Abstract

In 2019, Indonesia redefined the minimum age limit for marriage with the aim of achieving gender equality and reducing child marriage rates. Unfortunately, this legal reform did not entirely succeed and, instead, created a paradox within Indonesian society. This study aims to investigate the controversy surrounding the minimum age for marriage as stipulated in Indonesian Marriage Laws. The paper employs a socio-legal approach, collecting data through legal material investigation and interviews. The research indicates that the reformation attempt brings about at least three undesired implications: an increase in the number of marriage dispensations, child marriages, and pre-marital pregnancies. These paradoxes appear to be influenced by several factors: (1) the public's minimal awareness of the current marriage law, (2) the lack of socialization from government bodies, and (3) regulatory inconsistency itself. Theoretically, instead of resolving issues within society, it turns out that the legal changes initiated by the state do not significantly trigger changes within society.

Abstract

Abstract: This article discusses the debate of the lineage (nasab) of children born out of wedlock according to maqāşid asy-syarī'a framework by Auda. The data were collected from various literary sources, including primary, secondary, and tertiary materials. By employing the approach and theory of maqāşid asy-syarī'a of Auda, this article concludes that efforts to create a just and equitable jurisprudence can be undertaken by reconstructing the classical fiqh framework concerning the status and rights of children born out of wedlock. This article also concludes that every child fundamentally possesses the same legal status and civil rights, including the right to lineage with their biological father. This is made possible by establishing the reconstruction of the lineage of children born out of wedlock on a substantive-legal basis rather than a formal-legal basis, as found in the classical fiqh construction.Abstrak: Artikel ini mendiskusikan perdebatan mengenai nasab anak yang lahir di luar pernikahan menurut kerangka maqāşid asy-syarī'a ala Auda. Data dikumpulkan dari berbagai sumber pustaka, termasuk bahan primer, sekunder, dan tersier. Dengan menerapkan pendekatan dan teori maqāşid asy-syarī'a karya Auda, artikel ini menyimpulkan bahwa upaya untuk menciptakan yurisprudensi yang adil dan merata dapat dilakukan dengan merekonstruksi kerangka fikih klasik mengenai status dan hak-hak anak yang lahir di luar pernikahan. Artikel ini juga menyimpulkan bahwa setiap anak pada dasarnya memiliki status hukum dan hak-hak sipil yang sama, termasuk hak atas nasab dengan ayah biologis mereka. Hal ini dapat tercapai dengan melakukan rekonstruksi nasab anak yang lahir di luar pernikahan berdasarkan dasar hukum substantif daripada dasar hukum formal, seperti yang ditemukan dalam konstruksi fikih klasik.

Abstract

The legal substance in the Government Regulation on Marriage Law Implementation, particularly on financial requirements for polygamy, allows the emergence of ambiguous interpretations for judges. Article 41, paragraph C, of that regulation, does not specify how judges should assess the financial strength of a husband who intends to engage in a polygamous marriage. Likewise, the Bantul Religious Court judges (who granted the most polygamy permits in Yogyakarta of 2021) have a different perspective on the requirements for financial ability in polygamy. In this context, this study examines how Bantul Religious Court judges deal with this legal ambiguity in their decisions. This study examines 14 polygamy verdicts. This research finds that the concept of financial ability in the polygamy case is the judge's way of measuring the justice of the husband. Justice primarily refers to the husband's capability to provide an adequate financial portion of the fair share to their wife (in the future). To know the husband's financial ability, judges apply a holistic approach that rests on a sociological lens.[Substansi hukum dalam Peraturan Pemerintah tentang Pelaksanaan Undang-Undang Perkawinan, khususnya tentang persyaratan keuangan untuk poligami, memungkinkan munculnya penafsiran ganda bagi hakim. Pasal 41 huruf C peraturan itu tidak mengatur bagaimana seharusnya hakim menilai kekuatan keuangan seorang suami yang hendak melakukan perkawinan poligami. Begitu pula dengan Hakim Pengadilan Agama Bantul (yang paling banyak memberikan izin poligami di DIY tahun 2021) memiliki pandangan yang berbeda tentang syarat kemampuan finansial dalam poligami. Dalam konteks tersebut, penelitian ini mengkaji bagaimana Hakim Pengadilan Agama Bantul menyikapi ambiguitas hukum tersebut dalam putusannya. Studi ini mengkaji 14 vonis poligami. Penelitian ini menemukan bahwa konsep kemampuan finansial dalam kasus poligami merupakan cara hakim mengukur keadilan suami. Keadilan terutama mengacu pada kemampuan suami untuk memberikan porsi keuangan yang memadai dari bagian yang adil kepada istri mereka (di masa depan). Untuk mengetahui kemampuan finansial suami, hakim menerapkan pendekatan holistik yang berpijak pada lensa sosiologis.]

