Abstract

The rapid development of legal problems in the paradigm of human life requires scholars and jurists to always try to find the basic rules of Islamic Law, the order to make a renewal and new adjustment to the needs of the times which are always evolving from time to time. No doubt if the jurists are like Imams al-Ghazali, al-Juwaini, as-Syatibhi, Najmuddin at-Thufi, Izzudin Abdi Salam, Khalid Abu el-Fadhl, Muhammad Syahrur, as well as other scholars continue to strive to carry out Ijtihad, in the field of Maqashid Sharia in Particular. This qualitative research using the literature study approach seeks to explore the concept of maqashid sharia gradation which was coined by Sheikh Izzudin Abdi Salam. Where according to the idea it can be understood that, all forms of Sharia are made as an effort to bring benefit and reject mafsadat. Whether worldly or ukhrawi. It can also be understood that, this maqashid gradation is more emphasized on everything that is haqiqi and majazi in nature. Don’t be emphasizing the aspects of Dharuri, Hajj, or Tahsini. So, that in the end everything is done with hope (strong suspicion) not in certainty of all forms of mukallaf deeds.

Abstract

Abstract

The primary purpose of this research is to investigate and understand the importance of the concept of Kafā’ah in the practice of marriage in Muslim communities in Jordan, Marocco, and Pakistan. Kafā’ah in text or context is understood by the concept of harmony between the two brides to be, both in terms of wealth, nasab, beauty/good looks, especially in religious matters. This research uses a qualitative research approach (library research) to facilitate extracting and analyzing data. The results showed that the concept of Kafā’ah in the Muslim countries of Jordan, Marocco, and Pakistan, in general, is still guided by the view of imam madhhab, especially in Jordan and Pakistan, which is more inclined to the provisions of imam madhhab Hanafi which as the main criteria of Kafā’ah is concerning five basic things, including: religion, descent, hurriyah, the wealth of both brides, as well as the field of work. In contrast, Kafā’ah in the country of Marocco is more inclined to the provisions of the Imam Madzhab Maliki, which emphasizes religious and health aspects, be it a physical or psychic condition of a person. However, in some ways, it has shifted to the standard of Kafā’ah, which includes not only material, nasab, or religion, but on love or affection between the brides and grooms. Thus, the material of family law renewal is expected to be adopted or implemented in legislation, especially related to marriage in Indonesia.

Abstract

The phenomenon of wives working today is considered to cause changes and shifts in roles in a family. The position that generally places a husband as the head of the family and the main breadwinner, seems to have slowly changed. Its not as different as happened in some families in Kedungbunder Village Blitar Regency, where only the figure of the wife works to provide for the family. This kind of condition puts a wife having a more dominant role in the family. This study was conducted with the aim of examining social stratification among families whose livelihoods are borne by the wife. The method used is a qualitative research approach (field research), where data is collected through an in-depth interview process and parsipatory observation. The results showed that, some families in Kedungbunder Blitar Village where only the wife is working show the rule of law that states that the husband is the head of the family and the wife as a housewife, are considered not always applicable in the existing social reality. In the family, the wife's position is in a high social class because it is the economic source of the family and has more dominant power than other family members. Keywords: Social Stratification, Family, The Wife Works

Abstract

This study is motivated by the increasing severity of environmental degradation and natural disasters in Indonesia and globally, which reflect an imbalance in the relationship between humans and nature. Such conditions indicate not only ecological crises but also ethical and spiritual disorientation in human behavior toward the environment. In this context, Islamic eco-theology offers a normative framework rooted in the Qur’an, Hadith, and the principles of maqāṣid al-sharī‘ah, particularly the concept of hifẓ al-bi’ah. Therefore, this research aims to examine the orientation of Islamic eco-theology and to analyze how hifẓ al-bi’ah functions as a conceptual and ethical foundation in maintaining ecosystem balance and addressing global environmental challenges. This research employs a qualitative approach through library research, utilizing a descriptive-analytical method. Data were collected from primary Islamic sources, including the Qur’an and Hadith, as well as relevant scholarly literature on eco-theology and maqāṣid al-sharī‘ah. The analysis focuses on interpreting Islamic teachings related to environmental ethics and exploring their relevance within contemporary ecological issues. The findings reveal that Islamic eco-theology positions environmental preservation as an integral obligation of humans as khalīfah (stewards) on earth. The concept of hifẓ al-bi’ah emerges as a significant extension of maqāṣid al-sharī‘ah, emphasizing the necessity of maintaining ecological balance, preventing environmental destruction, and avoiding excessive exploitation of natural resources. The originality of this study lies in its integrative approach, which frames hifẓ al-bi’ah not merely as a normative principle, but as an operational and contextual paradigm that connects theological, ethical, and ecological dimensions in responding to the contemporary environmental crisis.
