Abstract

The increasing interest of the private sector to do business in company activities, except in fields that control the lives of many people and are strategic. The role of the government is to regulate what is included in government programs, especially the provision of facilities and infrastructure. One of them is in the form of regulations in the form of granting trading business licenses. The problems that arise include: What are the legal consequences of a mini market trading business if it does not have a Trading Business License (SIUP) and what are the actions taken by the authorized official against violators of the Mini Market Trading Business License (SIUP). The approach to the problem used in this research is normative juridical. On the basis of the discussion in the analysis described above, the following conclusions can be drawn: The legal consequences of a mini market business if it does not have a trading business license (SIUP) include administrative sanctions such as summons to be directed to seek SIUP, written warnings, temporary suspension of SIUP. and finally the revocation of SIUP in accordance with Gianyar Regency Regulation Number 6 of 2005 concerning Trading Business Permits (SIUP), while the criminal sanction is imprisonment for a maximum of 3 (three) months or a maximum fine of 4 (four) times the amount of retribution owed. Actions taken by authorized officials against violations of trade business permits (SIUP) include forming an integrated team involving stikeolders such as Satpol PP, Police, the legal department, the economic division and the regional supervisory agency (Bawasda), to oversee all business activities such as mini markets, supermarkets and hypermarkets in order to seek business licenses as a means of legality in carrying out their business activities.

Abstract

Not a few people are also involved in disagreements, fights that encourage them to commit mistreatment unintentionally so that it is felt that this criminal act of persecution can occur anywhere without knowing the place and can occur in public. Based on this background, the problem found is why someone commits a criminal act of mistreatment in public in terms of a criminology perspective at the Karangasem Resort Police, how is law enforcement against a criminal act of persecution in public in terms of a criminological perspective at the Karangasem Resort Police.The type of research in this study is empirical research with descriptive research. Data sources come from primary data sources and secondary data sources. The data collection technique used is Document Study, field research, interviews, and sample determination. Based on the data obtained and collected, it will be processed using qualitative analysis methods and then analyzed using inductive thinking methods. The conclusion obtained from this research is that there are several factors that cause the occurrence of criminal persecution. These factors are divided into 2 types, internal factors and external factors. The form of law enforcement against criminal acts of persecution in public from the perspective of criminology at the Karangasem Resort Police is divided into 3 forms, pre-emptive, preventive, and repressive.

Abstract

Adjustment of statutory regulations in the field of tourism business law in Indonesia is one of the consequences of the WTO agreement, thus the GATS-WTO agreement does not only concern Law Number 10 of 2009 concerning Tourism, but also all other related regulations. with tourism, such as labor regulations, Intellectual Property regulated in TRIP's, investment regulations (TRIM's), etc. These regulations will be affected by the provisions of the GATS-WTO, which must immediately be adjusted and harmonized with the GATS agreement commitment that has been agreed by Indonesia. It is by putting the principles of liberalization that it can have an impact on tourism arrangements in Indonesia which are not liberal but adhere to the principles of the Pancasila democracy state. The impact of the WTO on Indonesia's tourism business law arrangements related to TRIMS and GATS is the creation of tourism regulations that can protect local communities and cultures, limiting the liberalization of foreign investors from modern countries. The tourism arrangement must be in accordance with the nature of the purpose of its existence, namely to: increase economic growth; improve people's welfare; eradicating poverty; overcoming unemployment; preserving nature, environment and resources; promote culture; lifting the image of the nation; cultivate a love of the country; strengthen national identity and unity; and strengthen friendship between nations.

