Abstract

ABSTRACTSeeing from the prespectives of Deewes, the Prophet’s and Shahabah’s era constitute the era of developing the foundation of Islamic law. In other words, this era is considered as the genuine era of Islamic law implementation which employs the normative and rational approach to the text of Qur’an and Hadits. It can be said, then, that the phylosophy of Islamic law has been practiced since the era of the Prophet. In that era the development of Islamic law occurs in line with the cases in the community. This fact proves that there is a dialectic between the normative value of the text and social structure of the community in which the Islamic law applys. It shows that empirical experience is considered in the development of Islamic law. As the result, in the era of genuine implementation of Islamic law, the basis of Islamic law development is the texts of Quran and Hadits, rationalism of Ijma-Qiyas, and empirical approach of the sociological condition during the era of the Prophet and Shahabah.Keywords: Filsafat, History, Islamic

Abstract

The most discussed form of Islamic state system is khilafah. Therefore, this current study discusses the philosophy of khilafah from the perspectives of ontology, epistemology, and axiology. From the perspective of its ontology, it turns out that khilafah is a dynamic terminology in the history of Islamic politic. It can be traced from the history that the Islamic political system changes according to the social condition and the ruling regime. It may be called khilafah, imamah or mulk (kingdom). In other meanings, it can refer to religious theocracy, monarchy-oligarchy, or democracy in the form of nation state. Whatever the name of the Islamic state system is used, all Islamic state must be directed to achieve the maslahah. According to the scholars of the maqashid al-syariah, the maslahah is measured using the five universal standards of principles (kuliyat al-khams). They are ensuring the freedom of religion (hifdz al-din), ensuring the life (hifdz al-nafs), ensuring the creativity and freedom of thinking and speak (hifdz al-‘aql), securing the property (hifdz al-mal), and ensuring the sustainability of offspring and human dignity (hifdz al-nasl wa al-‘irdl).                Keywords: Islamic law Khilafah, Politic, Maslahah

Abstract

This article aims to discuss the enactment of Zakat ManagementLaw 23/2011. Based on the critical textual study, this study proposes an analysisshowing that the legislation of this law come out of centestation by variousinterest from different groups. Substantially, this law does not contravenethe Constitution of 1945 so that is has a very strong constitutional ground.Siyasashar’iyya is here relevant to the legislation of Islamic law, including theLaw of Zakat Management 23/2011. Therefore, this law is a real example ofthe product of the politics of Islamic law in the context of Indonesia. Artikel ini akan menjelaskan bahwa legislasi UU 23/2011 (UUPZ)merupakan suatu proses politik yang menghadirkan kontestasi kepentingan/aspirasi berbagai pihak. UU 23/2011 (UUPZ) secara umum tidak bertentangandengan UUD 1945 sehingga memiliki daya konstitusionlitas yang relatif kokoh.Teori siyâsah syar’iyyah memiliki relevansi yang kuat dengan isu legislasi dankonstitusionalitas UU 23/2011 (UUPZ). UU 23/2011 (UUPZ) merupakanproduk dari siyâsah syar’iyyah dalam konteks keindonesiaan.
