Abstract

Tujuan penelitian ini adalah untuk untuk mengetahui politik hukum pencalonan anggota DPR-RI yang berdomisili berbeda dengan daerah pemilihannya serta bagaimana konsekuensi pelaksanaannya terhadap rakyat, sehingga pemilu legislatif dapat benar-benar mencerminkan kedaulatan rakyat yangs sejati. Adapun metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian socio-legal, yaitu dilakukan dengan studi tekstual dalam pasal peraturan perundang-undangan kemudian dianalisis secara kritikal untuk dijelaskan makna dan implikasinya. Sehingga hasil dari peneltian ini menunjukan politik hukum terhadap calon anggota DPR RI yang mencalonkan diri dari daerah pemilihan bukan domisilinya di Indonesia masih pro dan kontra, syarat berdomisili di dapil dalam pencalonan anggota DPR RI harus segera diatur kedalam peraturan perundang-undangan, karena merupakan bentuk penghormatan terhadap NKRI. Norma yang mengatur mengenai syarat domisili dalam pencalonan anggota DPR-RI cenderung terlalu luas, sehingga akan memberi ruang kerugian bagi kebanyakan masyarakat pada implikasinya. The purpose of this study is to determine the legal politics of nominating DPR-RI members who are domiciled differently from their electoral districts and how the consequences of its implementation on the people, so that legislative elections can truly reflect the true sovereignty of the people. The research method used in this research is the socio-legal research method, which is carried out by textual studies in the articles of legislation and then analyzed critically to explain the meaning and implications. So that the result of this research is that the legal politics of candidates for members of the DPR RI who are nominating themselves from an electoral district instead of their domicile in Indonesia are still pros and cons, the requirements for domicile in the candidacy for members of the DPR RI must be regulated immediately into legislation, because it is a form of respect. against the Republic of Indonesia. The norms governing the domicile requirements in the nomination of DPR-RI members tend to be too broad, so that it will leave room for losses for most of the people on its implications.

Abstract

The Decree of the People's Consultative Assembly, also known as MPR Decrees, contains decisions made by the People's Consultative Assembly. The presence of MPR Decrees has undergone various system dynamics within the hierarchical order of legislation in Indonesia. Law Number 12 of 2011 on the Formation of Legislation reintroduces MPR Decrees as a type and hierarchy of law and regulation, reversing the previous law, Law Number 10 of 2004, which abolished the MPR Decrees from the structural hierarchy. The re-existence of MPR Decrees in the Indonesian legislative system has implications for the order and position of these decrees in the state administration system. This research adopts a normative research method, utilizing a statutory approach as the primary legal material and secondary legal materials such as books, journals, and other sources for analysis. The findings of this study indicate that the re-existence of MPR Decrees creates ambiguity in the validity of the MPR within the state administration system, considering that MPR Decrees originated before the reform or amendment of the 1945 Constitution, when the MPR held a higher position as a state institution. Furthermore, there is no authorized judicial institution to test the MPR Decrees if they are suspected of violating the provisions of the Constitution of the Republic of Indonesia.
