One of issue which often emerge in local goverment in indonesia is  Peraturan Daerah syariah, that is local regulation based on islamic law. Result of this research conclude that the Peraturan Daerah syariah is transformation of syaria as islamic law into local regulation as  positive law. in side of  legislation, it  can be assesed by using the principles of formulation of legislation and principles of material contens of legislation. To asses from perspective of human rights can be used three categories,  that is: arranging worship, having the character of privat law,  and having the character of publik law.Based on  two assesment instrument, Regulation Arranging worship and having character of private law should be assigned by central government through The Ministery of Religion Affairs, but syaria doctrin having character of publik law can be poured into local regulation as material resources of law.  Academically, the existence of Peraturan Daerah syariâah is motivated by Islamic doctrin on  the state in interpretation of Ibnu Khaldun  and Ibnu Taymia.  This doctrin is related to the teaching  of Imam Malik that  enable to release  the regulation such as  Peraturan Daerah SyariAh, although  not in the Islamic state. Practically, the Peraturan Daerah syariah is driven by political appointment while political campaign for local election. So far Peraturan Daerah Syariâah  is more as moral appeal rather than legals norm.

Deconcentration is an important element in the administration of the state. Its existence is not only in administrative law order, but also in Constitutional law because - like decentralization - it concerns the foundations and organization of the state. If decentralization gave birth to local government (autonomous region), then deconcentration gave birth to local state government (administrative area). These administrative areas are headed by what is known theoretically as a Prefector. For the Indonesian context, the prefector is held by the governor in such a way that the governor has a dual position, namely as the head of the autonomous region of the province as well as the prefector. The laws governing local government in Indonesia use the term representative of the center in the regions for the designation of prefector. Since the reformation until now, the administration of government from the center to the regions seems to have marginalized deconcentration as the governance structure. There was a strong impression during the reform era that looked at deconcentration as if were the antithesis of democracy. The impression was so strong that deconcentration and administrative areas were no longer included in the post-amendment 1945 Constitution. The deconcentrative authority possessed by the governor to revoke Regency/City Regional Regulations (Perda) that are contrary to higher laws, public interests, and decency, was annulled by the constitutional court in its decision in 2016. Furthermore, budgeting and regulation and formation the apparatus that assists the governor as the central representative in the regions appears to be running slowly. In this way the question arises: is the implementation of deconcentration effective by the governor as the representative of the central government in the regions? To answer this question, research was carried out on the implementation of the deconcentration. The results of the research show that the implementation of the deconcentration has not been effective due to various limitations: limited tools, limited rules, and limited authority

BPJS (Badan Penyelenggara Jaminan Sosial) Kesehatan merupakan lembaga jaminan kesehatan dalam lingkup Negara Kesatuan Republik Indonesia,memiliki kedudukan yang sangat penting dalam sistem pelayanan kesehatan di Indonesia. Keberadaan BPJS Kesehatan di Indonesia merupakan penggantian terhadap Askes (Asuransi Kesehatan) yang mulai diberlakukan sejak tanggal 1 Januari 2014, yang diatur di dalam Undang-Undang Nomor 24 Tahun 2011. Pelaksanaan pelayanan kesehatan melalui BPJS Kesehatan yang diberlakukan terhadap PNS, Polri, Pensiunan dan Masyarakat saat ini mengalami keterbatasan bagi pemerintah di dalam memberikan perlindungan hukum dalam pelayanan kesehatan. Keterbatasan tersebut menimbulkan masalah tersendiri bagi pemerintah dalam memberikan pelayanan publik dalam rangka mewujudkan asas pemerintahan yang baik (Good Governance) sebagaimana diamanatkan oleh Undang-Undang Nomor 25 Tahun 2009 Tentang Pelayanan Publik. Oleh sebab itu, perlu dirumuskan dan diketahui kebijakan pemerintah dalam pelaksanaan pelayanan kesehatan melalui BPJS (Badan Penyelenggara Jaminan Sosial) Kesehatan dalam rangka memberikan perlindungan hukum terhadap pasien dan untuk mewujudkan Asas Pemerintahan yang Baik (Good Governance), khususnya pada masa menghadapi pandemi covid-19 di Indonesia, khususnya di Provinsi Sumatera Barat.

