Abstract

Acceleration of land registration is accommodated through Law No. 11 of 2020 concerning Job Creation, the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency issued derivative regulations, namely the Regulation of the Minister of ATR/Head of BPN No. 1 of 2021 concerning Electronic Certificates. The problem of land registration in Banyuwangi is that there are 93,599 unregistered land plots, visiting Rogojampi Village, Rogojampi District, Banyuwangi Regency, the local community said that land registration was said to be too difficult and electronic registration did not provide a sense of security or certainty for the community. So in this case the author will discuss the Implementation of law and the benefits of electronic land registration for the first time faced by the Rogojampi village community. The study chose to resolve the legal issues in this paper using a normative research method, carried out through a legislative approach and a conceptual approach. Certificates as proof of ownership of land rights electronically through 2 authentication factors and encryption methods, a collection of certificates are stored in the database as a history to ensure that what was issued is correct.

Abstract

This research focuses on the issue of providing allowances to internship students, analyzed through the framework of labor law regulations and John Rawls theory of justice. Undergraduate student internships are crucial for national growth because they can foster creativity and human resource potential. To improve competence and competitiveness, internship programs serve as a strategic link between institutions, students, and education. However, internship practices in Indonesia were often abused through unpaid internships or by providing very low allowances, which led to unfair treatment of interns. The Indonesian legal framework regulates internships through Law Number 13 of 2003 and examines Law Number 20 of 2003 concerning the National Education System (Sisdiknas), which serves as the main reference in Permendikbudristek Number 63 of 2024 concerning the Implementation of Student Internships. This study uses a normative juridical approach with a qualitative analysis of relevant regulations, in which Rawl’s theory of justice serves as a normative evaluative tool in assessing the implementation of the regulations. The results show that although the legal framework is relatively clear, its implementation does not fully reflect Rawls's principles of equal opportunity and the difference principle. Unpaid internships exacerbate inequality and place a disproportionate burden on economically vulnerable groups. Penelitian ini memfokuskan pembahasan pada pemberian uang saku kepada mahasiswa berdasarkan aturan ketenagakerjaan dan teori keadilan John Rawls. Mahasiswa magang sangat penting bagi pertumbuhan negara untuk meningkatkan kompetensi dan daya saing, program magang memiliki fungsi sebagai penghubung strategis antara institusi, mahasiswa, dan pendidikan. Namun, praktik magang di Indonesia sering disalahgunakan dengan tidak dibayarnya atau dengan memberikan uang saku yang sangat rendah yang menyebabkan perlakuan tidak adil terhadap peserta magang. Kerangka hukum Indonesia telah mengatur magang melalui UU Nomor 13 Tahun 2003 serta mengkaji Undang-Undang Nomor 20 Tahun 2003 tentang Sistem Pendidikan Nasional (Sisdiknas) yang menjadi rujukan utama dalam Permendikbudristek Nomor 63 Tahun 2024 tentang Penyelenggaraan Magang Mahasiswa. Penelitian ini menggunakan pendekatan yuridis normatif dengan analisis kualitatif di mana teori Rawls berfungsi sebagai alat evaluasi normatif dalam implementasi regulasi. Hasil penelitian menunjukkan bahwa meskipun kerangka hukum relatif jelas, implementasinya belum sepenuhnya mencerminkan prinsip-prinsip Rawls tentang kesempatan yang sama dan prinsip perbedaan. Magang yang tidak dibayar memperburuk ketimpangan dan memberikan beban yang tidak proporsional pada kelompok rentan secara ekonomi

Abstract

Perlindungan terhadap pekerja perempuan pasca cuti melahirkan di Indonesia masih berhenti pada tataran formal, hukum positif menjamin hak cuti dan melarang PHK karena alasan reproduktif, namun tidak mengatur hak pemulihan jabatan (right to return) sehingga membuka ruang demosi, rotasi nonpromotif, dan hilangnya kesempatan promosi. Penelitian hukum normatif-preskriptif ini menelaah bentuk perlindungan yang berlaku dan menguji penerapan asas perlindungan hukum serta asas non-diskriminasi untuk mencegah diskriminasi jabatan pada perempuan pasca cuti melahirkan. Pendekatan yang digunakan meliputi perundang-undangan, kasus PHI Ternate No. 7/Pdt.Sus-PHI/2019 serta Putusan MA No. 228 K/Pdt.Sus-PHI/2020, perbandingan ILO Convention No. 111 Tahun 1958 dan FMLA 1993, serta konseptual, analisis dilakukan secara deduktif dengan penafsiran sistematis-teleologis. Temuan menunjukkan perlindungan yang ada belum menjamin keberlanjutan jabatan. Secara teleologis, larangan PHK dalam Pasal 153 UU No. 13/2003 jo. UU No. 6/2023 semestinya juga mencakup larangan degradasi posisi akibat fungsi reproduksi. Secara preskriptif, penelitian merekomendasikan penambahan norma eksplisit tentang job-protected leave/right to return melalui Peraturan Menteri Ketenagakerjaan, serta pengembangan doktrin prohibition of positional degradation agar pemulihan jabatan menjadi remedi utama dan tercapai keadilan substantif berperspektif gender.
