Abstract

Undang-Undang Perlindungan Anak, khususnya Undang-Undang Nomor 23 Tahun 2002, menjelaskan bahwasannya meskipun telah terjadinya perceraian atau keadaan lain yang berujung pada perpisahan, komunikasi antaranak dan kedua orang tuanya tetap harus tetap terjaga. Undang-undang memastikan bahwa anak mempunyai hak untuk sering bertemu dan menjaga kontak pribadi dengan kedua orangtuanya. Namun demikian, keadaan yang ada di masyarakat dan tidak adanya ketentuan peraturan yang melihatkan bahwasannya anak seringkali mengalami kesulitan untuk bersatu kembali dengan orang tuanya yang telah diberikan hak asuh dikarenakan tidak adanya pengaturan-pengaturan hukum yang inkra mengenai putusan perceraian. Penelitian ini mencakup rumusan masalah mengenai “Bagaimana pelaksanaan putusan pengadilan agama tentang penyelesaian sengketa hak asuh anak akibat perceraian”. Kajian hukum ini menggunakan strategi yang memadukan antara peraturan-peraturan perundang-undangannya dengan pendekatan-pendekatan konseptual. Penjelasan mengenai perlindungan anak sebagaimana tertuang didalam Undang-Undang Perlindungan Anak serta peraturan-peraturan perundang-undangan lainnya yang membahas tentang perlindungan anak jika terjadi permasalahan yang terjadi di rumah tangga antara orang tuanya. Hal ini juga berlaku pada situasi di mana proses hukum terkait permasalahan rumah tangga orang tua sampai saat ini berlangsung dikarenakan tidak mencapainya penyelesaian akhir. Peneliti mengusulkan perubahan terhadap UU Peradilan Agama, khususnya menganjurkan agar dimasukkannya ketentuan hukum yang mengamanatkan pemindahan segera anak kepada orang tua yang mempunyai hak asuh setelah ada putusan pengadilan. Alternatifnya, peneliti menyarankan pembentukan Peraturan Mahkamah Agung sebagai kerangka hukum untuk melaksanakan transfer tersebut. Kata Kunci: Penyelesaian Sengketa, Putusan, Hak Asuh Anak

Abstract

This study aims to determine the influence of the Think Pair Share (TPS) cooperative learning model on the mathematical communication skills of elementary school students. This study uses a quasi-experimental method and a pretest-posttest group design.  The population of this study is all students at SDN Gudang Kopi Sumedang, while the sample of this study is 31 students taken by cluster random sampling technique. Data is collected through written tests and observations during the learning process. The data produced was analyzed in a qualitative descriptive manner. The results showed that students' mathematical communication skills improved after learning with the TPS model. The average pretest score was 54.8, which increased to 80.3 in the posttest, with a gain value of 0.67, categorized as moderate. Observations also indicated that students were more active when working individually, discussing with a partner, and sharing discussion results in front of the class. In conclusion, the TPS learning model was proven effective in enhancing students' mathematical communication skills. This model can be an option for teachers to create interactive learning and actively engage students, particularly in mathematics learning at the elementary school level.
