Abstract

Becoming one of the materials inside the fifth amendment of Undang-Undang Dasar Negara Republik Indonesia 1945 (The 1945 Constitution of Republic Indonesia), Constitutional Court authority now has become one of the essential concerns given that the function as "the guardian of the constitution" it became crucial in the protection of the constitutional rights of citizens. Along with times, violations of citizens constitutional rights are no longer based solely on legal norms, but violations committed against the application of norms by state institutions or public bureaucratic institutions (Constitutional Complaint). In addition, the need for institutions that deal with constitutional questions over the existence of a legal norms whose constitutionality is doubtful (Constitutional Question) as well as the authority of the Judicial Review carried out by institutions holding judicial power, called the Supreme Court and the Constitutional Court, led to a dualism of Judicial Review which turned out to be vulnerable to presenting legal issues. The methodology used in this study is normative juridical with a qualitative approach and using literatures. From the results of this study it was concluded that the need for additional of Constitutional Complaint and Constitutional Question authority as the authority of the Constitutional Court as well as a one-stop Judicial Review system in the Constitutional Court became very important carrying out its function as a guardian of the Constitution.Menjadi salah satu materi dalam Amandemen kelima Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, kewenangan Mahkamah Konstitusi kini menjadi salah satu perhatian penting karena mengingat fungsinya sebagai the guardian of the constitusion menjadi krusial dalam perlindungan terhadap hak-hak konstitusional warga negara. Seiring dengan perkembangan zaman, pelanggaran hak-hak konstitusional warga negara tidak lagi hanya berdasarkan pada norma hukum, namun pelanggaran yang dilakukan atas penerapan suatu norma oleh lembaga negara atau lembaga birokrasi publik (Constitutional Complaint). Selain itu, perlunya lembaga yang menangani pertanyaan-pertanyaan konstitusional atas keberadaan suatu norma hukum yang diragukan konstitusionalitasnya (Constitutional Question) serta kewenangan Judicial Review yang dijalankan oleh lembaga pemegang kekuasaan kehakiman, yaitu Mahkamah Agung dan Mahkamah Konstitusi menimbulkan dualisme Judicial Review yang ternyata rentan menghadirkan persoalan hukum. Metodologi yang digunakan dalam penelitian ini berupa yuridis normatif dengan pendekatan kualitatif dan menggunakan bahan kepustakaan. Dari hasil penelitian ini disimpulkan bahwa perlunya penambahan kewenangan Constitutional Complaint dan Constitutional Question sebagai kewenangan Mahkamah Konstitusi serta sistem satu atap Judicial Review di Mahkamah Konstitusi menjadi sangat penting sebagai bentuk pelaksanaan fungsinya sebagai pengawal Konstitusi.

Abstract

AI offers convenience to human life. The trend of using AI-based scientific work has caused polemics for educational institutions because it has the potential to increase cheating, injustice, plagiarism and even reduce analytical skills which have an impact on academic integrity. Meanwhile, the main value in learning in higher education is instilling academic integrity to form ethical principles, values and manners in students. students in a social environment. The research method used is empirical juridical by conducting research on applicable legal provisions and implemented in practice, in this case the research was carried out on the provisions governing Artificial Intelligence (AI) and its application in the world of education. This qualitative research uses secondary data to study the adaptation of AI use in higher education, especially in the social sciences and humanities fields. The development of guidelines and regulations in the implementation of AI can minimize ethical issues in higher education. The results of this research show that the application of AI in the world of education needs to be regulated in a regulation so that its application does not overlap and remains in line with the aim of making education easier. Abstract

This research is conducted to express the urgency for the Government of Indonesia to adopt a regulation concerning the protection of palm oil smallholders. Such adoption is necessary since the partnership agreement between this minor group with the non-plantation enterprise is ineffective due to the conflicting interests between the Minister of Agriculture and the Minister of Industry. To achieve this purpose, this article is written based on doctrinal research by gathering rules under the MSMEs Law, the Competition Law, the Capital Investment Law, the Job Creation Law, and the SCM Agreement. This article is also supported by the justice fairness theory by Rawls. The first discussion of this article discusses the urgency to adopt this government regulation based on the MSMEs Law and the Competition Law which is to enforce the partnership agreement. Furthermore, the second discussion analyzes the Capital Investment Law and the Job Creation Law so that this aspired law shall balance the rights and obligations of the smallholders and the non-plantation enterprise. Last but not least, the third discussion discusses what to anticipate according to the WTO rules on subsidies. In the aftermath, this article suggested next research discussing the distribution of authorities between the MOA and the MOI.

Abstract

This research aims to provide a solution for the Indonesian Crude Palm Oil Smallholders so that they can play on the same level playing field and may acquire international market access. Such urgency exists since a conflict of interest exists between the Indonesian Ministry of Industry and the Ministry of Agriculture in efforts to regulate the KBLI 10431 sector regarding the CPO palm oil industry. In aiming for this purpose, this research is implementing the normative method through the implementation of Indonesian regulations related to industries, agriculture, and trades. This method is also implemented by applying the rules of international trade law. The article herein consists of two discussions involving Indonesia's domestic regulations and Indonesia's compliance with the World Trade Organization. The first discussion explains Indonesia’s necessity to adopt regulations that accommodate the interests of the ministries of industry, agriculture, and trade.  The second discussion explains Indonesia's urgency to adopt the government regulation therein due to the urgency in responding to unilateral environmental acts imposed by developed countries. From these discussions, this article recommends that the Indonesian government adopt a government regulation that may reconcile the conflicting interests within its executive branches. The article herein also stresses the urgency of adopting such a regulation to minimize Indonesia's climate litigation in the WTO Dispute Settlement Body.