Pengaturan tentang nagari sebagai satuan pemerintahan terendah dan kesatuan masyarakat hukum adat di sumatera Barat diatur pada tingkat Provinsi dengan Peraturan Daerah Nomor 7 Tahun 2018 Tentang Nagari. Sebagai Perda yang mengusung konsep adat, materi perda ini tidak mencerminkan filosofi adat basandi syara’, Syara’ basandi Kitabullah sebagai filosofi adat masyarakat nagari. Sebagai tatanan masyarakat adat, filosofi tersebut seharusnya dituangkan ke dalam struktur kelembagaan nagari. Sesuatu yang ditinjau dari konteks konsep otonomi asli sebagai otonomi nagari tidaklah bertentangan dengan Pancasila dan Undang-Undang Dasar 1945. Untuk itu harus dibentuk satu lembaga yang berfungsi untuk mewujudkan supremasi syara’, yang memiliki kedudukan tertinggi diantara lembaga-lembaga yang ada dalam nagari. Lembaga ini berfungsi untuk menjaga agar setiap kebijakan nagari yang dituangkan ke dalam Perna sebagai wujud dari otonomi asli tidak bertentangan dengan ketentuan syara’ (Agama). Perda hanya berfungsi mengatur kelembagaan nagari yang berkaitan dengan segi-segi administratif dan manajemen pemerintahan yang tidak mereduksi kewenangan nagari dalam melaksanakan otonomi asli menurut hukum tatanegara adat sepanjang terkait dengan kelembagaan nagari. Selebihnya pengaturan kelembagaan yang ada di nagari harus diserahkan kepada nagari yang bersangkutan untuk diatur dalam Perna dalam rangka mewujudkan otonomi asli dalam bidang hukum tata Negara adat.

This research aims to find out how the implementation of voting rights and the challenges faced in the implementation of voting rights of the Baduy community in Kanekes Village, Lebak Regency in the 2019 general election. The research uses a juridical-empirical method with data collected through document study and interview by using purposive sampling and snowball technique which is done directly through a list of questions and conducted on a rolling basis. All data obtained from the research will be compiled and analyzed qualitatively which includes data reduction, data presentation, and conclusion drawing. This study concludes that the Inner Baduy community has stricter rules in carrying out customary law it results in a prohibition on the establishment of polling stations in the Inner Baduy area, in addition to the existence of the Lunang customary value or Milu Kanu Meunang which is believed by the Baduy community, namely following the winner, this is an attitude of accepting and obeying government rules regardless of whoever the candidate or party wins the electoral contestation, this makes some of the Baduy community, especially the Inner Baduy, do not use their voting rights.

Old-Age Security (JHT) is an employment social security program that has the objective of providing cash benefits through a lump sum payment when participants enter retirement age, pass away, or experience permanent total disability. Where this mechanism is the embodiment of the mandate of Article 28H Paragraph (3) of the 1945 Constitution. However, the practice of implementing JHT has experienced several problems, for example changing implementing regulations in a short time, which raises two problems: First, regarding the dynamics of JHT arrangements in Indonesia, and the perspective of Human Rights in the implementation of JHT. This study uses a normative juridical method with library data collection techniques. This study concludes that the regulatory changes that have occurred in the regulations surrounding JHT are the government's efforts to adapt regulations to developments so that workers can enjoy JHT, but the government is not optimal in disseminating regulations to JHT beneficiaries. Meanwhile, from a human rights perspective, it can be concluded that the government is already present in realizing the fulfillment of the right to social security through JHT, which is through a legal umbrella in the form of Government Regulations and Ministerial Regulations. It's just that changing legal products in a short time is the main obstacle that has resulted in JHT not running optimally, so that workers have not been able to fully enjoy the fulfillment of their rights to JHT. Therefore, this study concludes that the government needs to create permanent regulations that do not require changes in a short time to fulfill JHT rights as a form of legal certainty.

In general elections, the public has the right, namely, not to vote, and the right to be elected. The right to be elected is the right of citizens to be elected as members of deliberative bodies or representatives of the people in a general election. Article 240 paragraph (1) letter g of the General Election Law regulates restrictions on the right to vote for former corruption convicts. Regarding the norms in this article, the Constitutional Court and the Supreme Court have different views. This is formulated in the Constitutional Court Decision Number 87/PUU-XX/2022 and the Supreme Court Decision Number 46P/HUM/2018. This article analyzes the views of Constitutional Justices and Supreme Court Justices regarding the norms in article 240, paragraph (1) letter g. The purpose of this article is to find out how voting rights are limited for former corruption convicts. This article uses a normative juridical research method. The research results found that first, restrictions on the right to vote for former convicts may be carried out in the interests of ensuring the freedom of disadvantaged groups. Second, in deciding a decision, the judge is obliged to explore, follow and understand the legal values and sense of justice that exist in society as well as pay attention to the juridical aspect.

The leadership of the Regional People's Representative Council (DPRD) can be dismissed at any time before their term of office ends, as happened in Solok Regency, Bukittinggi City and West Pasaman Regency. The three DPRD Chairmen were dismissed from their positions before the end of their terms of office. The problem in this research is what are the arrangements and procedures for dismissing the chairman of the district/city Regional People's Representative Council according to the relevant laws and regulations and whether the dismissal of the Chairman of the Regional People's Representative Council is in accordance with the governing regulations. This research aims to determine the arrangements for dismissing the chairman of the district/city DPRD according to relevant laws and regulations during his term of office according to regional government regulations, the mechanism for dismissing the Chair of the DPRD and the legal consequences of dismissing the Chair of the DPRD during his term of office on the implementation of the functions and duties of the DPRD in accordance with the problem formulation and the planned research objectives, the method used in this research is empirical juridical. The research results show that: there are two types of procedures for dismissing the chairman of the district/city Regional People's Representative Council, namely, through a proposal from a political party or through a complaint to the Honorary Board of the district/city Regional People's Representative Council. Research carried out in three regions, can be concluded that first the dismissal of the chairman of the district DPRD. Solok could not be carried out because there was not enough evidence of violating the code of ethics, while the dismissal of the Chairman of the Bukittinggi City DPRD could not be carried out after the Padang PTUN decision which stated that Parizal Hafni as Chairman of the Bukittinggi City DPRD won his lawsuit against DPP Gerindra and finally the dismissal of the Chairman of the District DPRD. West Pasaman can be implemented because it is in accordance with existing procedures/mechanisms.

Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah mengamanatkan bahwa salah satu tugas Gubernur sebagai Wakil Pemerintah Pusat adalah melakukan pengawasan terhadap Bupati/Walikota. Dalam melaksanakan tugas tersebut, Gubernur berwenang memberikan sanksi administratif kepada Bupati/Walikota. Gubernur dapat memberikan sanksi terhadap 16 pelanggaran administratif yang dilakukan oleh Bupati atau Wali Kota. Namun demikian, terdapat fenomena dimana Gubernur sebagai Wakil Pemerintah Pusat tidak dapat memberikan sanksi kepada Bupati atau Wali Kota, meskipun telah melakukan tindakan yang dianggap tidak sesuai atau tidak patut dalam kerangka hierarki pemerintahan daerah. Hal tersebut menjadi dasar penelitian ini, khususnya: 1. Bagaimana pengawasan yang dilakukan Gubernur sebagai Wakil Pemerintah Pusat terhadap Bupati/Walikota? 2. Bagaimana ketentuan yang mengatur sanksi administratif terhadap Bupati/Walikota dalam rangka tugas pengawasan Gubernur sebagai Wakil Pemerintah Pusat? Penelitian ini menggunakan pendekatan yuridis normatif, yaitu penelitian yang dilakukan melalui penelitian hukum yang mengkaji doktrin dan asas dalam ilmu hukum. Hasil penelitian ini dapat disimpulkan sebagai berikut: 1. Dalam menjatuhkan Sanksi Administratif Gubernur sebagai Wakil Pemerintah Pusat memiliki kewenangan yang terbatas, karena adanya penyempitan ruang lingkup penjatuhan sanksi administratif dalam rezim Undang-Undang Nomor 23 Tahun 2014 dibandingkan dengan rezim Undang-Undang Nomor 32 Tahun 2004. Keterbatasan dan penyempitan tersebut mengakibatkan tidak optimalnya penegakan hukum administrasi oleh Gubernur terhadap Bupati/Walikota. 2. Pengawasan yang dilakukan oleh Gubernur sebagai wakil Pemerintah Pusat kepada Bupati/Walikota merupakan turunan dari teori negara kesatuan, pengawasan tersebut sangat penting untuk menjaga keutuhan negara kesatuan. Pengawasan Gubernur terhadap Bupati/Walikota merupakan instrumen penegakan hukum administrasi sebagaimana diatur dalam Undang-Undang Pemerintahan Daerah selain instrumen lain sanksi administrasi.

Penyelenggaraan Pemungutan Suara Ulang dalam pemilihan umum Dewan Perwakilan Daerah (DPD) Sumatera Barat merupakan buah dari dari adanya putusan MK Nomor 03-03/PHPU.DPD-XXII/2024. Rentetan panjang pelaksanaan PSU tersebut yang juga diikuti dengan berbagai persoalan-persoalan hukum tidak terlepas dari ketiadaaan pengaturan yang mengatur secara tegas dalam Undang-Undang Pemilu berkaitan dengan Pelaksanaan PSU sebagai akibat dari dikeluarkannya putusan Mahkamah Konstitusi. Pengaturan terkait itu hanya diatur dalam Peraturan KPU, hal ini sejatinya belumlah cukup. Sehingga dengan itu susah untuk menentukan bagaimana politik hukum pengaturan PSU tersebut. Penelitian ini membahas dua rumusan masalah, pertama Bagaimana Politik Hukum Pengaturan Pemungutan Suara Ulang Dalam Pemilihan Umum Dewan Perwakilan Daerah (DPD), kedua Apakah Politik Hukum Pengaturan dan Pelaksanaan Pemungutan Suara Ulang Dalam Pemilihan Umum Dewan Perwakilan Daerah (DPD) Sudah Sesuai dengan Asas Kepastian Hukum. Penelitian ini dilakukan dengan menggunakan metode penelitian normatif dengan data sekunder sebagai data utama dan dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa, pertama, Politik hukum pengaturan dan pelaksanaan pemungutan suara ulang DPD Sumatera Barat menunjukkan tidak adanya pengaturan yang tegas terkait dengan PSU akibat dari putusan MK. Kedua, pelaksanaan Pemungutan Suara Ulang DPD Sumatera Barat tidak sesuai dengan asas kepastian hukum, hal tersebut dikarenakan terjadinya kekosongan pengaturan dalam Undang-Undang yang lebih tinggi terkait dengan PSU akibat dari putusan MK. .
