Abstract

This research paper examines the urgent need to reform the Indonesian Criminal Code to recognize corporations as subjects of criminal law. It delves into the concept of corporate criminal liability, highlighting the importance of establishing clear legal frameworks to hold corporations accountable for their actions. The study analyzes the politics of criminal law in Indonesia, focusing on shaping legal policies to address societal needs and ensure justice. Key findings include the necessity of incorporating various theories of corporate punishment (such as strict liability, vicarious liability, identification theory, and aggregation theory) into the legal framework to effectively address corporate criminal behavior. The research also reviews the RKUHP (Revised Criminal Code Bill), which explicitly defines corporate criminal liability and outlines the responsibilities of corporate management in crimes committed on behalf of corporations. Using normative juridical research methods, including statute and conceptual approaches, the paper examines existing legal regulations and their implications for corporate accountability in Indonesia. Concluding that a comprehensive understanding of corporate criminal liability is vital for law enforcement and judicial authorities to enforce the law effectively, the study advocates for legal reforms aligned with the values of Pancasila, reflecting Indonesia's unique socio-cultural context while addressing the complexities of corporate crime.

Abstract

This research explores the shift from a conventional criminal justice system, which focuses on retaliation, to restorative justice as regulated by the Prosecutor's Office of the Republic of Indonesia under Regulation No. 15/2020. The regulation outlines conditions for terminating prosecution in favor of restorative justice, emphasizing reconciliation over punishment. Using a normative juridical method with statutory, case study, and conceptual approaches, the study highlights the prosecutor's critical role in implementing restorative justice. Beyond their traditional prosecutorial duties, prosecutors act as facilitators to prevent case backlogs in courts by enabling termination of prosecution through mediation. In this system, prosecutors play an active role in reconciling victims and perpetrators. Through penal mediation, they aim to achieve a win-win solution where both parties reach mutual agreements and recovery is prioritized over retribution. The goal is to restore the relationships and conditions disrupted by the offense, ensuring the parties involved return to their original state, fostering justice that is both fair and rehabilitative. This approach reflects a significant transformation in Indonesia's criminal justice system, promoting efficiency and healing rather than focusing solely on punishment.

Abstract

Narkotika dan Psikotropika merupakan obat-obatan yang hanya boleh digunakan untuk kepentingan kesehatan dan/atau pengembangan ilmu pengetahuan. Penyalahgunaan narkotika dan/atau psikotropika dapat mengakibatkan berbagai dampak buruk bagi kesehatan bahkan dapat pula menyebabkan kematian. Namun demikian penyalahgunaan Narkotika dan Psikotropika marak terjadi di berbagai negara termasuk Indonesia. Yang memprihatinkan, Pelaku Penyalahgunaan Narkotika dan/atau Psikotropika tidak hanya berasal dari kalangan orang dewasa tetapi juga berasal dari kalangan remaja. Masih terdapat pula masyarakat yang tidak terlalu memahami apa itu Narkotika, Psikotropika, apa dampak buruk yang dapat diakibatkan oleh penyalahgunaan Narkotika dan/atau Psikotropika serta apa sanksi hukum yang dapat mereka hadapi apabila mengkonsumsi Narkotika dan/atau Psikotropika tanpa hak atau melawan hukum. Masyarakat demikian rentan menjadi sasaran bandar Narkoba. Oleh karena itu, dengan dilaksanakannya program kerja penyuluhan hukum ini diharapkan dapat meningkatkan pengetahuan masyarakat terkait aturan hukum tentang Narkotika, Psikotropika dan pidana bagi remaja yang melakukan tindak pidana sehingga masyarakat khususnya remaja mematuhi aturan hukum yang berlaku.
