Abstract

Abstract This study aims to analyze the application of morality to legal practice in Indonesia. This is because the reality of the rule of law today is dominated by a positivist-legalistic phenomenon that prioritizes text but darkens morality's meaning in law. Morality in law seems to be immersed in legal practice that deifies the textual law but neglects the law's moral essence. This research is juridical-normative research oriented towards coherence between the principles of law based on morality and legal norms and legal practice in society. This research's novelty is the development of morality in the rule of law practice by prioritizing two aspects, namely the integrative mechanism aspect of Harry C. Bredemeier with the progressive law of Satjipto Rahardjo. This study emphasizes that efforts to develop law must not forget the elements of morality development. This study's conclusions highlight that the development of law and morality will run optimally by upholding the law as an integrative mechanism and applying progressive law as a solution in facing the lethargy of the Indonesian nation.Keywords: integrative mechanism; morality; progressive lawAbstrak Penelitian ini bertujuan untuk menganalisis penerapan moralitas pada praktik berhukum di Indonesia. Hal ini dikarenakan bahwa realitas praktik berhukum saat ini didominasi oleh fenomena positivistik-legalistik yang mengutamakan teks tetapi menggelapkan makna moralitas dalam berhukum. Aspek moralitas dalam hukum seakan tenggelam dalam praktik hukum yang mendewakan tekstual undang-undang tetapi melalaikan esensi moral dalam undang-undang. Penelitian ini merupakan penelitian yuridis-normatif yang berorientasi pada koherensi antara asas-asas hukum yang bersumber pada moralitas dengan norma hukum serta praktik hukum di masyarakat. Kebaruan dari penelitian ini yaitu pembangunan moralitas dalam praktik negara hukum dengan mengedepankan dua aspek, yaitu aspek integrative mechanism dari Harry C. Bredemeier dengan hukum progresif dari Satjipto Rahardjo. Hasil dari penelitian ini menegaskan bahwa upaya membangun hukum tidak boleh melupakan aspek pembangunan moralitas. Simpulan dalam penelitian ini menegaskan bahwa, pembangunan hukum dan moralitas akan berjalan secara optimal dengan meneguhkan hukum sebagai integrative mechanism serta menerapkan hukum progresif sebagai solusi dalam menghadapi jagat kelesuan berhukum bangsa Indonesia.

Abstract

The current problem of refugees cannot be handled with policies that address the root of the problem. The increasing number of refugees in the Southeast Asian region makes transit countries overwhelmed in dealing with this problem. On the other hand, as a refugee recipient country in the last ten years, Australia has had a strict policy in accepting refugees. Australia's approach to return refugee ships to a transit country is a controversial policy because Australia itself is a country that signed the 1951 convention on refugee status. On the other hand, the existence of refugees and asylum seekers has a significant impact on the local community's social changes, and the current refugee policy arrangement is still in the hands of UNHCR ( United Nations High Commissioner for Refugees) under the auspices of the United Nations. There has been no concrete communication to touch the root of the problem of refugees and asylum seekers. Through an enthusiastic approach and communication with community-based management between ASEAN countries and Australia, it is hoped that it can resolve human rights issues related to supervision to empower refugees in society to become citizens of a third country, in this case, Australia.

Abstract

Legal issues related to refugees in Southeast Asia are influenced by the lack of regulations related to refugees in countries in Southeast Asia. This is related to the increasing number of refugees in Southeast Asia who are accepted by a country only based on humanitarian reasons. This study aims to examine the legal aspects related to the problem of refugees with the principle of non-refoulement related to refugees in Southeast Asia. This research is a normative legal research with a conceptual approach and legislation. The results of the study confirm that one of the legal aspects related to refugees in Southeast Asia is to strengthen regulations in each country in Southeast Asia. This includes also confirming the existence of the principle of non-refoulement by ratifying and becoming a party to the 1951 Convention and 1967 Protocol as an effort to provide legal certainty in implementing legal policies related to refugees. In addition, the role of the ASEAN Intergovernmental Commission on Human Rights (AICHR) plays an important role in providing welfare and protection for refugees from violence and discrimination. This is mainly by optimizing the involvement of ASEAN countries in providing direct assistance with the distribution of food, clothing and a decent living regardless of matters relating to citizenship. This is intended so that ASEAN countries' acceptance of refugees for humanitarian reasons is also limited and guided by legal products that guarantee legal certainty as well as the implementation of the principle of non-refoulement.
