Abstract

The legal realignment of the inheritance in Indonesia was legally regulated through laws passed, such as KHI and KUHpdt. Whereas legally non-constitutional acts are in accordance with living laws. When it comes to inherited religious laws, it seems too sensitive to discuss in such a haphazard way that studies of semantics should be conducted. It is therefore intended to make thematic and scientific discussion efforts, so it is hoped that the result will be a soluble consideration for addressing the different religious legacies. As for the research method, the author uses is library research by making the maqâṣîd asy-Syarîʻah yusûf al-Qarḍâwî theory one of his basic analyses. From research it is understandable that yusûf al-Qarḍâwî held the right to inherit Muslim heirs to his non-muslim properties.

Abstract

This research attempts to provide readers with a contextual understanding of jurisprudence (fiqh) to encourage flexible and dynamic thinking. This study uses library research as its research methodology. The results indicated that Islam has theological significance to the content of older works, including the Torah, the Injīl, and Zabur. The backdrop context of the birth of Islam is influenced significantly by the Arab Jahiliyah period. It is of great importance to Jewish and Christian theology. Despite the presence of Arab Jahiliyah, the teachings of Islam align with the traditions and culture of Arab Jahiliyah. Jurisprudence is intricately linked to the historical and socio-political context in which it was developed. The recontextualization of jurisprudence in today's period is necessary to ensure the sustainability of Islamic teachings. This research's conclusions distinguish it from others by focusing on issues connected to fundamental and historical assumptions about Islamic teachings.

Abstract

The purpose of this research is to describe the reality of mut’ah marriage in Indonesia by making an attempt to interpret the views of Shi’ah scholars. The discourse related to mut’ah marriage isn’t longer considered a new discuss in Indonesia. There have been several previous studies related to this problem. Starting from research that focuses on the discuss related to the legal controversy of contract marriage, efforts to compare Islamic law with positive law in Indonesia, attempts to criticize the hadith relating to the ability to implement mut’ah marriage, and research that is directly involved in the field. Basically, this opinion about the permissibility of marriage was specifically conveyed by the Shi’ah scholars. And the Sunnis generally forbiden it. This study used a qualitative approach with the library study method. The writer chose the research using the literature study method to make it easier to collect data related to the reality of the practice of mut'ah marriage in Indonesia. The research results show that: The practice of mut’ah marriage in Iran is actually regulated in a certain regulation. But, in Indonesia the marriage that are listed and protected in the regulations are marriages that are permanent (daim).
