Abstract

The question of the distribution of heritage property from parents to their children, or from people who have died to the parties entitled to them is a complicated problem and often cause problems for many family members. Generally, the problems arising from the practice of inheritance share are because each party feels it does not get the inheritance as it should be (unfair). This paper examines the concept of justice in the distribution of inheritance under Islamic law and Burgerlijk Wetboek (BW). This paper has provided valuable information on the understanding and concept of justice existing in Islamic law and also in BW, in which the different concept of justice has given rise to different provisions in terms of inheritance division. In the Islamic heirs law, the concept of justice is based on the principle of equitable justice, while the concept of justice contained in Burgerlijk Wetboek is built on Western philosophies and ideas, especially the justice Aristotle made about the equality of rights between individuals. Therefore, the rights of the heirs are equal to the rights of the daughter's heirs. The difference in fairness in the distribution of inheritance is due to differences in the perspectives of justice and the legal basis of the two heirs. Islam considers that the obligation to provide family support is the responsibility of men so that it is appropriate if men doubled the share of women's heritage. Meanwhile, in the Western thinking that forms the BW heir system does not determine and imposes obligations to provide a family income only to men or women, so BW's heirs provide a share of inheritance equally between men and women.

Abstract

This article seeks to delve into the extent of development and updates in Islamic civil law from the colonial era of Dutch rule to post-independence Indonesia. This research will focus on exploring the updates in Islamic civil law regarding inheritance and wills. It is a literature study with a normative-historical approach aimed at tracing the development and updates of inheritance and wills law in Indonesia, as well as the dialectics of thought attempting to oppose it. The innovations in inheritance and wills in Indonesia include substitute heirs, peace in estate division, adopted heirs, and compulsory wills. Substitute heirs provide a solution for heirs who are hindered from inheriting because their parents passed away first. Peace in estate division allows for the realization of equal distribution with a mutual agreement, while compulsory wills provide a solution for adopted children to still receive a third of the inheritance even if they do not have a blood relationship.

Abstract

Abstract: This article discusses the debate of the lineage (nasab) of children born out of wedlock according to maqāşid asy-syarī'a framework by Auda. The data were collected from various literary sources, including primary, secondary, and tertiary materials. By employing the approach and theory of maqāşid asy-syarī'a of Auda, this article concludes that efforts to create a just and equitable jurisprudence can be undertaken by reconstructing the classical fiqh framework concerning the status and rights of children born out of wedlock. This article also concludes that every child fundamentally possesses the same legal status and civil rights, including the right to lineage with their biological father. This is made possible by establishing the reconstruction of the lineage of children born out of wedlock on a substantive-legal basis rather than a formal-legal basis, as found in the classical fiqh construction.Abstrak: Artikel ini mendiskusikan perdebatan mengenai nasab anak yang lahir di luar pernikahan menurut kerangka maqāşid asy-syarī'a ala Auda. Data dikumpulkan dari berbagai sumber pustaka, termasuk bahan primer, sekunder, dan tersier. Dengan menerapkan pendekatan dan teori maqāşid asy-syarī'a karya Auda, artikel ini menyimpulkan bahwa upaya untuk menciptakan yurisprudensi yang adil dan merata dapat dilakukan dengan merekonstruksi kerangka fikih klasik mengenai status dan hak-hak anak yang lahir di luar pernikahan. Artikel ini juga menyimpulkan bahwa setiap anak pada dasarnya memiliki status hukum dan hak-hak sipil yang sama, termasuk hak atas nasab dengan ayah biologis mereka. Hal ini dapat tercapai dengan melakukan rekonstruksi nasab anak yang lahir di luar pernikahan berdasarkan dasar hukum substantif daripada dasar hukum formal, seperti yang ditemukan dalam konstruksi fikih klasik.
