Abstract

The increasing sales and high market demand for Thrift Fashion pose several risks, particularly concerning consumer safety and the sustainability of the business climate within the same market. Imported second-hand clothing may be classified as hazardous goods or products due to its free circulation without adequate quality control. This research aims to examine the challenges, obstacles, and policy implications in addressing the sales of Thrift Fashion in Indonesia. The methodology employed in this study is purely normative legal research, relying solely on secondary data sources. The findings indicate that Thrift Fashion is explicitly prohibited in Indonesia, as stated in Law Number 7 of 2014 concerning Trade, Law Number 8 of 1999 concerning Consumer Protection, and Regulation of the Minister of Trade Number 40 of 2022. The issue surrounding Thrift Fashion extends beyond the actions of consumers and business actors; it is also influenced by insufficient law enforcement to prevent the circulation of such goods. In response to this, it is essential to adopt effective solutions to address the proliferation of Thrift Fashion. One such solution is to educate consumers about the risks associated with the violation of product usage rights and to raise awareness among business actors at various levels regarding their obligation to ensure the quality of the products they sell. The government could also offer compensation or targeted subsidies to business actors engaged in the Thrift Fashion trade, enabling them to transition to alternative businesses when their products are confiscated and destroyed.

Abstract

ABSTRACT Objective: This research aims to undergo a juridical analysis of the stipulations for the adoption of refugee children from the perspective of international law.  Methodology: This was juridical normative research that collected data using the literary study method. This research used primary legal materials, secondary legal materials, and non-legal materials research instruments. Findings: A core principle in making policies concerning refugee children is the ‘best interest rule’, which has two main implementations: the making of governmental policies and decisions made on the children as individuals. Adoption may only be considered after all efforts on tracing and reunifying child refugees with their families have failed, or if the child’s parents have agreed on that adoption according to the standard stipulated in the Convention on the Protection of Children and Co-operation in Respect of Intercountry Adoption. A jurisprudence concerning this was the case of Mariya Abdi Ibrahim vs Norway in the European Court of Human Rights for Application No. 15379/16. Indonesian stipulations are not in line with the international law that allows the adoption of refugee children. Application: This research may provide insight for the Indonesian government in considering an alternative care model for the many child refugees in Indonesia. Originality: This research described alternative model patterns that may be applied in Indonesia, as the government only regulated the prohibition of adopting international child refugees in Indonesia. But when referring to some international conventions, some types of alternative care are permitted, including adoption, even though it is only applied as a last resort. Abstract

Examines the application of the consequence test as a balancing instrument between openness and confidentiality in determining exempted information within the local government of Purworejo Regency. The study is motivated by the tension between the constitutional right to public information access under Article 28F of the 1945 Constitution and the obligation to protect certain information categorized as exempt under Law No. 14 of 2008. Although the Freedom of Information Act (FOIA) establishes a limited list of exempt information, practices in Purworejo reveal inconsistencies in understanding and implementation, potentially leading to legal consequences such as information disputes at the Information Commission, as well as practical impacts, including low transparency and public participation. Using a normative-empirical legal approach, the research analyzes the legal framework and field implementation, including focus group discussions with stakeholders and a review of the Information Exemption List issued by the PPID (Public Information Disclosure Officer). Findings emphasize the critical need for a strict and proportional application of the consequence test to ensure that information exemptions are based on actual potential harm, not to conceal irregularities. The study recommends strengthening PPID capacity and oversight mechanisms to fully realize good governance principles.

Abstract

Dalam sistem peradilan pidana anak di Indonesia, bahwa anak sebagai pelaku tindak pidana dapat diproses peradilan pidana dan dihukum. Penelitian ini bertujuan untuk mengetahui pertimbangan yang digunakan Hakim didalam menangani kasus kepemilikan bahan peledak tanpa hak yang dilakukan oleh anak pada Putusan perkara Nomor X/Pid.Sus-Anak/2024/PN Kbm. Metode penelitian yang digunakan yaitu penelitian hukum normatif, dengan pendekatan perundang-undang (statue approach) dan pendekatan kasus (case approach). Penelitian ini menggunakan data sekunder yaitu bahan hukum primer dan bahan hukum sekunder. Berdasarkan penelitian dapat disimpulkan bahwa Hakim tunggal yang menyidangkan perkara ini berpendapat, bahwa perbuatan terdakwa masuk dalam kualifikasi sebagai tindak pidana berat mengingat ancaman pidana yang tertuang didalam ketentuan Pasal 1 ayat (1) Undang-undang Darurat Nomor 12 Tahun 1951. Namun demikian Hakim tetap berpegang pada ketentuan Undang-undang Republik Indonesia Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak yang diatur pada Pasal 79 ayat (1) hingga ayat (3), yang memungkinkan pidana pembatasan kebebasan untuk tindak pidana berat yang dilakukan anak. Pasal ini juga membatasi hukuman maksimal anak menjadi setengah dari ancaman hukuman orang dewasa dan meniadakan ketentuan minimum khusus pidana. Selanjutnya bahwa pertimbangan Hakim dalam memutus perkara tersebut telah berdasarkan fakta-fakta hukum terdakwa dan alat bukti dalam pemeriksaan di persidangan yang selanjutnya dihubungkan dengan unsur yang didakwakan dalam dakwaan tunggal Penuntut umum. Hakim menyatakan dan memutus untuk dilakukan pidana pembatasan kebebasan dengan pidana penjara di Lembaga Pembinaan Khusus Anak. Hal tersebut telah sesuai dengan ketentuan yang tertuang didalam Pasal 81 Undang-undang Nomor 11 Tahun 2012, karena perbuatan terdakwa dianggap membahayakan masyarakat.
