Abstract

This research is a document research that discussed and analyzed about the disparity in the minimum age limit of marriage in Article 15 of the Indonesian Islamic Law by using the theory of maṣlaḥah Sa'īd Ramaḍn al-Būṭi. This research became urgent in order to increase khazanah of science which is progressive and also opened insight into the opportunities for new thoughts, regarding the absence of rules in the disparity of minimum age limits of marriage for men and women in Islamic law. The data of this study were collected through the documentation method. After that, the reading was done on the text (text reading) and then the texts were analyzed. The result showed that the disparity in the minimum age limit of marriage in Article 15 KHI was based on consideration of the benefit of the family and household. The conclusion of the author's brief research was that the substance contained in Article 15 of the KHI concerning about the disparity in the minimum age limit of marriage for men and women included the benefits of parenting (mental, spiritual, financial and physical), social balance, and responsibility of marriage. The disparity in the minimum age limit of marriage in Article 15 of the KHI was a benefit if it was reviewed by using the theory maṣlaḥah from Sa'īd Ramaḍān al-Būṭi, because it had fulfilled five conditions, which were maslaḥah must be within the scope of the Shari'ah objectives, does not contradict to The Qur'an, does not contradict with the Sunnah, does not contradict with Qiyas, and does not contradict with the more urgent maṣlaḥah.

Abstract

Non-governmental entities often facilitate current matchmaking trends, promoting certain ideologies that may contradict the Islamic family law model introduced by the state. In response, Surakarta’s Ministry of Religious Affairs launched the "Samawa Program: Make Me Your Partner" to support matchmaking, especially amid limited mobility during the COVID-19 pandemic. This article uses a philosophical approach to examine this program’s goals, rules, and strategies and how it aligns with Jeremy Bentham’s legal utilitarianism theory. The article finds that this free of charge program provides marriage guidance practices distinct from regular marriage counseling practices at the Office of Religious Affairs. The program’s objective is for individuals to get marriage guidance as a foundation for building a family and to find a partner who meets their criteria. Considering Bentham’s seven indicators of happiness and pain levels, the program fully satisfies the intensity, duration, proximity, and fecundity benefit aspects. However, it can potentially generate harm regarding the other three elements: certainty, purity, and extent. At this stage, the program is considered highly beneficial, serving as an effective facilitation tool for individuals seeking compatible partners. It not only ensures a satisfying matchmaking experience but also provides quick, credible access to essential marital knowledge.

Abstract

The purpose of this article is to discuss about the implementation of the trial of integrated marriage validity or isbat nikah terpadu. Based on the Supreme Court Regulation (Perma) No. 1 of 2015, despite Religious Court (PA), the implementation of integrated marriage validity involved the Office of Religious Affairs (KUA). From the perspective of maqāṣid al-sharī'ah, the integrated marriage validity can be considered as an effort of Indonesian government to realize public benefits (maṣlaḥat) as the essence of maqāṣid al-sharī'ah in thefield of marriage affairs. In a broader sense, the existence of the integrated marriage validity could be considered to be able to preserve the religion (ḥifdh al-din), the soul (ḥifdh al-nafs), the intellectual faculty (ḥifdh al-’aql), the offspring (ḥifdh al-nasl), and the property (ḥifdh al-māl).Artikel ini bertujuan untuk membahas tentang pelaksanaan sidang isbat nikah terpadu. Bedasarkan Peraturan Mahkamah Agung RI No. 1 tahun 2015, pelaksanaan isbat nikah terpadu melibatkan dua institusi, yaitu Pengadilan Agama (PA) dan Kantor Urusan Agama (KUA) tempat dilaksanakannya sidang isbat nikah tersebut. Dari persepektif maqāṣid al-sharī’ah, pelaksanaan isbat nikah terpadu dapat dianggap sebagai usaha Pemerintah untuk mewujudkan kemaslahatan umum sebagai inti dari maqāṣid al-sharī’ah dalam bidang perkawinan. Dalam konteks yang lebih luas, pelaksanaan isbat nikah terpadu dapat dikategorikan sebagai usaha nyata Pemerintah dalam menjaga agama (ḥifdh al-din), jiwa (ḥifdh al-nafs), akal (ḥifdh al-’aql), keturunan (ḥifdh al-nasl), dan harta (ḥifdh al-māl).
