Abstract

The regulation concerning the functions of the Kerapatan Adat Nagari (KAN) in the Regional Regulation of West Sumatra Province presents several issues. On one hand, this regulation aims to strengthen the role of KAN by expanding its membership composition to ensure broader representation. However, on the other hand, this expansion becomes counterproductive as it leads to uncertainty regarding the number of KAN members. A fixed number of members is crucial for the validity of decision-making processes and the legitimacy of the decisions made. Similarly, the authority granted to KAN to formulate Peraturan Nagari (Perna) also raises concerns. Since Perna serves as a primary instrument in the implementation of Nagari autonomy, granting KAN the authority to establish Perna could be seen as an effort to reinforce KAN as a customary institution. However, it could also be viewed as a restriction of customary jurisdiction, as Peraturan Nagari must inherently take the form of written law. Furthermore, if Peraturan Nagari—except for the Nagari Revenue and Expenditure Budget (APB-Nag)—were to be established in an unwritten form, it would create difficulties in Nagari governance, as written regulations provide greater legal certainty and serve as essential documents for various administrative purposes. Therefore, KAN membership should ideally be limited to ninik mamak (customary elders), and its functions should be restricted to formulating policies within the domain of customary law. Additionally, KAN should be responsible for proposing recommendations for Perna to the Badan Permusyawaratan Nagari (Nagari Consultative Body) whenever certain matters are deemed significant enough to be formalized into Peraturan Nagari.

Abstract

After the Amendment of 1945 Constitution, democracy and Rule of Law become two concepts. They are the concept on how to run the power and run the goverment of Indonesia. Both concept, are interconected among each others and can not be separated, because on one side, democracy gives the grounds and mechanisme of power based on the principles of togetherness and equality, while on the other side, rule of law gives guide lines that goverment in the state is not a human but the law of human being. The both of concepts have relation each other. This article are trying to connected and related both concepts in an unseperated function.

Abstract

In the history of the formation of laws and regulations in Indonesia, the Law of the Republic of Indonesia Number 11 of 2020 Concerning Job Creation, is a product of laws and regulations that used the Omnibus Method for the first time in drafting its laws. The Mechanism for Forming Law Number 11 of 2020 refers to Law of the Republic of Indonesia Number 12 of 2011 concerning Formation of Legislation and as amended by Law of the Republic of Indonesia Number 15 of 2019 concerning Amendments to Law Number 12 of 2011 concerning Formation of Legislation, these two laws do not regulate the Omnibus Method. Arrangements related to the new Omnibus Method are included in the Law of the Republic of Indonesia Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 concerning the Formation of Legislation.

Abstract

Pengujian (judicial review) Undang-Undang terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 oleh Mahkamah Konstitusi, dari sisi struktur Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 ( terdiri atas pembukaan dan pasal-pasal) akan memunculkan pertanyaan; apakah yang dijadikan “batu uji” adalah cukup pasal-pasal dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 atau ‘plus’ pembukaan? Bagaimana kalau dalam permohonan pengujian undang-undang, pemohon memohonkan pengujian suatu undang-undang terhadap pembukaan dengan dalil tidak menemukan batu uji dalam pasal-pasal tetapi ditemukan dalam pembukaan serta mendalilkan pembukaan merupakan bagian yang tak terpisahkan dari Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (Pasal II aturan tambahan?.

Abstract

In Indonesia, the understanding of rule of law cannot be separated from the influence of the development of good thinking fromrule of law northe rule of law, but still has distinctive characteristics as shown in the 1945 Constitution of the Republic of Indonesia. The method for forming laws and regulations in Indonesia uses codification and sectoral. The codification method is the preparation of legal regulations in a book of laws in writing including collecting scattered legal provisions, then arranged systematically. There are various problems that arise in the formation of legislation in Indonesiaover regulations, overlapping regulations, multiple interpretations, ineffective, and sociologically problematic. Government encouragement in the progress of the Indonesian economy through the application of the methodlaw to all namely the Job Creation Law. This research is a legal research (doctrinal research) with a conceptual approach (conceptual approach) and the legal approach (statues approach). The results of this study explain that MethodAll Law in the formation of laws and regulations it has been regulated through Law Number 13 of 2022 where the purpose of the Omnibus Law is to link a rule with other related rules as intended to be integrated. Second, the Omnibus Law as an effort to overcome hyper regulation as a whole. Simplification as to avoid overlapping between regulations and other regulations

Abstract

The precedent of dismissal and replacement of Constitutional Court Judge Aswanto during his term of office by the proposing body (DPR) is the first time this has occurred in the history of filling the position of Constitutional Court Judge in Indonesia. Does the DPR unilaterally have the authority to dismiss or...recall against Constitutional Judges originating from their proposals during their term of office. The research results explain thatLThe proposing body can renominate or replace the constitutional judge from his proposal during his term of office if the constitutional judge from his proposal is dismissed during his term of office by the President first at the request of the Chairman of the Constitutional Court based on the reasons stated in the Law on the Constitutional Court. However, the proposing institutions (DPR, Supreme Court and President) cannot unilaterally withdraw or recall constitutional judges based on their proposals.
