Abstract

History records that the success in the effort to formulate a compilation of Islamic law was overshadowed by differences of opinion from several Islamic legal thoughts at that time. Moreover, there are many offers to include customary law and BW that are familiar to Muslims in the country into the KHI material. The emergence of differences of opinion among ulama is due to many factors, including their differences in using arguments, the method of ijtihad and understanding the al-Qur'an and Sunnah texts, the background, social, educational, and cultural backgrounds of the KHI formators at that time. This study uses a descriptive qualitative research approach. This study answers the hypothesis that certain social values and solidarity play an important role in the conclusions of a legal product. In collecting data in this study, the authors used two techniques, namely direct interviews and documentation. Direct interviews with figures involved in formulating KHI and several Islamic legal experts who are seen as understanding the issues being studied. Also reviewing data from other sources such as documentation related to KHI formulations such as journals, newspapers, magazines, study manuscripts at the beginning of the KHI preparation and other sources of information. The results of the study show the fact that the formulation of KHI through a structural approach is top down from the central government, but still involves the role of the ulama, scholars and practitioners of Islamic law. KHI material absorbs fiqh that is familiar in the country. The dynamics of differences of opinion are found in three patterns of Islamic Law thought that emerged at that time. First, the literalisasi group, which is a group that opposes thoughts that violate the nash qat'i. Secondly, the group is assimilative, this group tries to find a new interpretation in understanding nash qat'i. The three groups are Harmonized, Characteristics of this group may be out of zahir nash, if  judging there are provisions that can be an alternative, inheritance is included in the category of mu'amalat worship which must be open to accepting changes by considering the interests and eliminating the narrowness in society.History records that the success in the effort to formulate a compilation of Islamic law was overshadowed by differences of opinion from several Islamic legal thoughts at that time. Abstract

One of the important studies in Islamic family law is the provision of inheritance. Inheritance provisions are often a source of disputes within the family, especially in determining who is entitled to receive an inheritance. One form of progress in Islamic law in Indonesia is the formulation of the Compilation of Islamic Law. Article 97 of the Islamic Law Compilation stipulates that the share of inheritance for widows and widowers states that "The divorced widow or widower is each entitled to half of the joint property as long as it is not specified otherwise in the marriage agreement. The application of this article has received a response from the clergy and mass organizations in the country. The type of research used in this research is library research. The primary data source looks at the results of the Muhammadiyah Tarjih Council Decisions and the Decisions of Bahsul Masa'il Nahdhatul Ulama after 1991. The results of the study show the fact that there is a response to the acceptance of joint property provisions in KHI. First, from Bahtsul Masa'il NU, it was stated that the provisions for shared assets in KHI had not been accepted, divided automatically 50:50 because there was no ṣigat in the consent and qabul when the marriage contract, the automatic distribution of 50:50 was invalid because all the heirs who were still alive had not agreed. Both of the Muhammadiyah Tarjih Council can accept joint property provisions. According to Muhammadiyah, shared assets can be attributed to the concept of syirkah abdan (kongsi) in classical fiqh. Because husband and wife both contribute energy, help to meet household needs. Another reason is because the provisions on shared assets can be categorized as 'urf authentic which has been widely practiced in various regions in Indonesia.

Abstract

The Religious Courts Law and the Compilation of Islamic Law serve as guidelines for resolving cases in the Religious Courts. The drafting of religious justice laws and the drafting of Islamic law in Indonesia involved several important stages and key figures. One of the important figures in the preparation and formulation of laws regarding religious justice and the preparation of Islamic law is Busthanul Arifin. This research aims to explain Bustanul Arifin's ideas and thoughts which color the formulation of religious laws and the preparation of Islamic law in Indonesia. This research uses a qualitative method with a content analysis approach. The research findings explain that Busthanul Arifin's thoughts greatly influenced the formation of religious justice laws and the drafting of Islamic law. There are three important thoughts of Busthanul Arifin, namely first; institutionalization of Islamic law can avoid differences in the application of Islamic law. Second, the institutionalization of Islamic law can be carried out by increasing the authority and function of religious courts. Third, the institutionalization of Islamic law is to uphold justice and strengthen the Indonesian state based on Pancasila, not to create an Islamic state. Knowing and understanding Busthanul Arifin's thoughts on Islamic law legislation in Indonesia through the judiciary will provide an understanding that unity in the application of Islamic law is a solution to avoid legal dualism and strengthen the upholding of justice and is by Pancasila.

Abstract

Hingga saat ini ketentuan terkait hibah dalam KHI terus menjadi perdebatan di kalangan hakim dan praktisi Hukum Islam di Indonesia. Hal ini karena adanya ketentuan hibah di KHI yang berbeda dengan fikih klasik. Oleh karena itu menarik untuk diteliti tentang analisis metode ijtihad kontemporer terkait ketentuan  hibah dalam Kompilasi Hukum Islam. Metode penelitian ini menggunakan library research dengan menggunakan pendekatan sosiologi hukum. Hasil penelitian ditemukan dua kelompok yang berbeda dalam menggunakan metode ijtihad terkait hibah dalam KHI yaitu:  Pertama, kelompok tradisional yang menolak beberapa ketentuan hibah KHI  karena bertentangan dengan nash dan pendapat para fuqaha’. Metode ijtihad yang di pakai adalah Metode Ijtihad selektif (Ijtihad intiqo’i. Kedua, kelompok modernis yang bercorak harmonisasi dengan mencari jalan tengah antara hukum fikih kelasik dengan peraturan yang berlaku dan mempertimbangkan adat istiadat di Indonesia. Metode ijtihad yang digunakan  adalah penggabungan dari ijtihad selektif (Ijtihad intiqo’i) dengan ijtihad kreatif (insya’i) Until now, the provisions related to grants in the KHI continue to be debated among judges and practitioners of Islamic Law in Indonesia. This research method uses library research using a sociology of law approach. The results of the study found two groups of disagreements among scholars regarding post-formulation grants, namely: First, traditional groups that reject grant terms because they contradict the nash and the opinions of the fuqaha'. The ijtihad method used is the intiqo’i ijtihad method. Second, modernist groups that have a harmonized pattern by finding a middle way between class jurisprudence and applicable regulations and considering customs in Indonesia. The ijtihad method used is a merger of selective ijtihad (Ijtihad intiqo'i) with creative ijtihad (insya'i).
