Abstract

AbstrakHukum Jahiliyyah pra-Islam bersifat patriarki, diskriminatif, dan zalim, Islam hadir merubah bahkan menghapus tradisi-tradisi buruk yang telah mengakar kuat dalam masyarakat pra-Islam. Karakter Islam bertolak belakangan dengan tradisi Jahiliyyah. Islam menjunjung tinggi persamaan dan kesetaraan sebagaimana tertuang dalam al-Quran dan hadis. Metode yang digunakan adalah penelitian kepustakaan (library research) dengan menggunakan pendekatan kualitatif. Data-data yang diperoleh dianalisis menggunakan teknik deskriptif analisis. Secara teoritis al-Quran mengandung prinsip kesetaran antara laki-laki dan perempuan, kelahiran Islam sebagai rahmatan lil alamin memberikan hak-hak dalam Perkawinan, Mahar Poligami, Waris  bagi perempuan, sehingga Islam mengubah budaya patriarki (otoritas suami) menjadi peradaban yang bersifat egaliter. Pembaharuan Islam di bidang keluarga tersebut sejalan dengan tuntutan egaliter antara perempuan dan laki-laki (suami dan istri).  AbstractThe pre-Islamic law was patriarchy, discriminatory, and despotic. Islam was present to change and even expunge a immoral traditions that were existing in past era. Islamic characters contradicted to the ignorance tradition. Islam upholds equality as stated in the Quran and hadith. The method used is library research and using a qualitative approach. The data obtained were analyzed using descriptive analysis techniques. Theoretically, the Qoran contains the principle of equality between men and women, the come of Islam as rahmatan lil alamin provides rights in marriage and inheritance for women. Thus, Islam changed the patriarchal culture (husband's authority) into an egalitarianism. Islamic reform in the family sector is regarded with egalitarian demands between women and men (husband and wife).Keywords: Islamic Reform, Family, Egality, Husband, Wife.

Abstract

The development of information technology not only covers social, political and cultural but also affects the economy. One that is being widely discussed is Fintech. This article aims to analyze fintech on PT. iGrow Resources Indonesia towards fatwa DSN number 117 / DSN-MUI / II / 2018 about information technology-based financing services based on sharia principles. This research is a library research using a descriptive analysis approach. PT. iGrow is not directly participate in the lending and borrowing process but provides a digital technology-based platform to facilitate the lending-borrowing process. The development of technology and information, especially Peer to Peer (P2P) Lending, has made innovation in fintech-based financial services more practical and modern. The concept of adapting to technological developments combined with the financial sector by iGrow which was development step that is very aware of the needs of fintech for the business world. Regarding the extent to which the Islamic principles applied in PT. iGrow, can be seen in the discussion of the agreement. It is concluded that the standard contract is not in accordance with sharia principles based on the DSN fatwa number 117 / DSN-MUI / II / 2018 concerning information technology-based financing services based on sharia principles.Keywords: Contract, Fintech, iGrow, Sharia,  AbstrakPerkembangan teknologi informasi tidak hanya mencakup kehidupan sosial, politik, dan budaya tetapi juga berpengaruh terhadap perekonomian. Salah satu yang sedang ramai diperbincangkan adalah Fintech. Artikel ini bertujuan untuk menganalisa fintech di PT. iGrow Resources Indonesia berdasarkan fatwa DSN nomor 117/DSN-MUI/II/2018 tentang layanan pembiyaan berbasis teknologi informasi berdasarkan prinsip syariah. Penelitian ini merupakan penelitian kepustakaan (library research) dengan menggunakan pendekatan deskriptif analisis. PT. iGrow tidak turun langsung dalam proses pinjam meminjam tetapi  menyediakan platform berbasis teknologi digital dalam memfasilitasi proses pinjam-meminjam. Perkembangan teknologi dan informasi khususnya Peer to Peer (P2P) Lending telah menciptakan inovasi  layanan keuangan berbasis fintech menjadi semakin praktis dan modern. Konsep adaptasi perkembangan teknologi yang dipadukan dengan bidang financial oleh iGrow merupakan langkah pengembangan bisnis yang sangat menyadari kebutuhan fintech bagi dunia bisnis. Terkait sejauh mana prinsip syariah yang diterapkan dalam PT. iGrow, dapat dilihat pada pembahasan akad dalam kontrak. Disimpulkan bahwa kontrak baku belum sesuai dengan prinsip syariah berdasarkan fatwa DSN nomor 117/DSN-MUI/II/2018 tentang layanan pembiyaan berbasis teknologi informasi berdasarkan prinsip syariah. Kata Kunci: Fintech, iGrow, Kontrak, Syariah

