Abstract

Abstrak Tahap Yang Harus Dilakukan Dalam Membuat Sebuah Perjanjian Internasional Sehubungan Dengan Tindak Pidana Pencucian Uang (Money laundry) adalah : Perundingan (negotiation), Penandatanganan (signature), Ratifikasi. Tahapan Perbuatan tindak pidana Pencucian Uang (Money Laundry) Yang Dilarikan Ke Negara Lain dilakukan dengan cara : Penempatan uang (placement); Pelapisan uang (layering), dan Penyatuan uang (integration). Kata Kuci : Tindak Pidana, Pencucian Uang, Keamanan Negara Abstract The steps that must be taken in making an international agreement in connection with the crime of money laundry are: negotiation, signature, ratification. Stages of Money Laundering (Money Laundry) that are distributed to other countries are carried out by: Placement of money (placement); Layering, and integration of money.

Abstract

The crime of corruption is a problem that is currently felt to be growing rapidly along with the more advanced development of a nation, the increasing need and encouraging corruption. What are the efforts to prevent pluralism of investigations on corruption in the criminal justice system. What are the obstacles in efforts to prevent pluralism of investigations in the criminal act of corruption. In this study, the author uses a type of normative juridical research. Efforts to prevent pluralism of investigations into criminal acts of corruption in the Criminal Justice System are based on the authority of the Police, the Prosecutor's Office, and the KPK, in dealing with corruption cases must be based on law and its implementation cannot be carried out independently by one institution alone, but must be coordinated with other authorized institutions as well as regulated in law. The implementation of the criminal justice system, until now has not shown optimal performance because it is structurally not integrated in terms of the concept of function and supervision in the management of the judicial system/law enforcement not in a broad sense, weak in law enforcement because it is domiciled under executive (government) power. so that in certain cases the implementation of criminal law enforcement is influenced by executive power and does not rule out the influence of other powers, so there is still no firmness regarding the differences between executive, judicial, and legislative functions.

Abstract

Financing institutions are a more flexible alternative to banks for meeting the needs of the community, as stipulated in Presidential Regulation No. 9 of 2009. However, financing companies are not immune to the risk of bankruptcy, which can harm vehicle creditors. The main questions that need to be answered are what legal measures creditors can take and what factors cause bankruptcy. This study employs a normative legal method, referencing Law No. 37 of 2004 on Bankruptcy, particularly Articles 11, 13, and 14, which provide creditors with the option to file objections, appeals, or requests for reconsideration. The causes of bankruptcy can also be traced through economic and trade literature. However, the 2004 Bankruptcy Law still has weaknesses, particularly regarding authority in syndicated loans, necessitating clearer regulations to avoid legal confusion, especially in distinguishing the legal status of individual bankrupt debtors from legal entities and their legal consequences.
