Abstract

Undang Undang Dasar Negara Republik Indonesia 1945 Pasal 28J ayat (2)menentukan bahwa pembatasan hak setiap orang ditetapkan dengan undangundang. Komisi Pemilihan Umum sebagai lembaga pelaksana pemilihan umum menetapkan Peraturan Komisi Pemilihan Umum Nomor 14 Tahun 2018 dan Peraturan Komisi Pemilihan Umum Nomor 20 Tahun 2018 yang mengaturlarangan bagi mantan terpidana korupsi menjadi calon anggota legislatif. Adanyanorma larangan tersebut juga menimbulkan ketidaksesuaian dengan Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Oleh karena itu,penelitian ini berusaha menjawab pokok permasalahan tentang bagaimanapembatasan hak politik mantan terpidana korupsi menjadi calon anggota legislatif dalam peraturan perundang-undangan di Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis normatif dengan metode analisis kualitatif-deskriptif. Hasil penelitian ini adalah pembatasan hak politik mantan terpidana korupsi menjadi calon anggota legislatif diatur dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum, Peraturan Komisi Pemilihan Umum Nomor 30 Tahun 2018 dan Peraturan Komisi Pemilihan Umum Nomor 31 Tahun 2018 yang mengatur bahwa mantan terpidana korupsi boleh menjadi calon anggota legislatif dengan syarat harus bersedia secara terbuka dan jujur mengemukakan kepada publik bahwa yang bersangkutan merupakan mantan terpidana korupsi. Penelitian ini merekomendasika kepada Komisi Pemilihan Umum dalam menetapkan peraturan supaya memperhatikan asas kesesuaian antara jenis, hierarki, dan materi muatan peraturan perundang-undangan lainnya.

Abstract

The power relations between state institutions can be influenced by the state institutions that propose them, such as the appointment of United States judges who have ideological tendencies that are identical to the president. This study attempts to determine the ideology of constitutional judges and the political ideology of the President of the Republic of Indonesia through an analysis of the considerations of decisions and political parties. Is there a relationship between the political ideology of the president and constitutional judges in the consideration of decisions in judicial review cases? The design of this research is library research with a conceptual, legislative, and case study approach. Qualitative data analysis in the form of copies of Constitutional Court decisions supported by a study of related theoretical literature. The results of the study indicate that the ideology of constitutional judges seen from the considerations of their decisions is mostly moderate, although some considerations tend to be secular and Islamic. The political ideology of the president based on the ideology of the political parties supporting President Megawati and President Jokowi tends to be secular, while President Yudhoyono is nationalist-religious. The ideological relationship of constitutional judges proposed by the president is identical to the political ideology of President Megawati. Meanwhile, during the era of President Yudhoyono and President Jokowi, the ideology of constitutional judges in the consideration of their decisions was not identical to the ideology of the president's political party. This shows the independence of judges from the influence of the current political ruling ideology.

Abstract

The number of women's representation in seats in the Tulungagung Regency Regional People's Representative Council so far is still low, only 12% in the 2019 Election and 14% in the 2024 Election, while the percentage of female legislative candidates elected in the 2024 DPR RI Election reached 22.06%. Therefore, efforts need to be made to increase the number of women's representation in the Tulungagung DPRD by looking at the political preferences of voters in Tulungagung. This research aims to determine voters' political preferences for female legislative candidates in Tulungagung Regency and their relevance to election results. This research is mixed quantitative-qualitative research, with quantitative data analysis techniques followed by qualitative data analysis. Data collection through questionnaires and documentation. The results of the research found voters' political preferences for female legislative candidates in Tulungagung, considering that female legislative candidates are trusted to channel the aspirations of women and children, organizational abilities, reciprocity, high level of education, age maturity, similarity of political parties, and candidate popularity. There is a congruence in political preferences for the majority of female legislative candidates elected in Tulungagung in the 2019 and 2024 elections.
