Abstract

Financial Services Authority Regulation Number 19/POJK.03/2014 concerning Financial Services Without Offices In the Context of Inclusive Finance, the Financial Services Authority in collaboration with the Banking sector makes services sell well. In this study as clever behavior is Bank Central Asia, which is one of the banks that conducts Officeless Financial Services, because it needs to serve people in remote areas, it is necessary to know the definition of clever service in order to know how the legal position of Third Parties in managing smart services still unclear, especially the legal status of the Third Party as a liaison between the bank and the customer. The purpose of the study is to examine and analyze the legal standing of third parties in financial services without offices. This research is a normative legal research that examines the principles, legal concepts and legislation related to the legal position of third parties in the provision of financial services without offices. The conclusion of this study is that Officeless Financial Services is an activity of providing banking services and/or other financial services carried out not through office networks and legal relations of the parties based on cooperation agreements and internal circulars. The legal position of third parties is as a bank liaison with customers (agents) and an extension of the bank (partner), where in each implementation there are rights and obligations that must be fulfilled in order to achieve the implementation of salable services.

Abstract

Tujuan penelitian ini adalah untuk mengidentifikasi dan mengevaluasi berbagai bentuk kebijakan pemerintah daerah serta mengevaluasi kondisi eksisting berbagai  program TJSP di DIY dan Provinsi Jawa Tengah yang telah dilaksanakan. Untuk menjawab tujuan tersebut, maka metode yang digunakan adalah Pada tahun pertama, penelitian ini dilakukan dengan metode penelitian yuridis normatif dengan pendekatan perundang undangan (statute approach) (Marzuki, 2005: 137-139); dan penelitian yuridis empiris (sosiologis). yaitu mengkaji dan mengevaluasiberbagai bentuk kebijakan daerah serta program pelaksanaan TJSP di Daerah Istimewa Yogyakarta dan Provinsi Jawa Tengah. Berdasarkan hasil dan pembahasan dapat disimpulkan bahwa: Pertama, Kebijakan TJSP oleh pemerintah daerah terutama di DIY dan Jatenag secara umum masih sangat lemah,  dimana untuk DIY dalam bentuk Peraturan Gubernur sedangkan Jawa Tengah menggunakan Surat Keputusan Gubernur.  Kedua, untuk Program TJSP yang dilakukan oleh perusahaan selama ini belum mengetahui kalau pemerintah telah mengeluarkan kebijakan TJSP. Sehingga perusahaan dalam melakukan TJSP selama ini hanya sebatas inisiatif sendiri dan walapun secara tidak langsung sudah bekerjasama dengan pemerintah dalam melaksanakan TJSP. Perusahaan secara umum akan mendukung kebijakan Daerah mengenai TJSP dalam bentuk Perda. Namun ketentuannya harus mempertimbangkan kepentingan situasi dan kondisi yang dihadapai perusahaan.

Abstract

Despite a peace agreement being legally enforceable and officially recognized and accepted by both parties, the debtor may choose not to proceed with it. If the debtor fails to meet their obligations, the creditor has the right to demand that the peace agreement be terminated and declare the debtor insolvent. When petitioning for the termination of this peace agreement, the judge will naturally consider the provided information as well as the relevant bankruptcy and PKPU laws, notably Law Number 37 of 2004. This research utilizes a normative juridical approach, which includes analytical and descriptive aspects. The research aims to scrutinize and analyze the legal factors considered by the Commercial Court judges at the Semarang District Court during the invalidation of the peace agreement 23/Pdt.Sus-Pkpu/2018/Pn. Smg, as well as the ratification of peace agreement number 24/Pdt.Sus-PKPU/2018/Pn. Smg, as indicated in Decision Number 20/Pdt.Sus-Pailit/2019/Pn. Smg and Jo. Number 23/Pdt.Sus-Pkpu/2018/Pn. Smg. The research findings indicate that the Case Examining Panel of Judges invalidated the approved peace agreement due to evidence of the debtor's violation of contract or negligence. This led to the declaration of the debtor's insolvency and the termination of the corresponding peace agreement.
