Abstract

This research is motivated by an explanation of marriage with the laws in Indonesia that discuss marriage agreements. According to imam shafi'i if a man marries a girl or widow by ordering a dowry of one thousand on condition that the wife may leave the husband's house whenever she wants or on condition that the husband may not take her out of his country or on condition that the husband may not mix her with another woman. If the marriage has already taken place, then the husband may do so and not fulfill the condition again, then the marriage remains valid but the condition is void. Meanwhile, the marriage agreement according to Indonesian law does not only regulate property issues and the consequences of marriage but also the rights and obligations of both parties as long as the agreement does not conflict with the limits of the law. Marriage is a permanent relationship between two people that is recognized as legitimate by the community concerned based on the applicable marriage regulations. Depending on the local culture, the form of marriage can vary and its purpose can vary as well. But generally marriage is exclusive and recognizes the concept of infidelity as a violation of marriage. This research was conducted to examine marital agreements in the perspective of Indonesian law. This research is conducted with a normative approach to analysis using primary and secondary materials presented qualitatively using the deductive method to get conclusions. The result of this study is that the juridical marriage agreement of the existence of the marriage agreement is that it does not cancel the existing marriage contract. The conclusion is that based on the descriptions described thoroughly, this research can be concluded that the marriage agreement made by the prospective husband and the prospective wife at the time or before the marriage is held which is legalized by the marriage registrar as regulated in Law number 1 of 1974 Article 29, emphasizes that the contents of the agreement must not violate the boundaries of law, religion and decency, meaning that it can be about anything.

Abstract

Lembaga keuangan perbankan di Indonesia mengalami transformasi digital yang pesat namun tingkat penerimaan Masyarakat masih tergolong rendah. Penelitian ini bertujuan untuk mengungkapkan dampak variabel religiusitas, keamanan fintech, dan citra merek terhadap keputusan nasabah untuk menyimpan uang di bank digital syariah. Penelitian ini menggunakan data primer yang diperoleh melalui penyebaran kuesioner atau angket, melibatkan 100 responden yang dipilih berdasarkan perhitungan lemeshow. Metode analisis yang digunakan adalah uji validitas, reliabilitas, uji asumsi klasik, uji regresi linier berganda dan uji hipotesis dengan menggunakan perangkat lunak SPSS 24 untuk menganalisis data penelitian. Hasil penelitian menunjukkan bahwa secara parsial variabel keamanan fintech dan citra merek memiliki pengaruh yang signifikan (Sig. <0,005) terhadap keputusan nasabah untuk menabung di bank digital syariah, sementara variabel religiusitas tidak memiliki pengaruh signifikan (Sig. >0,005) terhadap keputusan nasabah untuk menabung di bank digital syariah. Temuan ini mendorong penelitian selanjutnya untuk mengeksplorasi faktor-faktor lain yang dapat memengaruhi keputusan nasabah dalam menggunakan layanan bank digital syariah. Sehingga mampu menjadi bahan evaluasi bagi industri bank digital syariah dalam meningkatkan pangsa pasar.The banking and financial institutions in Indonesia have undergone rapid digital transformation; however, the level of public acceptance remains relatively low. This research aims to elucidate the impact of religiosity, fintech security, and brand image variables on customers' decisions to deposit money in Islamic digital banks. The study employs primary data obtained through the distribution of questionnaires, involving 100 respondents selected based on the Leveshow calculation. The analytical methods utilised include validity and reliability tests, classical assumption tests, multiple linear regression analysis, and hypothesis testing, all conducted using SPSS 24 software for data analysis. The results of the study indicate that, partially, fintech security and brand image variables exert a significant influence (Sig. <0.005) on customers' decisions to deposit money in Islamic digital banks. Meanwhile, the religiosity variable does not have a significant impact (Sig. >0.005) on customers' decisions to deposit money in Islamic digital banks. These findings propel further research to explore other factors that may influence customers' decisions to utilise Islamic digital bank services. Thus, it can serve as evaluative material for the Islamic digital banking industry to enhance market share

Abstract

Marriage is a sacred institution in Islam and the Indonesian legal system, which requires the presence of a guardian as one of its pillars. The problem arises when a daughter is born outside the bonds of a legal marriage, causing debate about the legality of the biological father to act as a marriage guardian. This study aims to examine in depth the legal status of biological fathers as marriage guardians for extra-marital daughters, focusing on a comparative analysis between the perspective of the Shafi'i Mazhab and the provisions in Indonesian positive law. This research uses a juridical-normative method with a descriptive-qualitative approach, through a literature study of classical Syafi'iyah fiqh books, Law Number 1 of 1974 concerning Marriage, the Compilation of Islamic Law, and decisions of the Constitutional Court. The results showed that according to the Syafi'i Mazhab, an extramarital child does not have a nasab relationship with his biological father, so it is not valid for him to be a marriage guardian, and guardianship is left to the judge's guardian.In Indonesian positive law, although there is recognition of the civil relationship between the child and the biological father based on Constitutional Court Decision No. 46/PUU-VIII/2010, this recognition does not include guardianship rights in marriage. The gap in this research lies in the inconsistency between the recognition of civil relationship and guardianship authority in legal practice. The findings of this research provide a normative contribution in clarifying the legal position of the guardian of extramarital children and the urgency of synchronization between Islamic law and national law in answering contemporary family problems.
