Abstract

This article explores the conflict between Land Management Rights (HPL) and Customary Rights and analyzes its implications in the context of Government Regulation (PP) 18/2021 in Indonesia. The analytical focus encompasses the origins of the conflict, its details within the legal framework, and the identification of root issues that trigger field tensions. The research methodology involves legal document analysis, case studies, and interviews with relevant stakeholders. The study also evaluates the impact of the implementation of PP 18/2021 on the conflict and its implications in legal, social, and environmental dimensions. The research findings provide crucial insights for policymakers, stakeholders, and the community, supporting the understanding of the HPL and Customary Rights conflict and seeking sustainable solutions. Critical analysis underscores the necessity for a review of existing regulations to accommodate the traditional rights of local communities, preserve environmental sustainability, and reduce the potential for conflict within a more inclusive legal framework.

Abstract

Studi ini bertujuan meneliti penyelesaian perselisihan yang disediakan dalam sistem hukum Indonesia dan peran pemerintah dalam menyelesaikan sengketa perbatasan. studi ini mengunakan yuridis-empiris. Studi ini menyimpulkan bahwa; Pertama, sengketa tanah batas wilayah desa Sendi telah dipicu oleh krn agresi militer belanda, yg menyebabkan warga sendi meninggalkan wilayah sendi untuk mengungsi. Karena terjadi kekosongan tersebut, perhutan mengklaim itu miliknya. Dgn pembuktian jual beli uang golden dgn kepala desa yg dulu. Sekitar th 1998, warga keturunan sendi, menghendaki kembalinya desa Sendi. Kedua, paradigma penyelesaian sengketa batas umumnya melalui dua cara; resolusi sengketa perbatasan non-hukum, dan penyelesaian hukum. Dalam resolusi non-hukum, ini dimediasi oleh Kemendagri dan Pemerintah; sementara, dalam penyelesaian sengketa hukum itu dicapai melalui peninjauan kembali ke Mahkamah Agung atau Mahkamah Konstitusi. Ketiga, dalam sengketa batas wilayah, peran kasus sengketa adalah pemerintah. Hasil studi menunjukkan bahwa desa adat menjadi salah satu solusi untuk dapat mengakhiri sengketa desa Sendi antara penduduk Desa dengan Perhutani

Abstract

In the realm of education, the significance of teaching and learning is paramount, with teachers assuming a pivotal role in shaping successful educational outcomes. Learning, viewed as an ongoing lifelong process, is characterized by purposeful endeavors to cultivate individual potential and foster responsible citizenship. Civic education, marked by an emphasis on comprehensive comprehension and skill development, encounters persistent challenges such as the limitations of conventional lecture-based methods that impede effective learning. In response, this study developed a specialized learning module concentrating on two-variable linear equations, employing the ADDIE model. Employing a quantitative experimental research approach, data collection involved comprehensive methods including questionnaires, observations, interviews, and meticulous statistical analysis. The validation process underscored the module's pronounced practicality and engagement, further affirming its viability for implementation. The study's findings, presented earlier, deduced that the integration of the discovery learning model aided by the "bilik" cultural diversity image media significantly influences the learning outcomes of fourth-grade students studying civic education at SD Muhammadiyah 2 Waru. Notably, pretest results averaged at 68.25, while posttest scores displayed an average of 94.7. The t-test calculations confirmed a disparity in the averages, with pretest and posttest increments of 71.17 and 96.7, respectively. These outcomes substantiate the model's efficacy in elevating posttest scores beyond pretest levels, emphasizing its impact on learning outcomes. Consequently, this research offers valuable insights into advancing the effectiveness of civic education through innovative pedagogical strategies.
