Abstract

Eksistensi kepala otorita yang merepresentasikan kepala daerah di ibu kota negara yang tertuang dalam Undang-Undang Republik Indonesia Nomor 3 Tahun 2022 tentang Ibu Kota Negara (UU No. 3 Tahun 2022) memunculkan problematika hukum yang baru. Proses penunjukan, pengangkatan, dan pemberhentian kepala otorita yang dilakukan langsung oleh Presiden bertentangan dengan Pasal 18 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Posisi kepala otorita sebagai pejabat setingkat menteri juga akan memunculkan permasalahan terkait kedudukan produk hukum yang diterbitkan. Artikel ini menggunakan metode penelitian hukum. Kesimpulannya, terdapat potensi pelanggaran konstitusional terkait eksistensi kepala otorita dalam UU No. 3 Tahun 2022.

Abstract

Proses pemilihan umum (pemilu) di Indonesia memiliki prinsip langsung, umum, bebas, rahasia, jujur, dan adil. Tetapi, dalam pemilu presiden dan wakil presiden tahun 2024, eksistensi dari prinsip tersebut perlu dipertanyakan. Hal ini disebabkan terdapat sejumlah polemik yang mewarnainya. Di antaranya, Mahkamah Konstitusi Republik Indonesia yang relatif mendiamkan pelanggaran prinsip dalam pemilu, ketidaknetralan negara, dan pengabaian rule of ethics. Artikel ini menggunakan metode penelitian hukum normatif untuk menjawab isu hukum dirumuskan. Ke depan, perlu adanya rekonstruksi terkait kinerja dari MK.

Abstract

The power relations between state institutions can be influenced by the state institutions that propose them, such as the appointment of United States judges who have ideological tendencies that are identical to the president. This study attempts to determine the ideology of constitutional judges and the political ideology of the President of the Republic of Indonesia through an analysis of the considerations of decisions and political parties. Is there a relationship between the political ideology of the president and constitutional judges in the consideration of decisions in judicial review cases? The design of this research is library research with a conceptual, legislative, and case study approach. Qualitative data analysis in the form of copies of Constitutional Court decisions supported by a study of related theoretical literature. The results of the study indicate that the ideology of constitutional judges seen from the considerations of their decisions is mostly moderate, although some considerations tend to be secular and Islamic. The political ideology of the president based on the ideology of the political parties supporting President Megawati and President Jokowi tends to be secular, while President Yudhoyono is nationalist-religious. The ideological relationship of constitutional judges proposed by the president is identical to the political ideology of President Megawati. Meanwhile, during the era of President Yudhoyono and President Jokowi, the ideology of constitutional judges in the consideration of their decisions was not identical to the ideology of the president's political party. This shows the independence of judges from the influence of the current political ruling ideology.

Abstract

Rapid global economic development has increased the intensity of cross-border transactions, which in turn demands an adaptive and comprehensive legal framework, including from the perspective of Sharia Economic Law. This study aims to analyze the application of various types of Sharia contracts in cross-border trade transactions, identify variations of operationally relevant contracts, and unravel the accompanying legal issues and challenges. This study uses a normative legal method (literature study) with a conceptual, legislative, and Sharia compliance approach. Data are sourced from journal literature, fatwas, and international standard regulations (such as AAOIFI and the United Nations Convention on Contracts for the International Sale of Goods/CISG). The results show that Sharia-compliant cross-border transactions are implemented through various instruments such as Sharia Letters of Credit (L/C), trade finance instruments, and the adoption of smart contracts, with the dominant use of Murabahah, Wakalah, Kafalah, and Sharf (foreign exchange) contracts. However, the implementation of these contracts faces crucial issues related to legal harmonization, differences in jurisdictions and legal systems across countries, the enforcement of foreign Sharia arbitration awards, and the challenge of eliminating gharar elements in global trade standards such as Incoterms. It can be concluded that harmonization of international trade instruments with the principles of Islamic jurisprudence (fiqh) is essential to provide legal certainty, protect the parties, and guarantee universal Sharia compliance.