Abstract

Desa Adat sebagai kesatuan masyarakat hukum Adat yang ada di Propinsi Bali mempunyai suatu kesatuan tradisi dan tata krama pergaulan hidup masyarakat umat Hindu secara turun temurun berada dalam ikatan Kahyangan Tiga (Kahyangan Desa) yang mempunyai wilayah dan harta kekayaan sendiri serta berhak mengurus rumah tangganya sendiri. Sebagai kesatuan masyarakat hukum Adat (Desa Adat) diikat oleh aturan Adat atau hukum Adat yang tumbuh dan berkembangan dalam lingkungan masyarakat setempat, yang lebih dikenal adalah dalam bentuk Awig-Awig yang merupakan pedoman dasar dari Desa Adat dalam pemerintahannya. Adapun pokok permasalahan dalam penulisan ini adalah bagaimana penerapan sanksi awig-awig Desa Adat dan hambatan-hambatan apa saja yang dialami terhadap pelanggaran perkawinan yang dilakukan oleh Krama Desa Adat Takmung. Metode pendekatan yang digunakan adalah pendekatan empiris, untuk dapat memberikan gambaran secara kualitatif . Data primer dan data sekunder ini dilakukan melalui penelitian kepustakaan dan lapangan dengan studi dokumenmaupun pedoman wawancara. Simpulan penelitian ini menunjukan penerapan sanksi terhadap pelanggaran awig- awig desa Adat tergantung dari pelanggaran yang dilakukan sesuai dengan apa yang tercantum dalam awig-awig desa Adat Takmung dengan mengutamakan penyelesaian secara kekeluargaan dan bijksana, baik berupa denda secara fisik atau denda dengan harta (meteriil). Dengan sosialisasi kepada warga desa secara terus menerus dan tindakan yang tegas baik perangkat desanya atau kepatuhan warga desanya maka hambatan-hambatan dalam penerapan sanksinya dapat diselesaikan dengan sebaik- baiknya. Traditional Villages as a customary law community unit in the Province of Bali have a unity of traditions and manners for social life of the Hindu community from generation to generation within the Kahyangan Tiga (Kahyangan Desa) bond which has its own territory and assets and has the right to take care of its own household. As a customary law community unit (Adat Village) is bound by customary rules or customary law that grows and develops within the local community, which is better known in the form of Awig-Awig which is the basic guideline of the traditional village in its administration. The main problem in this writing is how to apply the awig-awig sanction of the Traditional Village and what obstacles are experienced against marriage violations committed by the Krama of the Takmung Traditional Village. The approach method used is an empirical approach, to be able to provide a qualitative description. Primary data and secondary data were conducted through library and field research using document studies and interview guidelines. The conclusions of this study show that the application of sanctions for violations of awig-awig in traditional villages depends on the violations committed in accordance with what is stated in the awig-awig in traditional villages of Takmung by prioritizing amicable and wise settlements, either in the form of physical fines or monetary fines. . With continuous outreach to villagers and firm action by both the village apparatus and the compliance of the villagers, the obstacles in applying sanctions can be resolved as well as possible..

Abstract

Lingkungan hidup adalah kesatuan ruang dengan semua benda, daya, keadaan, dan makhluk hidup, termasuk di dalamnya manusia dan perilakunya yang mempengaruhi kelangsungan perikehidupan dan kesejahteraan manusia serta makhluk hidup lainnya. Hukum pidana pada hakikatnya adalah “hukum sanksi” yang tujuannya untuk mengatur dan menentukan ketertiban dalam masyarakat, menjamin keamanan dan juga keselamatan negara. Maksud dari kata-kata tersebut yaitu bahwa hukum pidana merupakan sarana pemaksa untuk melindungi warga masyarakat terhadap perbuatan yang merugikan atau yang mengakibatkan terjadinya penderitaan pada pihak lain yang dalam hal ini adalah pencemaran lingkungan hidup. Pencemaran lingkungan hidup adalah masuknya atau dimasukannya makhluk hidup, zat, energi, dan/atau komponen lain ke dalam lingkungan hidup oleh kegiatan manusia sehingga kualitasnya turun samapai tingkat tertentu yang menyebabkan lingkungan hidup tidak dapat berfungsi sesuai dengan peruntukannya. Dalam penulisan artikel ini diambil beberapa perumusan masalah yaitu, Bagaimanakah kebijakan hukum pidana terhadap pelaksanaan UU No. 23 Tahun 1997 tentang Lingkungan Hidup saat ini? dan bagaimanakah kebijakan hukum pidana terhadap pelaksanaan UU No. 23 Tahun 1997 tentang Lingkungan Hidup pada masa mendatang? Metode penelitian yang digunakan dalam penelitian ini adalah metode hukum normatif dengan jenis penelitian yang digunakan adalah jenis penelitian yuridis normative dan dikaji dengan pendekatan perundang-undangan (the statute approach). Kebijakan hukum pidana lingkungan hidup pada saat ini belum dapat dikatakan secara optimal karena dalam penanganannya masih dalam batas teguran, sehingga belum ada vonis hakim yang dapat memenjarakan ataupun memidanakan pelaku tindak pidana pencemaran lingkungan hidup. Untuk kebijakan hukum pidana lingkungan hidup untuk masa yang akan datang pengawas lingkungan harus melakukan sosialisasi dan membuat buku pedoman pengawasan kegiatan lingkungan untuk pengawasan lingkungan hidup. The living environment is the unity of space with all objects, forces, conditions and living creatures, including humans and their behavior which influences the continuity of life and welfare of humans and other living creatures. Criminal law is essentially a "law of sanctions" whose aim is to regulate and determine order in society, guarantee the security and safety of the state. The meaning of these words is that criminal law is a means of coercion to protect citizens against actions that are detrimental or cause suffering to other parties, which in this case is environmental pollution. Environmental pollution is the entry or entry of living creatures, substances, energy and/or other components into the environment by human activities so that their quality decreases to a certain level which causes the environment to be unable to function according to its intended purpose. In writing this article, several problem formulations were taken, namely, what is the criminal law policy regarding the implementation of Law no. 23 of 1997 concerning the current environment? and what is the criminal law policy regarding the implementation of Law no. 23 of 1997 concerning the Environment in the future? The research method used in this research is a normative legal method with the type of research used being normative juridical research and studied using a statutory approach. Environmental criminal law policy at this time cannot be said to be optimal because its handling is still within the limits of warnings, so there has been no judge's verdict that can imprison or criminalize perpetrators of criminal acts of environmental pollution. For environmental criminal law policy for the future, environmental supervisors must carry out outreach and create a guidebook for monitoring environmental activities for environmental monitoring.

