Abstract

Studi ini bertujuan untuk mengidentifikasi dan menganalisis pengaturan hukum berkaitan dengan penyebaran informasi kepada konsumen berdasarkan peraturan perundang-undangan, yaitu Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UU PK) serta mengkaji tanggung jawab public figure yang menyebarkan informasi tidak benar di media sosial berdasarkan Undang-Undang Informasi dan Transaksi Elektronik. Jenis penelitian dalam studi ini mempergunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan analisis hukum. Hasil studi menunjukkan bahwa Seorang public figure sebagai pihak yang berkedudukan sebagai jasa pengiklan suatu produk wajib untuk memberikan informasi yang benar kepada konsumen. Pengaturan penyebaran informasi kepada konsumen berkaitan dengan promosi produk telah secara tegas diatur dalam ketentuan Pasal 4, Pasal 7, Pasal 8 dan Pasal 10 UU PK. Seorang public figure yang menyebarkan informasi tidak benar berkaitan dengan promosi produk melalui social media yang dapat menimbulkan kerugian konsumen dapat dituntut pertanggungjawaban berdasarkan ketentuan Pasal 45 A ayat (1) UU ITE. Kata Kunci: Perlindungan Hukum, Konsumen, dan Public figure ABSTRACT This study aims to identify and analyze legal arrangements relating to the dissemination of information to consumers based on the laws and regulations, namely Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UU PK) and to examine the responsibility of public figures who disseminate false information on social media based on the Undang-Undang Informasi dan Transaksi Elektronik (UU ITE). The type of research in this study uses a normative juridical research method with a statutory approach, a conceptual approach and a legal analysis approach. The results of the study indicate that a public figure as a party who is domiciled as an advertiser of a product is obliged to provide correct information to consumers. The regulation of information dissemination to consumers related to product promotion has been expressly regulated in the provisions of Article 4, Article 7, Article 8 and Article 10 of the UU PK. A public figure who disseminates untrue information related to product promotion through social media that can cause consumer losses can be held accountable under the provisions of Pasal 45 A ayat (1) UU ITE. Abstract

Land or land rights can be obtained by someone as an heir, either a biological child or a living spouse, either individually or jointly between the biological child and the living spouse. The acquisition of property rights over land occurs through inheritance, which is the transfer of land rights due to the death of a person or heir who holds land rights. The objective of this research is to identify and analyze the regulation of land ownership rights for foreign nationals according to Article 21 Paragraph 3 of the Basic Agrarian Law (UUPA) and to identify and comprehend the implementation of land ownership rights by the State for foreign nationals at the Badung Regency Land Office. This research applies empirical legal research method with statutory approach, legal concept analysis and factual approach. The results of this research indicate that the regulation of the acquisition of property rights to land for foreign nationals according to Article 21 Paragraph 3 of the Basic Agrarian Law is that heirs with foreign citizenship are obliged to relinquish the right within a period of 1 year since the loss of Indonesian citizenship. The implementation of the granting of land ownership rights by the State for foreign nationals in the Badung Regency Land Office is that a foreign national may receive inheritance of land and/or buildings with property rights status (such as a house). However, within one year, the foreign national must transfer his/her rights to the land and/or building to another person.