Abstract

The Indonesian government issued Regulation in Lieu of Law (Perppu) Number 2 Year 2022 on Job Creation by amending several contents of the regulation. After the issuance of the regulation, attention has been focused on the regulation of the protection of women in law. Therefore, this study aimed to determine the effect of Government Regulation on Job Creation regarding the welfare of women workers in the review of contemporary Islamic law through siyāsah dusturiyāh. The analysis was conducted through library study, using data sources acquired from the literature pertaining to the Government Regulation in Lieu of Law on Job Creation. The results showed that in contemporary Islamic legal study, the concept of siyāsah dusturiyāh emphasized policy formation to achieve benefits measured through Maqasid Shari'ah. According to Perppu, every citizen was able to secure employment and receive fair as well as dignified compensation and treatment in labor relations, including the protection of women workers. However, several aspects did not work in accordance with the objectives and had a negative impact on women workers. These included the threat of low wages, the expansion of the outsourcing system, and the obligation of prolonged leave, which no longer persisted. In this context, Perpu was not consistent with the purpose of the benefit of women workers.

Abstract

This research aims to determine the intent of legislation and the constitution regarding interfaith marriages in Indonesia, so that judges can have a deeper understanding of the existing legal intent rather than relying solely on subjective legal interpretations. Additionally, this study also examines the authority of judges in District Courts who play a role in the determination of interfaith marriages. This research is a qualitative-normative study that utilizes legal documents and literature review, including books, journals, reports, and other reliable sources, which are analyzed using legal logic reasoning. Based on the researcher’s findings, legal logic reasoning in interpreting legislation indicates that interfaith marriages are prohibited. This can be seen in the constitutional goals of Indonesia in the fourth paragraph of the 1945 Constitution, the Judiciary Power Law in Article 5 and Article 50. The constitutional goals serve as the foundation for every judge’s decision. Such decisions not only aim to achieve lasting peace and justice for the parties involved but also for society at large or the majority of the Muslim community in Indonesia. Therefore, interfaith marriages between Muslim women and non-Muslim men should not be permitted. Furthermore, according to Constitutional Court Decision Number 68/PUU-XII/2014, which states that interfaith marriages are closely related to religion, the authority to resolve interfaith marriage cases should be held by Religious Courts. This is in line with Article 49 of Law Number 3 of 2006 on Religious Courts, which specifies one of their authorities is related to marriage matters.

Abstract

This study examines the application of maqāṣid al-syarī'ah in the framework of national cyber regulations, especially related to child protection in the digital space. Using a normative qualitative approach, this study analyzes relevant laws and regulations, classical and contemporary maqāṣid literature, and recent studies on forms of digital crimes against children. The results show that the digital ecosystem presents various multidimensional threats to the protection of reason (ḥifẓ al-'aql), heredity (ḥifẓ al-nasl), and property (ḥifẓ al-māl), so an integrative framework is needed that bridges the goals of Islamic law with modern cyber governance. This study found that there is a value gap in Indonesia's cyber regulatory structure, especially the absence of a maqāṣid-based ethical paradigm in digital child protection arrangements. The novelty of this research lies in the formulation of a new conceptual integration model between maqāṣid al-syarī'ah and national cyber regulations for child protection. This integrative model has never been proposed in previous research and provides a conceptual basis for the development of ta'zīr-based digital governance policy guidelines and governance in the future.
