Abstract

AbstractThis legal research aims to know the implementation of the prudential banking principles in the giving of credit with the guarantee of Warehouse Receipt in the Bank of Central Java Jepara Branch Office and all its problems. This research is a descriptive empirical law research. Technique of collecting data through interview and literature study. The types of data used are primary and secondary data types. The data analysis tecnique used is qualitative with interactive analysis model. Based on the result of this legal research, the implementation of prudential banking principles in the giving of credit with the guarantee of Warehouse Receipt conducted by Bank of Central Java Jepara Branch Office with several stages,but in its implementation is not done maximally because there are some actions that do not reflect bank prudential principles.. Keyword: Prudential Banking Principles, Credit, Warehouse Receipt Guarantee.AbstrakPenelitian hukum ini bertujuan mengetahui penerapan prinsip kehati-hatian bank dalam pemberian kredit dengan jaminan Resi Gudang di Bank Jateng Kantor Cabang Jepara. Penelitian hukum ini merupakan penelitian hukum empiris yang bersifat deskriptif. Teknik pengumpulan data melalui wawancara dan studi pustaka. Jenis data yang digunakan adalah jenis data primer dan sekunder. Teknik analisis data yang digunakan adalah kualitatif dengan model analisis interaktif. Berdasarkan hasil penelitian hukum ini, penerapan prinsip kehati-hatian bank dalam pemberian kredit dengan jaminan Resi Gudang yang dilaksanakan oleh Bank Jateng Kantor Cabang Jepara dengan beberapa tahapan, namun dalam pelaksanaannya tidak dilakukan secara maksimal karena ada beberapa tindakan yang tidak mencerminkan prinsip kehati-hatian bank.Kata Kunci: Prinsip Kehati-hatian Bank, Kredit, Jaminan Resi Gudang

Abstract

Objective: This research aims to explores how to guarantee the right to health for marginalised groups, examines systemic barriers to accessing health services, and evaluates the role of government policies and health insurance programmes in reducing the healthcare gap. Research Design & Methods: This research uses a qualitative method with a literature review approach, where literature related to health rights and health insurance policies for marginalised groups are the main sources in analysing the problems and solutions. This approach allows for an in-depth understanding of the issues faced by marginalised groups in accessing health services as well as the role of government policies in addressing these disparities. Findings: The Indonesian government is obligated to ensure the right to health for all individuals, including marginalised groups, through an inclusive health system supported by legal frameworks and health insurance programmes like Health Social Security Administering Body (SSAB), JKN-KIS, and Prolanis, which help reduce disparities in access to health services. Implications & Recommendations: To reduce the health access gap, the government must develop inclusive policies, collaborate closely with community organizations, and prioritize infrastructure and resource distribution in remote areas to ensure equitable health services. Contribution & Value Added: This research emphasizes the importance of protecting the right to health for marginalised groups, the role of government in ensuring equal access through health policies, the need for a strong legal foundation, and offers practical recommendations for more inclusive and effective health policies.
