Abstract

This study aims to analyse the concepts of authority, hermeneutics, and beauty in the thought of Khaled Abou El Fadl and their implications for Islamic law in Indonesia. The research employs a qualitative approach with the library research method. Data is obtained from various literary sources, including books, scholarly journals, and relevant articles. The analysis is conducted using a descriptive-analytical method by describing and examining El Fadl’s thoughts and linking them to the context of Islamic law in the contemporary era. The findings indicate that the concept of authority in Islamic law should reflect ethical and moral values that prevent the monopolisation of religious understanding. El Fadl’s hermeneutics emphasise openness in interpreting sacred texts, while the concept of beauty highlights that Islamic legal rulings should embody justice and moral aesthetics. The study concludes that El Fadl’s ideas offer new insights into the development of a more contextual, humanistic, and responsive methodology of Islamic law. The concepts he proposes are relevant in constructing a more inclusive Islamic legal system that prioritises human values. Keywords:  El Fadl; authority; hermeneutics; beauty

Abstract

The purpose of this article is to discuss about the implementation of the trial of integrated marriage validity or isbat nikah terpadu. Based on the Supreme Court Regulation (Perma) No. 1 of 2015, despite Religious Court (PA), the implementation of integrated marriage validity involved the Office of Religious Affairs (KUA). From the perspective of maqāṣid al-sharī'ah, the integrated marriage validity can be considered as an effort of Indonesian government to realize public benefits (maṣlaḥat) as the essence of maqāṣid al-sharī'ah in thefield of marriage affairs. In a broader sense, the existence of the integrated marriage validity could be considered to be able to preserve the religion (ḥifdh al-din), the soul (ḥifdh al-nafs), the intellectual faculty (ḥifdh al-’aql), the offspring (ḥifdh al-nasl), and the property (ḥifdh al-māl).Artikel ini bertujuan untuk membahas tentang pelaksanaan sidang isbat nikah terpadu. Bedasarkan Peraturan Mahkamah Agung RI No. 1 tahun 2015, pelaksanaan isbat nikah terpadu melibatkan dua institusi, yaitu Pengadilan Agama (PA) dan Kantor Urusan Agama (KUA) tempat dilaksanakannya sidang isbat nikah tersebut. Dari persepektif maqāṣid al-sharī’ah, pelaksanaan isbat nikah terpadu dapat dianggap sebagai usaha Pemerintah untuk mewujudkan kemaslahatan umum sebagai inti dari maqāṣid al-sharī’ah dalam bidang perkawinan. Dalam konteks yang lebih luas, pelaksanaan isbat nikah terpadu dapat dikategorikan sebagai usaha nyata Pemerintah dalam menjaga agama (ḥifdh al-din), jiwa (ḥifdh al-nafs), akal (ḥifdh al-’aql), keturunan (ḥifdh al-nasl), dan harta (ḥifdh al-māl).

Abstract

This study examines water resource management in Indonesia following the annulment of the Water Resources Law by Constitutional Court Decision No. 85/PUU-XI/2013, which mandated that water governance prioritize the greatest prosperity of the people. Despite the subsequent enactment of Law No. 17/2019, persistent issues of corporate industrialization, exploitation, and privatization of water sources threaten citizens' fundamental right to water and ecological sustainability. The paper adopts Jasser Auda’s contemporary Maqashid al-Shariah with its system approach as an alternative analytical framework. Auda's methodology shifts the maqasid focus from classical preservation to construction, development, and the fulfillment of human rights (hifdz al-huquq al-insan), employing six interconnected features, including a hierarchical structure. The analysis explicitly places the fulfillment of the people's rights to water within Auda's General Maqasid (Maqasid al-‘Ammah). This classification underscores the urgent need for water access as a fundamental human necessity, requiring a social and public dimension of governance that transcends individual interests.
