Abstract

Penelitian ini bertujuan untuk memahami tentang perlindungan konsumen terhadap produk makanan dan minuman yang dijual serta mengetahui upaya penanggulangan kadaluwarsa produk makanan dan minuman, baik dari segi klaim konsumen maupun pengendalian terhadap produk makanan dan minuman yang dijual. Penelitian yang digunakan adalah penelitian normatif, meneliti dan mengkaji tentang hukum sebagai norma, aturan, asas hukum, prinsip hukum, doktrin hukum. Bahan hukum yang dipergunakan mengikat secara hukum berkaitan dengan makanan dan minuman yakni Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-undang Nomor 7 Tahun 1996 tentang Label dan Iklan Pangan, dan Peraturan Pemerintah No. 69 Tahun 1999 tentang Label dan Iklan dan peraturan perundangan lain yang terkait. Hasil penelitian menyatakan bahwa, bentuk perlindungan konsumen terhadap makanan dan minuman yang dijual meliputi pengendalian oleh Dinas Kesehatan, pengendalian oleh Badan Pengawas Obat Makanan (BPOM), dan pengendalian oleh produsen melalui pemasaran atau penjualan produk. Upaya pengawasan produk makanan dan minuman yang dijual antara lain melalui penerapan prosedur peredaran produk dan pengawasan produk. This research aims to understand consumer protection for food and beverage products sold and to determine efforts to overcome the expiration of food and beverage products, both in terms of consumer claims and control over food and beverage products sold. The research used is normative research, researching and studying law as norms, rules, legal principles, legal principles, legal doctrine. The legal materials used are legally binding in relation to food and drink, namely Law Number 8 of 1999 concerning Consumer Protection, Law Number 7 of 1996 concerning Food Labels and Advertisements, and Government Regulation No. 69 of 1999 concerning Labels and Advertisements and other related laws and regulations. The research results state that forms of consumer protection for food and drinks sold include control by the Health Service, control by the Food Drug Monitoring Agency (BPOM), and control by producers through marketing or selling products. Efforts to monitor food and beverage products sold include, among other things, implementing product distribution procedures and product supervision.

Abstract

This study, titled The Legal Consequences of Breach of Contract in E-Commerce Transactions under Law No. 19 of 2016 on Electronic Information and Transactions, addresses the legal framework governing online buying and selling activities in Indonesia, with particular focus on the consequences that arise when a seller fails to fulfil their contractual obligations. It examines how such transactions are regulated by the Electronic Information and Transactions Law and investigates the legal implications of breach of contract (wanprestasi) within that context. The research adopts a normative juridical approach, concentrating on the analysis of legal norms and principles within positive law. This doctrinal method relies primarily on written legal sources, including statutory provisions, academic literature, legal theories, and expert opinions relevant to the research topic. Data collection was conducted through library research, by reviewing and compiling both primary and secondary legal materials. These materials were then analysed using a qualitative normative method, which involves interpreting the law in a systematic and logical manner to evaluate its application to e-commerce transactions. The study ultimately aims to provide a comprehensive understanding of the legal process surrounding online commerce and to clarify the specific legal outcomes when a seller breaches their contractual duties under the prevailing legal framework.
