of marriage remain contested in terms of their validity and contextual relevance. In this regard, Harald Motzki’s methodological contributions are significant, especially through his isnād-cum-matn analysis and dating theory, which allow for a historical and textual tracing of hadith transmissions. This study employs a qualitative approach using library research to examine Motzki’s epistemology and its relevance to reinterpreting hadiths often used to justify child marriage practices. The findings suggest that Motzki’s approach reveals the dynamic nature of hadith transmission and opens the door for more contextual and just reinterpretations of Islamic law. Thus, Motzki’s epistemology is not only essential in the academic study of hadith but also strategically valuable in supporting the reconstruction of Islamic marriage law that aligns with child protection and the principles of maqāṣid al-sharī‘ah.

Abstract

The Legal Reconstruction of Marriage Dispensation in Indonesia through a Theo-Juridical Approach in the Perspective of the Qur’an aims to re-examine the practice of underage marriage within the context of Islamic law, particularly from the perspective of the Qur’an, and to recommend a form of legal reconstruction within the Indonesian legal system. Child marriage remains a persistent legal and social phenomenon across various regions in Indonesia, despite the revision of the minimum marriageable age through Law Number 16 of 2019. A legal loophole in the form of marriage dispensation, as stated in Article 7 paragraph (2), creates room for practices that contradict the principles of child protection. This study employs a normative-juridical method and thematic (maudhū‘i) interpretation of Qur’anic verses related to marriage, family responsibility, and child protection. The findings indicate that the Qur’an emphasizes not only biological readiness but also intellectual maturity (rushd) as an ideal requirement for marriage. The practice of marriage dispensation is considered inconsistent with maqāṣid al-sharī‘ah, particularly in the aspects of protecting life, intellect, lineage, and the dignity of children. This paper recommends legal reconstruction that includes statutory reform, strengthening of law enforcement structures, and transformation of legal culture in society based on Qur’anic values.

Abstract

Marriage is a series of sacred processions that cannot be separated from the provisions set by religious law. The implementation of marriage cannot be separated from the social culture of society which has been preserved for generations. One of the prohibitions or challenges in marriage that has developed in Javanese society is that the calculation of wehon is erratic or inappropriate. The aim of this research is to determine the meaning and implementation of the custom of selecting weton in marriage from a urf perspective. This research discusses the definition of wethon, the implementation of selecting wethon according to the opinions of scholars and according to urf. Apart from that, it also discusses urf analysis of the practice of calculating wethon in Sanankulon village. In this research, empirical methods are used, the data collection method in this research is interviews. The results of this research show that calculating the wethon is very ingrained in the community. This custom cannot be separated from people's lives. In fact, almost all the people of Sumber village, Sanankulon sub-district use calculating the wethon before marriage, in order to find a good day for marriage. Classification of the purpose of calculating the wethon that is done The prospective bride and groom's parents divide it into two, namely believing it is bad luck if it is not counted and only as a matter of caution or consultation. If you believe in bad luck then the action is considered shirk, but if it is just a consultation then it is not considered shirk.

Abstract

Nilai-nilai dan nalar Maqashid Syariah dalam fase ini terlihat sangat jelas sekali, dalam berbagai hal yang dilakukan oleh para sahabat, tabi’in, tabiut tabi’in dan lainnya dalam menentukan sebuah keputusan yang berhubungan dengan Islam, baik itu dalam hukum dan lain sebagainya. Artikel ini adalah perpustakaan penelitian dengan pengumpulan data kualitatif dan pendekatan normatif-teologis untuk menganalisis maqasid syari’ah di masa sahabat dan tabi’in. Hasil penelitian ini menyebutkan bahwa pada zaman sahabat dan tabi’in, pengetahuan mereka sempurna tentang hukum hukum yang terdapat di dalam Al Quran dan mengetahui pula sebab sebab turunnya, serta rahasia syariat dan tujuan karena pergaulan mereka pada zaman nabi saw. Karena itu mereka tidak memerlukan peraturan peraturan dalam mengambil suatu hukum. Mereka tidak menggunakan pengetahuan Ushul Fiqh dalam teori, tetapi dalam praktek sesungguhnya ilmu ini telah diterapkan dan menjadi teladan bagi umat sesudahnya.

Abstract

In Islam, adopting children has been known since the time of the Prophet Muhammad. Literally, tabbani means a family couple who tries to get a foster child from another family, then treats it as if it were their biological child. The reality of informants in Sawentar, Blitar, child adoption is based on the agreement of biological parents with adoptive parents, then the adopted child is manipulated as if he were the biological child of the adoptive parents, without going through the court process, Research qualitative approach type of observational research, field-research, determination of empirical approaches, subjected to 3 primary sources. Descriptive qualitative means using qualitative data, then described descriptively. Problems are solved by non-doctrinal empirical normative studies, sourced from primary and secondary data. The purpose of the research is to describe the process of adoption without trial, under HI / Islamic Law and or HP / Positive Law. Documentation, data collection by interviewing, observing reinforced the technique of analyzing documents in the design of descriptive qualitative methods, starting with reducing, presenting, ending with drawing conclusions, where the researcher holds the primary key. The conclusion was found that child adoption in Sawentar Village, the subject of the study carried out the adoption without going through the procedures as established by the government. This means that in positive law there is a violation of the law. The subject considers the judicial procedure to be a lot of time consuming, feels the complexity, does not meet the requirements of adoption, and the lack of understanding regarding child adoption according to the law. Implications, reviewing positive law, judicial child adoption is not fulfilled, if the socialization of adoption in the community is not intensified. Adoption is more about the agreement of both parties without a court process. Then, there is a lack of legal protection for adopted children, confidentiality in both, if not open, nasab (family ties based on blood relations, both up, down, and sideways) and the pleasure of the mother, father or biological person will be lost.
