Abstract

National Shariah Arbitration Board (Basyarnas) is one of the manifestations of the first established Islamic Arbitration in Indonesia. Basyarnas stands autonomously and independently as one of the legal instruments that resolve disputes of the parties, whether coming from within the environment of Islamic banks, Takaful Insurance, or any other party who needs it. In connection with the Basyarnas function, this article discusses the following three main issues: Firstly, the view of sharia economic actors on Basyarnas. Shariah economic actors generally consider the importance of Basyarnas’s position in settling disputes in Sharia economics. In the last five years (2010-2015) the number of disputes cases in Basyarnas (23 cases) is slightly higher than cases handled by the Religious Courts (20 cases). Secondly, the reason for sharia economic actors chooses the arbitration route because the process is faster, the cost is light and the verdict is final and binding and the secrets of the parties are maintained. Thirdly, the factors that influence the choice are also determined by the level of confidence of the sharia economic actors to the judges’ ability within the Religious Courts to resolve the dispute.

Abstract

This article proves that the interpretation of the Koran is greatly influenced by the socio-political background of the interpreter which influences their interpretation and the choice of approach they use. The regional head election (Pilkada) contest in DKI Jakarta is an arena for seeking the legitimacy of each interpreter for the intent of Qs. al-Ma'idah: 51. On the other hand, a textual approach based on a linguistic approach (al-'ibrah bi' general al-lafdzi) gave birth to an exclusive interpretation in rejecting non-Muslim Regional Head candidates. Meanwhile, the basis of the socio-historical approach ('al-ibrah bi especially al-sabab) is a more inclusive religious foundation that allows non-Muslim Regional Head candidates. The choice of this approach seems to have a reciprocal correlation with the socio-political setting of the interpreter, because in fact the interpretation of awliya' in Qs. Al-Maidah: 51, is neutral. Etymologically it can be interpreted; close, friend, protector, helper, leader, alliance, ally, intimate, lover, soul mate and maybe many more. However, when scholars have a certain tendency, in the end the interpretation of awliya' is brought to the subjective meaning of the interpreter, even though the interpreter claims to have constructed an interpretation that is objective and universal in nature. This research is a field research with a hermeneutic approach. Sources of data are Muslim scholars who are experts in the field of interpretation of the Koran from various backgrounds by purposive sampling according to the expertise of the informants.

Abstract

Nâshîr al-Dîn al-Albânî is one of the most influential figure in the contemporary Salafist movement, alongside Bin Bâz and Uthaymin. This article will discuss the influence of Nasir al-Din al-Albâni on Indonesian Salafi Islamic legal thought. In the discourse of Islamic legal thought in Indonesia, some scholars explain the importance of al-Albânî's role in defending Ibn Bâz's fatwas by writing dozens of works, including his fatwas, that have been translated into Indonesian. On the other hand, other scholars emphasized al-Albânî's central role in the global Salafist movement as a contemporary Salafist ideologue. This figure calls for ijtihad based on authentic traditions and rejects tackled and bequeaths his brand of Salafism in deconstructing the traditions of schools of fiqh. The research question is what is the influence of al-Albânî's takhrîj traditions on Indonesian Salafist Islamic legal thought? This is qualitative research with a historical, hadith scientific, and sociological approach. The findings of this study are that the traditions of takhrîj al-Albânî and its understanding have led to the strengthening of a strict literal way of Islamic law. Al-Albâni greatly influenced Indonesian Salafists in forming a pattern of thought called "Neo-Ahl al-Hadîts". The Neo-Ahl al-Hadîts legal thought inflicts radical and intolerant attitudes among Indonesian Salafist. Nâshir al-Dîn al-Albânî adalah salah satu tokoh paling berpengaruh dalam gerakan Salafi kontemporer, bersama Bin Bâz dan Uthaymin. Artikel ini akan membahas pengaruh Nâshir al-Dîn al-Albânî dalam pemikiran hukum Islam Salafi Indonesia. Dalam wacana pemikiran hukum Islam di Indonesia, beberapa ulama menjelaskan pentingnya peran al-Albânî dalam membela fatwa-fatwa Ibnu Bâz dengan menulis puluhan karya, termasuk fatwanya, yang telah diterjemahkan ke dalam bahasa Indonesia. Di sisi lain, ulama lain menekankan peran sentral al-Albânî dalam gerakan Salafi global sebagai ideolog Salafi kontemporer. Tokoh ini menyerukan ijtihad berdasarkan hadis shahih dan menolak menegur dan mewariskan merek Salafismenya dalam mendekonstruksi tradisi mazhab fikih. Pertanyaan penelitiannya adalah bagaimana pengaruh tradisi takhrîj al-Albânî terhadap pemikiran hukum Islam Salafi Indonesia? Jenis penelitian ini adalah kualitatif dengan pendekatan sejarah, ilmu hadis, dan pendekatan sosiologis. Temuan penelitian ini adalah bahwa hadis takhrîj al-Albânî dan pemahamannya telah menyebabkan penguatan hukum Islam secara literal yang sangat kaku. Al-Albâni sangat mempengaruhi kaum Salafi Indonesia dalam membentuk pola pemikiran yang disebut “Neo-Ahl al-Hadîts”. Kemudian, pemikiran hukum Neo-ahl al-Hadîts melahirkan sikap radikal dan intoleran di kalangan Salafi Indonesia.

Abstract

The article aims to describe the religious views of Indonesian Muslim groups concerning Covid-19 and health protocols. It also explores the factors that lead some Muslims to reject health protocols in their religious practices. The qualitative method was employed in this study, with research subjects selected through purposive sampling, and data were analyzed using descriptive analysis. The informants included leaders of Indonesian Muslim groups, such as Muhammadiyah, Nahdlatul Ulama, and other Muslim group leaders. The research findings indicate that most Muslim group leaders interpret Islamic teachings with academic perspectives, although many tend to adopt conservative interpretations. This conservative religious understanding is influenced by several factors: first, the psychological factor of panic or cultural shock among some Muslims; second, the influx of information on social media whose accuracy is challenging to verify; third, economic pressure on the people; and fourth, the government’s indecisiveness and the ineffectiveness of public communication.
