Abstract

The Constitutional Court has an authority in judging at first and final levelof the decision that shall be final and binding also obtain permanent legalforce since the end of spoken/read, but there are some decisions that cannot be directly implemented due to need follow-up with the formation ofnew laws or law amendment, for example Constitutional Court decisionNumber 5/PUU-IV/2007 that grant the petition of the Petitioner regarding“individual candidates in the election of regional leader and regional leaderproxy”, can not be directly applied operationally, without following up withthe making of the Law Amendment of Law Number 32 Year 2004 regardingRegional Government. Legislation making in order to follow up the decisionof the Constitutional Court legally permissible, although the law in questionoutside the National Legislation Program (Prolegnas). In making legislation,the Constitutional Court decision can be used by legislators as a referenceto determine the constitutionality of draft of law, against the Constitution ofthe Republic of Indonesia Year 1945.

Abstract

Badan Hukum Publik Badan Penyelenggara Jaminan Sosial yang dibentukberdasarkan Undang-Undang Nomor 24 Tahun 2011 tentang BadanPenyelenggara Jaminan Sosial sebagaimana ditentukan Pasal 7 adalah untukmenyelenggarakan program jaminan sosial. Badan Penyelenggara JaminanSosial dimaksud meliputi Badan Penyelenggara Jaminan Sosial Kesehatan danBadan Penyelenggara Jaminan Sosial Ketenagakerjaan yang berfungsimenyelenggarakan program jaminan kesehatan, program jaminan kecelakaankerja, program jaminan kematian, program jaminan pensiun, dan jaminan haritua.

Abstract

“In order to carry out the duties and functions of the Minister ofLaw and Human Rights Republic of Indonesia as the President’spermanent proxy in any Judicial Reviews before theConstitutional Court, the Directorate Litigation of Legislationas an echelon unit II in Directorate General of Legislation, amongothers, prepares and composes the Government’s/President’sOpinion and provides assistance in any trials before theConstitutional Court. The activities in preparing and composingthe Government’s Opinion is started from analysing the supply,collecting data, coordinating with the related institution in anyJudicial Reviews and also the concept of composing theGovernment’s Opinion and Opening Statement. Because of thePresident’s Opinion is a formal Government’s Opinioncomposed in oral and written concern about the principal ofsuplication which is the result of coordination between ministersor Government’s Institution, then in composing the government’sOpinion, Directorate Litigation of Legislation coordinates withDepartments, State Agencies, Non-Department GovernmentAgencies, community organizations, religion organizations, orprofessional organizations and invites sources from academics,practical, professional and NGOs to find any supports orinformation related with the supply principals.”
