Abstract

Kekerasan seksual menjadi ancaman bagi generasi bangsa. Masalahnya masih banyak orang menganggap kekerasan seksual hanya hal sepele. Sehingga perlu dilakukan kajian dan studi mengenai masalah ini sehingga masyarakat mengetahui bahayanya tindakan kekerasan seksual. Tujuan dari riset ini menyusun kajian studi materi tentang kekerasan seksual di kalangan anak dan tindakan yang tepat dilakukan dalam pencegahan kekerasan seksual di Indonesia. Penelitian yang digunakan dalam penelitian ini adalah penelitian kualitatif dengan penelitian kepustakaan. Pencarian artikel diperoleh dari database Google Scholar dan Scopus, menggunakan kata kunci terpilih yang diterbitkan dalam kurun waktu 10 tahun terakhir, sejak tahun 2012 hingga 2022. Sumber artikel berfokus pada insiden yang terjadi di Indonesia dan beberapa sumber kekerasan seksual berbahasa Inggris yang terjadi di luar Indonesia. Hasil kajian materi yang didapatkan bahwa kejahatan kekerasan seksual menjadi masalah global dunia. Kasus yang terjadi di indonesia masih didominasi oleh wanita dan anak-anak. Permasalahan lainnya di indonesia banyak korban yang tidak mau melaporkan kasus yang menimpanya karena diintimidasi oleh pelaku ataupun merasa malu, dihakimi oleh masyarakat sehingga merasa tidak perlu melakukan pelaporan ke pihak berwajib. Sudat pandang dari negera lain bahwa masih banyak mempercayai kekerasan seksual itu adalah myth. Akan tetapi terdapat peraturan yang melarang kekerasan yang dibuat oleh International Criminal Court, International humanitarian law, dan international Law Commission. Kasus yang terjadi di benua eropa dan amerika adalah kasus yang lebih ke arah pemerkosaan (rape). Hukum pidana internasional melarang kekerasan seksual atau dengan kata lain secara de facto dikutuk di sebagian besar negara.Kekerasan seksual menjadi ancaman bagi generasi bangsa. Abstract

Criminal law enforcement against companies in environmental crime cases still faces significant challenges. Although Law Number 32 of 2009 concerning Environmental Protection and Management (PPLH Law) has regulated criminal sanctions for companies that pollute the environment, its implementation is still weak. The main factors that hinder the effectiveness of law enforcement include difficulties in proving criminal elements, weak capacity of law enforcement officials, and political and economic pressures that benefit polluting companies. In addition, corruption, overlapping authority between institutions, and inequality between regulations and implementation are the main obstacles in criminally ensnaring companies. The principles of strict liability and corporate criminal liability that are expected to ensnare polluting companies are still not applied optimally. Legal reform is needed to strengthen the effectiveness of environmental criminal law enforcement, including through increasing the capacity of law enforcement officers, improving regulations, and implementing stricter sanctions such as the revocation of business licenses. Information transparency, inter-agency coordination, and protection for whistleblowers must also be strengthened. With these steps, it is hoped that environmental law enforcement can be more effective in providing a deterrent effect to polluting companies, ensuring corporate criminal responsibility, and upholding the principles of environmental justice in Indonesia.

Abstract

This study analyzes the application of restorative justice to minor crimes in the Indonesian criminal justice system, especially after the issuance of Police Regulation No. 8 of 2021. The shift from a retributive approach to a restorative approach is a response to the failure of the conventional criminal system in achieving substantive justice and overcrowding in correctional institutions. The research method used is normative juridical with a statutory and conceptual approach. The results of the study show that restorative justice has strong theoretical legitimacy through the conceptĀ  of reintegrative shaming and normative support from Law No. 11 of 2012 and Perpol No. 8 of 2021. However, its implementation faces juridical and institutional challenges, especially related to the hierarchy of norms, accountability, and the understanding of law enforcement officials and the public towards the concept of restorative justice. It also found potential irregularities if there is no strict supervision of the peace mechanism outside the formal process. Therefore, there is a need for harmonization of regulations, integrated training for officials, and the participation of civil society in the supervision of implementation. This study recommends the reform of the Criminal Code and the establishment of inter-institutional regulations to ensure that restorative justice becomes a valid, effective, and just approach in national criminal law enforcement.

Abstract

Taxes are the main instrument in the country's financial system because they function as a source of revenue to support national development. However, tax evasion practices are still rampant and cause significant fiscal losses, requiring effective law enforcement. In the context of Indonesian tax law, tax avoidance can be subject to administrative and criminal sanctions in accordance with the provisions of Law Number 28 of 2007 concerning General Provisions and Tax Procedures (KUP Law). Administrative sanctions function as the main instrument that is both preventive and repressive through the mechanism of fines, interest, or increases in taxes owed. However, in cases with the impact of large losses and intentional elements, relevant criminal sanctions are applied as the ultimate remedium. Reform through Law Number 7 of 2021 concerning the Harmonization of Tax Regulations (HPP Law) strengthens aspects of legal certainty, affirms the principle of ultimum remedium, and increases the authority of tax authorities while still paying attention to the protection of taxpayer rights. This study uses a normative juridical method by examining positive norms, the principle of legality, the principle of proportionality, and the principle of justice in the application of sanctions. The results of the analysis show that the integration of administrative, criminal, and regulatory sanctions is able to create a fairer, more transparent, and sustainable tax system, while maintaining legal legitimacy and public trust

Abstract

The ratio legis of rehabilitation regulation in Indonesian positive law reflects a shift in the criminal paradigm from a repressive system to a restorative and rehabilitative approach. This study is important to test the suitability of legal objectives (rechtsidee) with the implementation of applicable norms, as well as assess the extent to which rehabilitation arrangements can function as a legal instrument in reducing recidivism rates in narcotics offenders. Law Number 35 of 2009 concerning Narcotics and Law Number 22 of 2022 concerning Corrections have regulated rehabilitation for perpetrators of narcotics crimes. However, implementation in the field faces obstacles such as limited facilities, human resources, and post-rehabilitation monitoring mechanisms. Permenkumham No. 12 of 2017 concerning the Implementation of Medical and Social Rehabilitation for Prisoners and Prisoners of Narcotics Abusers Medical Rehabilitation is intended for narcotics addicts who are still experiencing physical dependence and need medical treatment. Rehabilitation arrangements in correctional institutions (Lapas) are based on several national regulations that regulate how inmates, especially those involved in narcotics cases, receive coaching and recovery so that they do not return to commit similar crimes (recidivism). Rehabilitation as an instrument of recidivism reduction has a strong rational basis, because an effective rehabilitation program is able to improve behavior, strengthen self-control, and equip inmates with life skills. Thus, they have a greater chance of living a productive life after being free and not falling back into narcotics abuse. However, the implementation of rehabilitation in prisons still faces a number of challenges, such as limited facilities, professional personnel, and the lack of follow-up programs (aftercare) after the prisoners are released. This hinders the effectiveness of rehabilitation in reducing recidivism.
