Abstract

ABSTRACT . This study aims to find out and describe the implementation of cooperation between service users and wedding organizers during the Covid-19 period in Bengkulu City. The type of this research is empirical legal research, using qualitative research methods. The results of the study that: (1). The implementation of cooperation between service users and wedding organizers during the Covid-19 period in Bengkulu City had fulfilled the elements of force majeure and the Covid-19 pandemic could be qualified as a force majeure, because when the pandemic hit, the Indonesian Government had declared the Covid-19 pandemic a non-national disaster. natural disasters with the issuance of Presidential Decree Number 12 of 2020 concerning Stipulation of Non-Natural Disasters for the Spread of Coronavirus Disease 2019. Marriage permits in Bengkulu City must comply with health protocols and must have recommendations from the Covid-19 Task Force and fulfill the conditions that have been determined, if these conditions are violated then the Bengkulu City Covid-19 Task Force team will not issue a permit even if it continues it will be disbanded. And if the permit has been issued, it must be postponed due to the emergence of the spread of Covid-19. Therefore, directly making the Focus Wedding Organizer no longer considered a default, but only classified as force majeure. Where the delay in implementing the agreement made the Focus Wedding Organizer and the service user settle each other. (2) Settlement of disputes on service user agreements with Wedding Organizers with AA and NE due to the Covid-19 situation. Done by deliberation and consensus where the aggrieved party finally asks for compensation costs which in this case the amount to be paid each month is IDR 1,645,000 (one million six hundred and forty five thousand rupiah) which is divided into 5 months. Installment payments will be made every 20th starting from November and 2020 ending in April 2021. Keywords: Agreement, Settlement, Breach of Contract.

Abstract

Sewa menyewa kapal merupakan suatu bentuk perjanjian yang dilakukan nelayan tradisional dalam memenuhi kebutuhan sarana prasarana penangkapan ikan. Penelitian ini bertujuan untuk mengkaji latar belakang perjanjian sewa menyewa kapal penangkap ikan oleh nelayan tradisional dan pemilik/jurgan penyedia kapal dalam perpektif sosiologi hukum. Perjanjian sewa menyewa secara umum merupakan kegiatan ekonomi. Tetapi dalam hal obyeknya kapal penangkap ikan oleh nelayan, tidak hanya persoalan ekonomi. Oleh karena itu penelitian ini berupaya mengkaji persoalan apa yang melatarbelakangi perjanjian sewa menyewa kapal penangkap ikan oleh nelayan tradisional dan pemilik kapal. Penelitian hukum non doktrinal ini pendekatan socio-legal research, dengan lokasi penelitian di wilayah pesisir Kota Bengkulu. Hasil penelitian menunjukkan bahwa perjanjian sewa menyewa kapal dilakukan secara lisan (tidak tertulis) dalam masyarakat nelayan tradisional. Hubungan sewa menyewa antara nelayan tradisional dengan juragan pemilik kapal pada dasarnya tidak hanya dilatarbelakangi oleh persoalan ekonomi, tetapi juga aspek sosial dalam masyarakat pesisir. Budaya kebersamaan dan hubungan patron-klien sangat mempengaruhi perjanjian sewa menyewa kapal antara nelayan tradisional dengan nelayan juragan pemilik kapal. Abstract

This study aims to find out and analyze legal protection and certainty over the rights of parties for creditors in Fiduciary guarantees after the Constitutional Court Decision Number 2/PUU-XIX/2021, as well as the process of executing Fiduciary collateral objects by creditors in post-Fiduciary guarantees. Issuance of Constitutional Court Decision Number 2/PUU-XIX/2021. The research method was carried out in a normative juridical manner. The data used is secondary data obtained using a literature study. It is hoped that the research results can serve as input for decision-makers and the public in general related to legal issues in the execution of fiduciary guarantee objects after the issuance of the Ruling of the Constitutional Court of the Republic of Indonesia Number 2/PUU-XIX/20 Based on the results of the research, it can be concluded (1) Legal protection and legal certainty for the rights of Creditors (Fiduciary Recipients) after the issuance of the Constitutional Court Decision Number 2/PUU-XIX/2021, June 8, 2021, has undergone changes that lead to a potential for less guaranteed protection law and legal certainty of the rights of creditors (Fiduciary Beneficiaries) in exercising their rights to execute collateral Objects. (2) The process of executing Fiduciary collateral objects after the issuance of the Constitutional Court Decision Number 2/PUU-XIX/2021, June 8, 2021, can be carried out in 2 (two) ways, namely by submitting an application to the District Court and by parate executie as long as it has been there is an agreement regarding default/default since the guarantee agreement was made.
