Abstract

Sigi is a region which has an area of 5.196 , with a population of 229.474 inhabitants. Sigi location of the region is not too far to the capital of Central Sulawesi province, the city of Palu, from year to year growth of people needing somewhere to stay home. Housing developments in Sigi is growing as well. The impact, the development of residential areas in Sigi reduces existing agricultural lands. With the limited land in this area tends to be increased conversion resulting from agricultural land to non-agricultural rapidly and progressively. Agricultural land have been converted to other uses outside the agricultural sector will be very little chance to turn back to agriculture.The problems examined in this study aims to determinehow the implementation of the conversion of agricultural land into housing in Sigi.The results of this study indicate that agricultural land conversion to non agriculture has frequently occurred in the village of Pombewe, Sigi. Some agricultural land in the village Pombewe much in alihfungsikan into housing, but land is not included in the sustainable food agricultural land, due to be sustainable food agricultural land as well as the requirements and criteria to be set by the Regent.

Abstract

The focus of this research is the Responsibility of Complementary Allies in the Commanditaire Vennootschap (CV) Business Entity. This study aims to determine the responsibilities of complementary allies if the Commanditaire Vennootschap (CV) goes bankrupt, and to find out the responsibilities of complementary allies in the agreement made if the Commanditaire Vennootschap (CV) fails. This study uses a normative juridical research method using a statutory approach and a conceptual approach using primary and secondary legal materials related to the research focus, then it is analyzed qualitatively descriptively. The result of this research is that if the CV is declared bankrupt, all of CV's assets are collateral for the settlement of CV's debt. Personal assets of complementary partners can be accounted for to pay off all debts of the CV. If the CV is in default, the one who must be responsible is complementary allies. This responsibility is in the form of compensation to creditors as a consequence of default by CV to private assets of limited partnership because the CV is not a legal entity that has separate characteristics of its assets from its management.

Abstract

This research investigates the revitalisation of land rights after natural disasters. Using empirical juridical methods, the study concludes that the revitalisation of land rights in Central Sulawesi, carried out by the provincial government in collaboration with the Ministry of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (Ministry of ATR/BPN) and led by the Head of BPN Central Sulawesi, involves the procurement of land through the use of abandoned land to relocate communities affected by disasters for the public interest. This land procurement is aimed at constructing permanent housing for disaster victims. Although BPN Palu City still recognises the land rights of areas affected by the disaster, these lands can no longer be used as they are located in disaster-prone zones (DPZ). Recipients of permanent housing will receive new certificates for plots of land that have been adjusted to the latest spatial design.

Abstract

The rise of copyright infringement that occurred in Indonesia is very alarming, even the act of infringement seems to have been regarded as a common thing. DJKI is a government agency that organizes the formulation and implementation of policies in the field of intellectual property in accordance with the provisions of legislation, of course expected to provide copyright protection in Indonesia. The research method used is Normative Empirical, using a statutory approach that is analyzed qualitatively. DJKI has a role as a regulator, as an administrator, law enforcement, and dissemination of intellectual property, as well as the authority to receive and handle complaints of intellectual property violations in accordance with applicable procedures up to the stage of the prosecution process. It is recorded that the number of complaints submitted to the DJKI from 2019 to 2022 is 155 complaints and all of these complaints have been resolved by the DJKI, one of the complaints is copyright infringement that occurred in Central Sulawesi is a case of copyright infringement of Hasan Bahasyuan’s song, this complaint has also been resolved by the DJKI through a mediation process so that the case does not proceed to court. So it can be seen that DJKI has an important role in copyright protection in Indonesia.