Abstract

This article discusses the regulation of immunity rights granted to members of the People's Representative Council (DPR) who are involved in legal cases. The main objective of this research is to analyze the regulation and impact of immunity rights on DPR members involved in legal cases. This research utilizes a document analysis method to examine the regulations and laws related to DPR immunity rights, as well as case studies involving DPR members implicated in legal cases. The data used in this research are sourced from legal documents, court rulings, and media reports. The research findings indicate that the immunity rights granted to DPR members provide special legal protection that restricts their detention, arrest, and prosecution during their term in office. However, the use of these immunity rights also raises various controversies, especially when DPR members are involved in legal cases involving corruption or other serious violations.

Abstract

The purpose of writing this thesis is for these matters: (1) to find out and analyze the legal force of Kep. MDA 08/SK/MDA-PBali/X/2020 against traditional villages in Bali in relation to restrictions on demonstrations at the traditional village of Wewidangan; (2) to find out and analyze the existence of Kep. MDA. 08/SK/MDA-PBali/X/2020 which is viewed from the perspective of human rights. This thesis is classified as a normative research which uses 2 types of approaches, namely the statutory approach and the conceptual approach. The legal materials in this thesis were collected using document study techniques and then analyzed qualitatively. Based on the research results, it is known that Kep. MDA 08/SK/MDA-PBali/X/2020 has binding legal force against traditional villages in Bali. This opinion is based on 3 considerations, namely: (1) the arrangement of Kep. MDA 08/SK/MDA-PBali/X/2020 is in accordance with the theory of Catur Praja and in line with the concept of the rule of law; (2) according to the considerations from Kep. MDA 08/SK/MDA-PBali/X/2020, it is known that the a quo decree was born after the traditional village in Bali stipulates and enforces Pararem for the Prevention and Control of Gering Agung Covid-19; and (3) Kep. MDA 08/SK/MDA-PBali/X/2020 is an implementation of the Bali Mawacara principle as referred to in Regional Regulation Number 4 of 2019. Furthermore, Kep. MDA 08/SK/MDA-PBali/X/2020 could not be qualified as a violation of human rights. Based on the principle of siracausa, the International Covenant On Civil And Political Rights 1966, and the provisions of Article 28 J of the 1945 Constitution of the Republic of Indonesia, the a quo decision can actually be used as a means to respect, protect, and fulfill human rights for every Balinese citizen, especially karma desa, krama tamiu, and guests who are in the traditional village of wewidangan.