Abstract

AbstrakTulisan ini bertujuan untuk mengetahui peran ganda yang dibebankan kepada oran tua terhadap pembelajaran online anak di masa pandemi Covid-19. Adapun rumusan masalah penelitian ini adalah bagaimana peran ganda orang tua terhadap pembelajaran online anak di masa pandemi covid-19? dan bagaimana tinjauan hukum Islam atas peran ganda orang tua terhadap pembelajaran online anak di masa pandemi covid-19?. Dalam penulisan ini menggunakan Metode Kualitatif Deskriptif dengan pendekatan studi kasus (case study) melalui wawancara, observasi dan dokumentasi kepada orang tua yang memiliki anak usia sekolah pada jenjang pendidikan TK, SD, SMP dan SMA. Hasil dari penulisan ini adalah Pandemi Covid-19 berdampak pada sektor pendidikan mulai dari jenjang pendidikan TK, SD, SMP, SMA. Kebijakan belajar online di rumah mengharuskan orang tua berperan ganda, pertama menjadi orang tua yang mengasuh anak kedua, menjadi guru bagi pendidikan formal anak. Bagi para orang tua, hendaknya berupaya menggunakan cara-cara atau pola pendidikan anak sebagaimana yang di syariatkan dalam Al-Quran dan Sunnah.Kata kunci:  Peran Ganda, Pembelajaran Online, Covid-19.

Abstract

This study aims to analyse the dynamics of the political relationship between Islamic law and customary law in inheritance disputes in Indonesia. This study employs a critical qualitative approach using legal-political discourse analysis based on social theory as its main framework. It focuses on a critical reading of legal texts, legislation, religious fatwas, court decisions, customary documents, and public discourse in the mass media and academia related to inheritance disputes. The findings reveal that the struggle and negotiation between Islamic law and customary law in inheritance disputes in Indonesia are not merely conflicts between religious norms and local traditions, but rather a sharp reflection of how the state regulates, negotiates, and even instrumentalises law for the sake of political identity and formal stability. When the state chooses to affirm one legal system while reducing another, what is sacrificed is not only legal diversity itself but also substantive justice for the most vulnerable women, customary communities, and those living under overlapping legal authorities that are not equal. This is where the urgency lies for the emergence of a new legal paradigm that not only recognises plurality but also nurtures it as a collective force towards inclusive social justice.

Abstract

Departing from the ecological crisis that reveals the paradox between ritual piety and massive environmental destruction, this study positions the Qur'anic narrative about nature not as a frozen normative text, but as a living ethical-political horizon with the potential to convert Indonesian Muslim religiosity into transformative ecological activism. This study uses a qualitative approach with an interpretive-critical design, combined with a multiple-case study strategy, to examine in depth how the Qur'anic narrative about nature is produced, articulated, and mobilised in ecological activism as a social practice rich in context, values, and power relations. The results indicate that the reconstruction of Qur'anic narratives about the cosmos, mīzān, fasād, raḥmah, and amānah of the caliphate encourages the conversion of religiosity from ritualistic to ecological religiosity, which positions nature as an ethical-political subject, while also providing a framing device for Muslim activists, Islamic boarding schools, and grassroots movements to build awareness, environmentally friendly practices, and advocacy for ecological justice in agrarian conflicts, climate crises, and resource management. These findings strengthen and expand the study of Islam and the environment by showing that Qur'anic narratives function as symbolic resources that frame awareness, build solidarity, and drive community-based ecological activism, especially when they engage creatively with local wisdom and respond to the dynamics of environmental politics in Indonesia.
